RE: APPROVAL OF VARIANCE FROM SECTION 9-4 A. (7) OF THE WELD COUNTY
SUBDIVISION REGULATIONS - JANET AND GERALD ROTH
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado did, on January 22, 1979, approve Recorded Exemption
No. 369 for Janet and Gerald Roth, and
WHEREAS, Section 9-4 A. (7) of the Weld County Subdivision
Regulations states that the minimum size of any building site,
tract or lot created by the recorded exemption procedure shall
not be less than one (1) acre, except when smaller lot sizes are
allowed in a specific zoning district, and
WHEREAS , under Section 12 A. of the Weld County Subdivision
Regulations, a variance may be granted by the Board of County
Commissioners of Weld County, Colorado, and
WHEREAS, Janet and Gerald Roth have requested a variance
for Lot A, said lot being 0. 77 acres, more or less in size. Lot
A was created by the recorded exemption procedure, and
WHEREAS, the Department of Planning Services of Weld County
recommends that said request be approved.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of Weld County, Colorado that the request of Janet and
Gerald Roth for a variance from Section 9-4 A. (7) of the Weld
County Subdivision Regulations be, and hereby is, approved.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 22nd day of
January, A.D. , 1979.
