RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION NO. 301 - ROBERT RAMSAY.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter , is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing
held on the 16th day of January, 1978, in the Chambers of the
Board of County Commissioners of Weld County, Colorado, that the
division into two parcels of a certain parcel of land, as shown on
the plat known as Recorded Exemption No. 301, being the property
of Robert Ramsay, located on a parcel of land in Part of the NW4
of Section 18, Township 4 North, Range 68 West of the 6th P.M. ,
Weld County, Colorado, and being more particulary described on
Exhibit "A" which is attached hereto and incorporated herein by
this reference, does not come within the purview of the definition
of the terms, "subdivision" and "subdivided land" , pursuant to
its authority under Section 20-38-101 (10) (d) , CRS 1973, as amended,
and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not with-
in the purposes of the Weld County Subdivision Regulations and
the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and Section 2-1A (3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land owned by the applicant, be exempt from
the definition of the terms, "subdivision" and "subdivided land"
pursuant to its authority under Section 30-28-101 (10) (d) .

RE: Recorded Exemption #301
Dear Commissioners :
The attached application, plat , and related items are in reference
to a request by Robert D. Ramsay for a recorded exemption. The
subject property is described as Pt . NW* Section 18, T4N, R68W of
the 6th P.M. , Weld County, Colorado. Said property is located 12
miles east of Berthoud on the west side of Newell Lake . The pro-
perty in question contains approximately 38 acres of Class II and
III irrigated soils . The property is proposed to be divided into
parcels containing 8.4 and 29. 5 acres . It is the intent of Mr.
Ramsay to construct a new residence on the 29. 5 acre parcel and to
house his widowed mother in the existing residence on the 8. 4 acre
parcel .
On October 12 , 1977, the Board of County Commissioners approved a
request by Mr. Ramsay for a lot size variance so that he could
make application for this recorded exemption. At the time the
Board made a decision on that request , the Department of Planning
Services Staff submitted a letter of recommendation to the Board.
A copy of that letter of recommendation is included in the attached
packet . Nothing has been received by our office since the approval
of the lot size variance which would change our recommendation of
approval for this request .

Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has determined
at a public hearing held on the 12th day of October, 1977 , in
the Chambers of the Board of County Commissioners of Weld County,
Colorado, that a certain parcel of land is owned by Robert Ramsay,
which land is more particularly described as follows, to-wit:
The South 25 acres of the SW4 of the NW; of Section 18, Township 4
North, Range 68 West of the 6th P.M. , EXCEPT a portion thereof

west quarter as bearing North and South and with all bearings herein

Ramsay may make application to the Board of County Commissioners
to apply for a recorded exemption, as set forth in Section 9-4 .
A. (6) of the Subdivision Regulations, and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, based upon the recommendations of the Department of
Planning Services , feels that the applicant has shown good cause
for granting a lot size variance under Section 9-4 .A. (6) of the
Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that a variance from lot
size requirements , be, and hereby is , granted to Robert Ramsay
' 'for the above-described parcel of land.
The above and foregoing Resolution was , on motion duly made

Dear Commissioners :
The. attached letter and related items are in reference to a
request by Robert Ramsay for a lot isze variance . The sub-
ject property is described as Pt . of the NWn of Section 18 ,
T4N, R68W of the 6th P.M . , Weld County , Colorado . Said
property is located 1' miles east of Berthoud on the west
side of Newell Lake . The property in question contains
approximately ,38 acres of Class II and III irrigated soils .
The request is to obtain a variance from the minimum lot
size requirement , Section 9 . 4 (a) (G) , so that Mr . Ramsay may
make application to apply for a recorded exemption . Section
9 . 4 (a) (6 ) states , "That that the original tract or parcel of
land to be divided under this section meets minimum lot size
requirements established by the Weld County Zoning Resolu-
tion ; variance from this requirement being allowed only upon
good cause being shown to the Board of County Commissioners
where said tract or parcel of land lies within the Compre-
hensive Plan of an existing incorporated town of Weld County .

If this lot size variance is granted , ?lr. Ramsay will pro-
ceed with his application for a recorded exemption to divide
the property into two lots . The property in question is
proposed to he divided into parcels containing 8 . 4 and 29 . 6
acres , As indicated in a letter dated September 22 , 1977,
it is the intent of Mr . Ramsay to construct a new residence
on the 29. 6 acre parcel and to house his widowed mother in
the existing residence on the 8 . 4 acre parcel .

Based upon the information submitted and the adopted policies in
the county , the Planning Commission staff recommends that the
request be approved for the following reasons :
1 . The Berthoud Planning Commission has indicated they have no
objections to the „ranting of this request .
2 . The request complies with the intent clause of the recorded
exemption procedure (Section 9. 2 of the Weld County Subdivision
Regulations ) , the intent clause of the Agricultural District
(Section 3 . 3(a) of the Weld County Zoning Resolution) , and the
Weld County Comprehensive Plan since the use would be compatible
with surrounding land uses.
