I did not know until today that we only have a week or so to work out our issues as the Board meets on October 7th and they need everything signed by then. As we discussed, my client, t, Stephanie Odell, and your client Rick Davis each own an undivided '/z interest in the 5909 W C St. Property. My client owns her undivided one half in an LLC. There are several things happening now regarding this property. Through property research conducted by the Department of Planning Services for a pending land use application (US 14-0046), the Weld County Zoning Dept. Staff determined there was a conveyance of property in 1998 by Windon and Betsy Davis, owners of real property described as Lot B of Recorded Exemption No, RE-783 to Weld County without proceeding through the applicable subdivision of land application process. To rectify this condition an amendment to the existing Recorded Exemption is necessary. The City of Greeley, and the current property owner of this conveyance, provided a letter of support for the amendment to Recorded Exemption No. 783. The Department of Planning Services in conjunction with the City of Greeley have completed the property survey and have now prepared a Mylar plat for signature and recording to rectify this condition. Additionally, Mr. Davis began an application for use by special review for a wood chipping operation on the property. He filed the application using a POA he obtained under questionable circumstances. At the time of the application, August 4, 2014, Windon owned 1/2 of the property; Betsy Davis owned the other 1/2. Although she died earlier and left Rick Davis an undivided '/2 interest in the property, Rick was not yet in title as her will had not yet been probated. Although Windon Davis was the personal representative of Betsy's estate he could not grant that power (of a fiduciary) via POA. It is less than clear as to who had authority to give permission to whom for the application. The county needs to clear up these authority issues, wants to make sure that the current owners are in agreement and wants my client to sign the plat and application as part owner and as personal representative of the estate and wants Ms. Odell to EXHIBIT sign a statement or letter that Mr. Davis may act on behalf of the estate for the land use application Rick Davis initially filed before the Board will approve the application. Your client has also been charged with a zoning violation for conducting a non- conforming use on the property and there are apparently neighbors to the West resisting his application. The planning commission has recommended approval of the rezone and re- subdivision of the lots and there will be a hearing on Wednesday October 7, 2015 to approve the recommendations of the County Planning Commission. The new plat, if approved by the Board of County Commissioners will designate your client's house and the one-acre of property upon which it is located as "Lot A" and the remaining property, approximately 40-50 acres, as "Lot B". The Lot A property is valued by the assessor at about$ 113,000.00 and the Lot B is valued at approximately $33,000.00. In order to conduct business near your client's house on Lot A, Mr. Davis will need access on to Lot B and will need to use part of Lot B for the operation. Notwithstanding this great disparity in values my client is willing to offer the following: • She would convey her interest in Lot A to Mr. Davis • Davis would convey his interest in Lot B to Ms. Odell • Odell would lease back to Davis the area needed on Lot B for Davis' tenant to operate the wood chipping facility for $ 10.00 a year, automatically renewable for one year periods. The lease would terminate if Davis was not personally and actively participating in the wood chipping operation as he has historically done- the idea being here that the lease is for Rick Davis' benefit and not anyone else. • Davis would have to obtain liability insurance to protect Odell from accident and injury on her land and name her LLC as additional insured. • Odell would waive her right to any rents, past or future from the wood chipping operation • Odell would grant all permissions required by the county for Davis to complete the county application for use by special review and sign the plat. • The parties would agree not to interfere with each others use of the land and not to disparage one another. • This agreement would be a complete release of claims all parties had against the other, their heirs and assigns and the estate of Windon Davis. This agreement would assure the peaceful coexistence of our clients and is a ver y work able solution, but time is of the essence. 1 Please bring this to the attention of your client and get back to me by Monday if possible. The hearing is Wednesday October 7, 2015 to approve the recommendations of the County Planning Commission. This hearing MAY be able to be continued until November 4, 2015, depending on whether the County Attorney will agree, but that is not likely as apparently this matter has been continued numerous times already. Sacco Attorney at Law To whom it may concern, I was asked by Nader G. to comprise a letter detailing my experience while living at 6312 west C street, Greeley, Co., and more specifically, detail the activities on the property next to it . My family resided there from July 2013 thru June 2015, and witnessed the activities first hand on a daily basis. First the log storage side, from what I understand , a local tree cutting business stores cut trees at that location, delivery of material was normally once per day, and had no effect to myself or family. Last summer, for a week long span, a large tree grinder was brought to site to process stumps, this was understandably loud and literally shook the ground while in operation. Secondly, the sawdust processing side, from what I understand, a local company uses the property to store and process sawdust for the local dairy farms. The activity was very sporadic and did not follow a set day or hour timeframe. Semi trucks would deliver and pile material, than process and load for delivery. The unloading , piling, and loading was a moderate annoyance mostly due to the heavy equipment required . For sporadic periods of time, a grinder would come and go, than more recently a grinder was set and processed material for an extended amount of time, than was removed approximately 4 months prior to our departure. The grinding was almost unbearable, as witnessed by a Weld county health inspector commissioned to detail activity. The ambient noise level in my yard exceeded 75 DB for continuous amounts of days, and the dust generated is choking if the wind was blowing towards my house. My personal conclusion, while I am an advocate for personal property freedom of use, I believe some of the activity closest to the 6312 west C st. property is inappropriate for that location. Specifically, the grinding of stumps and sawdust done in such close proximity to the house I lived in. Had I not been in the line of work I do, and since I am interested in some of the product the land owner has to sell, I never complained, however, if circumstances were different, I would have filed a grievance with the county, which I am sure any other occupant would do. I comprise this with no hard feelings towards Ric(neighboring land owner), and hope to continue doing business with him. To whom it may concern, I was asked by Nader G . to comprise a letter detailing my experience while living at 6312 west C street, Greeley, Co., and more specifically, detail the activities on the property next to it . My family resided there from July 2013 thru June 2015, and witnessed the activities first hand on a daily basis. First the log storage side, from what I understand , a local tree cutting business stores cut trees at that location , delivery of material was normally once per day, and had no effect to myself or family. Last summer, for a week long span, a large tree grinder was brought to site to process stumps, this was understandably loud and literally shook the ground while in operation. Secondly, the sawdust processing side, from what I understand, a local company uses the property to store and process sawdust for the local dairy farms. The activity was very sporadic and did not follow a set day or hour timeframe. Semi trucks would deliver and pile material, than process and load for delivery. The unloading , piling, and loading was a moderate annoyance mostly due to the heavy equipment required . For sporadic periods of time, a grinder would come and go, than more recently a grinder was set and processed material for an extended amount of time, than was removed approximately 4 months prior to our departure. The grinding was almost unbearable, as witnessed by a Weld county health inspector commissioned to detail activity_ The ambient noise level in my yard exceeded 75 DB for continuous amounts of days, and the dust generated is choking if the wind was blowing towards my house. My personal conclusion, while I am an advocate for personal property freedom of use, I believe some of the activity closest to the 6312 west C st. property is inappropriate for that location. Specifically, the grinding of stumps and sawdust done in such close proximity to the house I lived in. Had I not been in the line of work I do, and since I am interested in some of the product the land owner has to sell, I never complained , however, if circumstances were different, I would have filed a grievance with the county, which I am sure any other occupant would do. ''. - \ - -L -.-414,441.12....:7.` +`�`�i /", To whom it may concern, I was asked by Nader G . to comprise a letter detailing my experience while living at 6312 west C street, Greeley, Co., and more specifically, detail the activities on the property next to it . My family resided there from July 2013 thru June 2015, and witnessed the activities first hand on a daily basis. First the log storage side, from what I understand , a local tree cutting business stores cut trees at that location , delivery of material was normally once per day, and had no effect to myself or family. Last summer, for a week long span, a large tree grinder was brought to site to process stumps, this was understandably loud and literally shook the ground while in operation. Secondly, the sawdust processing side, from what I understand, a local company uses the property to store and process sawdust for the local dairy farms. The activity was very sporadic and did not follow a set day or hour timeframe. Semi trucks would deliver and pile material, than process and load for delivery. The unloading , piling, and loading was a moderate annoyance mostly due to the heavy equipment required . For sporadic periods of time, a grinder would come and go, than more recently a grinder was set and processed material for an extended amount of time, than was removed approximately 4 months prior to our departure. The grinding was almost unbearable, as witnessed by a Weld county health inspector commissioned to detail activity_ The ambient noise level in my yard exceeded 75 DB for continuous amounts of days, and the dust generated is choking if the wind was blowing towards my house. My personal conclusion, while I am an advocate for personal property freedom of use, I believe some of the activity closest to the 6312 west C st. property is inappropriate for that location. Specifically, the grinding of stumps and sawdust done in such close proximity to the house I lived in. Had I not been in the line of work I do, and since I am interested in some of the product the land owner has to sell, I never complained , however, if circumstances were different, I would have filed a grievance with the county, which I am sure any other occupant would do.
