This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Project description: Bill Barrett Corporation drilled the Anschutz State 5-62-36 well in January 2014 and is proposing to complete this well as a Class II Underground Injection Well. The existing agreement allows for the pad disturbance and an 80 foot road and pipeline corridor. Existing infrastructure within the area will allow for future piping of water to the tanks. Roads: This project is west of CR 89 (local gravel) and is south of CR 56 (section line/non-maintained). The latest ADT on CR 89 was 17 vpd taken on 8/18/11. Traffic: The traffic narrative information provided with the submittal states that the site will have 1 employee per shift with only 1 shift per day. On average, 20 roundtrip trucks will access the site and travel north or south on CR 89. Access: Access is from CR 89 then west on CR 56 via a private driveway (3.5 Miles). An access permit has been approved for the access to the site (AP14-00069). Access improvements are required and shall include 60ft radii to accommodate turning trucks and double cattle guards across the access to prevent the tracking of mud onto the County maintained gravel roadway. Alternatives such as recycled AC or gravel may be considered with lighter traffic impact projects. General Site Plan Requirements: Improvements/Road Maintenance Agreement: A draft of the agreement will be provided to the applicant after approval of the application at the BOCC hearing. Possible mitigations included in the road maintenance agreement may include but are not limited to: dust control, specified haul routes, damage repairs, and future improvement triggers. A drainage narrative was submitted on Sept. 2, 2014, revised on Oct. 14, 2014 describing the site drainage and water quality sizing. This is acceptable to Engineering. Grading Permit: A Weld County Grading Permit will be required if disturbing more than 1 acre. Contact the Planning Department for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303- 692-3575. CONDITIONS OF APPROVAL: Prior to recording the plat: A. An Offsite Improvements Agreement and Road Maintenance Agreement is required for this site. Road maintenance including dust control, damage repair, and triggers for improvements will be included. B. The applicant shall complete a Nonexclusive License Agreement for the upgrade and maintenance of Weld County RD 56 Right-of-Way. The plat shall be amended to delineate the following: A. The County Road 56 Section Line is estimated to have 60 feet of unmaintained County line right-of-way. The applicant shall verify the existing right-of-way and the documents creating the right-of-way and this information shall be noted on the plat. All setbacks shall be measured from the edge of right-of-way. B. Show the approved non-exclusive license agreement on the Plat and label it with the recorded reception number and date. C. Show the approved access on the plat and label with the approved access permit number (AP14-00069). D. The applicant shall indicate specifically on the plat the type of right-of-way/easement and indicate whether it is dedicated, private, or deeded to provide adequate access to the parcel. E. Show and label standard tracking control onto publically maintained roadways on the map. F. Show the accepted water quality feature on the map and label as (Water Quality Feature, No-Build or Storage Area), as well as the design volume. G. The map identifies CR 54 as CR 56 one mile north of the site. This should be changed to CR 54. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to the start of construction. Contact the Planning Department for application information. B. In the event that 1 or more acres are disturbed, the applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and Environment. C. Right of way permit is required for any work within the public right of way. D. Special transport permit is required for any over size or over weight vehicles. Prior to Operation: NA DEVELOPMENT STANDARDS (NOTES ON THE PLAT) 1. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 2. The historical flow patterns and runoff amounts will be maintained on the site. 3. Weld County is not responsible for the maintenance of onsite drainage related features. 4. There shall be no parking or staging of vehicles on County roads. On-site parking shall be utilized. 5. The right-of-way or easement shall be graded and drained to provide an all-weather access. There will be no full time employees at the facility and the applicant is proposing to provide portable toilets and bottled water during construction and operation of the facility. The applicant submitted a Waste Handling Plan. The waste handling plan describes how wastes generated onsite will be disposed of off-site. The applicant submitted an approved Dust Abatement Plan. The dust abatement plan indicates that gravel will be used for access and travelways within the facility and that water or magnesium chloride will be applied as needed for dust abatement purposes. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: 1. Prior to allowing the plat to be recorded: A. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1. A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2. A list of the type and volume of chemicals expected to be stored on site. 3. The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). 4. Solids and sediment will accumulate in the storage tanks. The waste handling plan shall include a detailed plan that describes the method of how those solids will be removed, including all on-site handling procedures. 5. The waste handling plan shall provide a commitment to notify the Weld County Department of Public Health and Environment in writing, in the event the plan is amended. The plan shall be reviewed and approved by the Weld County Department of Public Health and Environment. 2. We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to release of building permits: A. The applicant shall submit evidence of an APEN and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment, if applicable. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. B. The applicant shall submit a Groundwater Monitoring Plan, and the Groundwater Monitoring Plan shall be approved by Weld County Department of Health and Environment. Evidence of such shall be submitted, it writing, to the Department of Planning Services. C. The facility shall post financial assurance with the COGCC. The financial assurance shall be adequate to cover a third-party closure of the facility, including the plugging and abandonment of the well, in accordance with industry standards, and the removal of all structures (including concrete) on the facility. The site shall be returned to its original grade. The facility shall submit evidence to Weld County Department of Public Health and Environment that the appropriate financial assurance has been obtained. D. A Detailed Closure Plan shall be submitted to Weld County Department of Public Health and Environment. The Closure Plan shall include a description of the manner in which the well will be plugged and abandoned, as well as specific details regarding reclamation of the property. No structures or equipment associated with the facility shall remain on the property following closure. E. Detailed Plans for a concrete unloading pad shall be submitted for acceptance. A leak detection system shall be designed and installed beneath the concrete unloading pad(s) and sump(s). The plans and engineered drawings will be stamped and signed by a Colorado Registered Professional Engineer (PE). Plans shall be submitted to and accepted by Weld County Department of Public Health and Environment. 2 F. Detailed plans for the concrete secondary containment structure for all storage and processing tanks shall be submitted for acceptance. Secondary containment volume shall provide containment for the entire contents of the largest single tank plus sufficient freeboard to allow for precipitation. The plans and engineered drawings will be stamped and signed by a Colorado Registered PE. The Weld County Department of Public Health and Environment will consider structures other than concrete, provided a Colorado Registered PE provides a certification indicating that the proposed alternate containment system meets, or exceeds, the function of a concrete system with regard to containment, spills, and unintended releases. Plans shall be submitted to and accepted by Weld County Department of Public Health and Environment. 3. We recommend that the following requirement be incorporated into the permit as a condition that must be met within six months of operation: A. A PE certified and signed copy of the Spill Prevention, Control and Countermeasure Plan, prepared in accordance with the applicable provisions of 40 CFR, Part 112 shall be provided to Environmental Health Services Division of the Weld County Department of Public Health and Environment. B. The applicant shall submit documentation to the Weld County Department of Public Health and Environment that the facility was constructed in accordance with the application materials. 4. We recommend that the following requirements be incorporated into the permit as development standards: A. No disposal of waste, other than Class II, as currently defined by the Environmental Protection Agency, is permitted. Any changes from the approved Class II use will require an amendment to this Use by Special Review Permit. B. All liquid wastes received at the facility shall be unloaded on the unloading pad. The unloading/loading pad leak detection system shall be constructed and operated in accordance with the approved design. The unloading pad shall be cleaned at a frequency that prevents oils and other wastes from building up on the pad. During winter months, the facility shall maintain the unlading pad free of ice. C. Analytical waste data and environmental monitoring data shall be made available to Weld County Department of Health and Environment upon request. The Weld County Department of Health and Environment reserves the right to require additional monitoring. 3 D. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. E. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. F. Any contaminated soils on the facility shall be removed and disposed of in accordance with applicable rules and regulations. All spills will be documented and records will be kept onsite for WCDPHE review upon request. All spills will be reported to local, state and federal agencies in accordance with all state and federal regulations. G. The facility shall comply with the approved Groundwater Monitoring Plan. H. All stormwater, which has come into contact with waste materials on the site, shall be confined on the site. In the event the storm water is not adequately controlled on the site, upon written notification from the WCDPHE or CDPHE, a comprehensive site-wide Stormwater Plan shall be developed and implemented. The plan must be approved, in writing by the WCDPHE or CDPHE, prior to implementation. I. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The facility shall operate in accordance with the approved "waste handling plan", at all times. J. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall operate in accordance with the approved "dust abatement plan", at all times. K. This facility shall adhere to the maximum permissible noise levels allowed in the non-specified Zone as delineated in Section 14-9-30 of the Weld County Code, or with all applicable State noise statutes and/or regulations. L. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. As employees or contractors are on site for less than 2 consecutive hours a day portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the 4 Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. M. All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAPs) and volatile organic compounds (VOCs). All chemicals must be stored securely, on an impervious surface, and in accordance with manufacturer's recommendations. N. A current PE certified and signed copy Spill Prevention, Control and Countermeasure Plan shall be available on site, at all times. O. The operation shall comply with all Colorado Oil and Gas Conservation Commission rules and regulations. P. A geotechnical engineering report performed by a registered State of Colorado engineer shall be required or a open hole inspection. A search of the Colorado Cultural Resource Inventory database indicated that no cultural resource inventories have taken place in the vicinity of the proposed project area and no historic properties have been recorded within the subject property. However, our files contain incomplete information for this area, as most of Colorado has not been inventoried for cultural resources. As a result, there is the possibility that as yet unidentified cultural resources exist within the proposed project area. As you may be aware, under state and federal laws, our office. the State Historic Preservation Office, takes on a consulting role on projects that have the potential to affect historic properties (such as buildings and archaeological sites). Please note if this project includes Federal involvement(federal permitting, federal funds or federal lands), Section 106 of the National Historic Preservation Act (16 U.S.C. 470) requires the federal agency to meet the requirements of as set forth in 36 CFR 800 ("Protection of Historic Properties") and the lead federal agency remains legally responsible for all required findings and determinations of National Register of Historic Places(NRHP)eligibility and project effects(36 CFR 800.2(a)(3)). Should the project uncover human remains during the proposed project activities, the requirements under State law C.R.S. 24-80 (part 13)apply and must be followed.
