RE: CONSTRUCTION OF A 230 KV TRANSMISSION LINE (C. O, G.
PREFERRED ROUTE) FROM LOVELAND TO LONGMONT, IN
WELD COUNTY, COLORADO.
WHEREAS, the PLATTE RIVER POWER AUTHORITY is desirous
of establishing a proposed 230 KV transmission line from Loveland to
Longmont within Weld County road rights-of-way on County Road No. 3 ,
and
WHEREAS, said PLATTE RIVER POWER AUTHORITY has sub-
mitted an agreement to the Weld County Board of County Commissioners,
copy attached herewith, including Exhibits A and B showing preferred route
and cross-section of transmission rights-of-way, all of which are attached
hereto and made a part hereof by reference, and
WHEREAS, the Board believes it to be in the best interests of the
County to enter into such an agreement in accordance with the conditions
and stipulations as contained therein.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that said AGREEMENT/prgAiiriVoE,xhbit:

the construction of a 230 KV transmission line (C, O, G. preferred route) from
Loveland to Longmont, in Weld County, copy of which is attached hereto and
made a part hereof by reference, be, and it hereby is approved.
BE IT FURTHER RESOLVED, that the Board be, and it hereby is
authorized to execute the Agreement as submitted and to make the same
effective forthwith.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 19th day of November,

ELECTRIC TRANSMISSION LINE RIGHT-OF-WAY
AND SUBORDINATION AGREEMENT
THIS AGREEMENT made and entered into this /1z day of November,
1975 by and between the County of Larimer, State of Colorado, acting by and
through its Board of County Commissioners (hereinafter called the "County")
and the Platte River Power Authority, a separate governmental entity of the
State of Colorado (hereinafter called "Platte River");
WITNESSETH:
WHEREAS, the Larimer-Weld Regional Council of Governments has
designated the electric transmission line route shown in Exhibit "A" which
is attached hereto and incorporated herein by this reference, as its preferred
route for Platte River's proposed 230 kV Transmission Line from Loveland to
Longmont (the "COG Preferred Route");
WHEREAS, the County favors the COG Preferred Route and is willing
to grant Platte River a perpetual and dominant right to the use of a portion
of the County road right-of-way along the COG Preferred Route in order to
minimize the need for Platte River to erect its transmission towers on adja-
cent private lands;
WHEREAS, Platte River is willing to follow the COG Preferred Route
and to locate its transmission towers inside the County road right-of-way as
preferred by Larimer-Weld COG and the County, PROVIDED; (a) that Platte River
is granted the perpetual and dominant right to the use of that portion of the
road right-of-way occupied by its transmission line, (b) that the County sub-
-
ordinates its use of such portions of the road right-of-way to the use by
Platte River, and (c) that the parties agree that Platte River shall have no
obligation to relocate said transmission line at its expense in order to accom-
-
modate some other or future enlarged use of said County road right-of-way;

NOW THEREFORE, in consideration of the mutual covenants hereinafter
contained, the parties agree as follows:
1. Right to use. The County does hereby grant to Platte
River the perpetual right to locate an electric transmission
line inside the right-of-way for Larimer County Road No. 11 along
the route shown on Exhibit "A" with the transmission line towers
to be located within the County road right-of-way as shown on
the typical cross section attached hereto as Exhibit "B" and in-
- corporated herein by this reference, and hereby agrees that the
conductor wires may overhang, to the extent necessary, any portion
of the traveled road; PROVIDED that the clearance between any con-
ductor and the road surface shall be at least 25 feet vertically.
The parties do further agree that the rights granted to Platte
River by this Agreement include:
a) The dominant right to use the outer ten (10) feet
along either or both sides of the County road right-of-way
for a line of single poles supporting electric transmission
circuits. The outer edge of each pole foundation shall not
be further than two (2) feet from the dividing line between
the County road right-of-way and adjacent property.
b) The dominant right for Platte River to use such por-
tion of the County road right-of-way for such transmission
purposes, meaning that use by the County of that portion of
the County road right-of-way so used by Platte River is here-
by subordinated to such use by Platte River, and if a relo-
cation of the transmission line should subsequently be nec-
essary to accommodate some other or future enlarged use of

the County road right-of-way, all expenses for such relocation
shall be paid for entirely by the party or entity desiring the
relocation.
c) The right to install , construct, operate, repair, main-
tain and replace said transmission line.
2. Agreement by Platte River. Platte River agrees to follow
the COG Preferred Route with its transmission line, as shown in
Exhibit "A".
3. Binding on Successors. This Agreement shall be binding upon
and inure to the benefit of the successors and assigns of the parties.
4. Amendment or Modification. No amendment, modification or
relinquishment of the rights and obligations resulting from this
Agreement shall be effective unless evidenced by a writing signed by
all of the parties hereto.
IN WITNESS WHEREOF, the parties have duly executed this Agreement as
of the date hereinabove set forth.

Dear Glenn:
Enclosed are two (2) copies of the route for the Platte River
Power Authority transmission line between Loveland and Longmont,
as recommended by the Larimer-Weld Regional COG and adopted by
the Platte River Board. Included with the route maps is the
right-of-way and subordination agreement between Weld County and
Platte River providing for Platte River's use of Weld County
Road 3, and a similar agreement with Larimer County on its County
Road 11 .
Both copies have been executed on behalf of Platte River. One
copy is for Weld County and the other for you as Chairman of the
Larimer-Weld Regional COG. An executed copy of all documents has
also been provided to the Larimer County Commissioners.
Final determination of this line routing has been a problem for all
of us and it is good to have it settled. Hopefully the final seg-
ment eastward to Fort St. Vrain will be easier.
