Signature: Owner or Authorized Agent Date S gnatufe: Owne or Auth rized Agent Date Site Specific Development Plan and Use By Special Review Amendment (2/6/15) Weld County, CO Saddle Butte Rockies Midstream, LLC Milton Terminal Saddle Butte's gathering system is currently designed to transport approximately 45,000 barrels of oil per day collected from existing oil development in the immediate area through gathering lines constructed off of the main trunk pipeline and from truck offload lanes at the Milton Terminal. Once polished, the crude will be transported from the Milton Terminal through a 10" interconnect pipeline with the adjacent White Cliffs Terminal or transported to other locations via semi-trucks. The truck loading and offloading facilities will include two lanes associated with the two proposed LACTs. In general,these two lands will be designed to both load and offload semi-trucks and will not change the originally proposed layout of the Milton Terminal. Even with this change, it is anticipated that truck trips per day into the terminal will remain the same at 10 truckloads/day for both loading and offloading. Site Specific Development Plan and Use By Special Review Weld County, CO Saddle Butte Rockies Midstream, LLC Milton Terminal USR Questionnaire 1. Explain, in detail,the proposed use of the property. Saddle Butte Rockies Midstream, LLC (Saddle Butte) proposes to construct approximately 50.8 miles of 4-6" diameter crude oil gathering pipeline, connected to an 13.7-mile, 8" diameter trunk pipeline terminating at a crude oil polishing terminal (Milton Terminal) located in southwestern Weld County (Section 24,Township 3 North, Range 65 West) on property owned by the applicant. From the Milton Terminal,the crude oil will be transported through a 10" interconnect pipeline with the adjacent White Cliffs Terminal. Additional crude oil will be moved in the future through a 8"diameter and approximately 12.4-mile long interconnect pipeline with the Suncor facility near Ft. Lupton. Only the terminal is being reviewed in this Use By Special Review (USR) process as the proposed pipelines are 8" in diameter or less, thus do not require the need for special review. The gathering system is currently designed to transport approximately 45,000 barrels of oil per day collected from existing oil development in the immediate area through gathering lines constructed off of the main trunk pipeline and from truck offload lanes at the Milton Terminal. The Milton Terminal will occupy approximately 18 acres of a 32.12-acre parcel. The remaining 14 acres will initially be utilized as a pipe and equipment laydown yard during construction. Once construction is completed, the remaining portion of the parcel will be held for potential future expansion. 2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan. The Milton Terminal is consistent with Section 22-2-10 (D) which emphasizes the development of natural resources. The land being converted to industrial use is currently non-irrigated rangeland adjacent to an existing crude oil terminal (White Cliffs). Saddle Butte does not anticipate any impact to cultivated lands found nearby. The project is anticipated to have minimal impact to the existing land use of the subject parcel and those surround it. By building the terminal, the project will contribute to the County's industrial economic base by providing additional capacity in the production of crude oil. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning)and the zone district in which it is located. As per Weld County Code, oil and gas support facilitates and services are currently allowed in the Agricultural Zone District upon approval through the USR process. Impacts incurred by the proposed project will be mitigated through reclamation and landscaping and thus, should be minimal and temporary in nature, allowing for existing land uses to continue post construction. 4. What type of uses surround the site (explain how the proposed use is consistent and compatible with surround land uses). The proposed Milton Terminal is located in an area identified as Agricultural Zoning. Part of this designation includes areas of primary use where oil and gas extraction is located. Since the proposed project is in alignment to other existing and nearby land uses and due to the rural nature of the area, it is anticipated that there will be few impacts to traffic and adjacent residences. 5. Describe, in detail,the following: a. Number of people who will use this site During construction,there will be numerous employees at the terminal location. Once construction is completed, Saddle Butte anticipates that approximately 3-5 employees, plus the individual truck drivers, will have access to the terminal during times of truck loading, maintenance and routine inspections. b. Number of employees proposed to be employed at this site Once completed and operational, the number of Saddle Butte employees people using the entire site will be approximately 3 people per week c. Hours of operation The terminal will operate 24 hours/day, 7 days/week, and 365 days/year. d. Type and number of structures to be erected (built) on this site The following structures are proposed at each site: ✓ 4-30,000 barrel tanks ✓ 2-10,000 barrel tanks ✓ 1-10,000 barrel water tank for fire suppression ✓ Mainline pumps ✓ Booster pumps ✓ Sump pump ✓ Sump tank ✓ Outlet metering ✓ Filtration & polishing equipment ✓ Inlet metering ✓ Pig launcher and receivers ✓ Combusters ✓ 2- LACTS for truck loading ✓ 8-400 barrel polishing tanks ✓ Office Building/Warehouse (40'x60') ✓ MCC building ✓ Transformers The attached plot plan provides additional detail. e. Type and number of animals, if any,to be on this site No animals will be associated with this project. f. Kind of vehicles(type,size,weight)that will access this site and how often A total of 15 vehicles (light weight trucks) per week will access the site as well as approximately 10 semi-truckloads per day offloading oil from the terminals. During construction, commercial vehicles will be accessing the Milton Terminal parcel and along the pipeline easement. g. Who will provide fire protection to the site The La Salle Fire Protection District will be providing fire support to the terminal. Saddle Butte will contact the District, as well as the adjacent fire protection districts to inform them about the project and coordinate with them on an emergency action plan. An Emergency Information Sheet will be distributed to each District every year with updated information. h. Water source on the property(both domestic and irrigation) Currently,there is a domestic water well on site (Permit#203955, Receipt#0415328). During construction and initial operation, bottled water will be provided by the construction contractor until a permanent water source can be established. It is anticipated that Saddle Butte will consult with the State of Colorado Department of Water Resources to change to well to commercial use and connect it to the office building as a potable water source. Water for dust abatement will be trucked to the site by the construction contractor from a municipal site. i. Sewage disposal system on the property(existing and proposed) During the construction phase of the project and during the initial operation of the terminal, portable toilets will be provided until a permanent water source can be established and a septic system constructed. There is an existing septic/leach field on the property (#SP-0400192)that will be used once the existing water well is connected to the office building. j. If storage or warehousing is proposed,what type of items will be stored No major storage is proposed for the Milton Terminal site with the exception of a few small parts that will be kept in the warehouse attached to the office building. On the laydown yard to the north of the terminal site, valves, pipe, pump parts etc.will be stored during construction. 6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted as a landscape plan map as part of the application submittal. No landscaping around the Milton Terminal is planned. However, a chain link fence around the perimeter of the site will be installed. 7. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. If and when termination occurs, all improvement will be removed and the site will be reclaimed to its original state and seeded with native seed. 8. Explain how the stormwater drainage will be handled. Stormwater drainage and control will be managed as per the guidelines outlined by the Colorado Department of Public Health and Environment (CDPHE). The applicant will obtain a discharge permit from CDHPE that will cover long term operation and maintenance of the two terminals. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. Construction of the Milton Terminal will take approximately 4-6months. No landscaping is planned for the site. 10. Explain where storage and/or stockpile of wastes will occur on this site. No storage is planned for any site associated with this project. Any waste produced will settle to the bottom of the existing tanks and be removed directly from there. 11. Please list all proposed on-site and off-site improvements associated with the use (example: landscaping,fencing, drainage,turn lanes etc.) and a timeline of when you will have each one of the improvements completed. All improvements proposed for this project will be performed throughout and towards the end of the construction phase. All improvement will be completed based upon the construction stage of each facility and the pipeline and will be weather and seasonal dependent. Currently, it is anticipated that the existing road access from WCR 30 will not be improved. The access from the road to the new office building will utilize the existing access to the property. Access to and from the truck loading LACTS will be created to the north of the existing access or access point for the office building. Saddle Butte Rockies Midstream, LLC Milton Crude Oil Terminal Dust Abatement Plan From construction through operation and maintenance, Saddle Butte Rockies Midstream, LLC will utilize watering as a best management dust suppression practice to control fugitive dust. On unpaved roads, Saddle Butte Rockies Midstream, LLC will utilize water trucks as needed to control dust. Vehicle speeds will also be limited to ten miles per hour to reduce dust. The main access drive and truck circulation areas will be constructed with road base, thereby reducing dust emission. Truck unloading areas will be constructed with concrete. If areas are disturbed due to facility maintenance activities, disturbances will be watered to control dust as needed and vehicle speeds will be limited to ten miles per hour. Revegetation of the disturbed area shall be completed within one year. To prevent dust emissions, disturbed soil shall be furrowed a minimum of six inches deep at right angles to prevailing winds. If needed, silt fence shall be installed as a wind break. Water used for dust suppression will be provided by an offsite source. Saddle Butte Rockies Midstream, LLC Milton Crude Oil Terminal Waste Handling Plan 1. All wastes generated on site will be disposed of by Waste management or Waste management Conservation Services Inc. (CSI). General wasted generated at the terminal will be taken to the Waste Management North Weld Landfill. Wastes generated by or accumulated in tanks will be removed via vacuum trucks and then transported to CSI. Approved by Revised Date 6/29/10 Traffic Plan — Access Permit Application Saddle Butte Rockies Midstream, LLC Milton Crude Oil Terminal Southern Half of the NW4, Sec 24, T3N, R65W WCR 47 Saddle Butte is proposing to construct a crude oil storage and polishing terminal ( Milton Terminal) with an associated pipe laydown yard off Weld County Road 47, approximately %z mile north of Weld County Road 30. The terminal will be built upon an 18 acre portion of a 34 acre piece of property owned and managed by Saddle Butte. The remaining portion of the parcel will be used for the laydown yard . Access to the site will be from WCR 30, north to the site on WCR47. In this area, WCR 47 dead ends approximately 1/3 mile north of the project site, thus there will be no through traffic. During construction of the site, all construction vehicles will be parked off of WCR 47, on the construction site. Warning signs will be placed at least 500 feet either side of the north and south access point to the site. Should dust become an issue with vehicle visibility, water will be applied to control the dust. Once operational, traffic will continue to enter and exit the site off of WCR 47. Traffic Narrative — Use by Special Review Saddle Butte Rockies Midstream, LLC Milton Crude Oil Terminal Southern Half of the NW4, Sec 24, T3N, R65W WCR 47 This traffic narrative is associated with the Use by Special Review application for the proposed Milton Crude Oil Terminal located along WCR 47, approximately '/ mile north of WCR 30 as proposed by Saddle Butte Rockies Midstream, LLC (Saddle Butte). Currently, the proposed construction site is owned by Saddle Butte and has 2 existing access points. The first access point from the south is a 2-track dirt road used to access the existing residential structure. The second access point is approximately 725 feet to the north and is used an existing meter station on the property and to access an existing well on an adjacent property to the east. Saddle Butte is proposing to construct two additional access points from the property to WCR 47. Of the two existing access points, the northern most access will not be altered while the southern-most access point will be widened to allow for semi trucks to enter the terminal . ZION ENGINEERING February 12,2015 Weld County Department of Public Works Drainage Engineer 1111 H Street Greeley,CO 80631 Reference: Revised Drainage Narrative—Saddle Butte Rockies Midstream Milton Terminal Project To Whom It May Concern: Saddle Butte Rockies Midstream, LLC("Saddle Butte")proposes to construct a crude oil terminal located in the SE %of the NW V.Section 24,T3N, R65W in Weld County,Colorado. The site is approximately 17.9 acres in area and sits adjacent to Weld County Road 47 ("WCR 47")on the east side approximately one half mile north of Colorado Highway 30. The terminal site will ultimately contain four(4)73 foot diameter storage tanks, two to three(2-3)42 foot diameter storage tanks with a lined earthen containment berm,pumping equipment,metering equipment,control building, truck unloading facilities, and a combined Operations Control Center / Office building. This letter summarizes the site drainage with the intent of requesting a waiver from the Weld County Department of Public Works requirements for a full drainage report and detention pond. There is a north south ridge that divides the drainage of the proposed site with the eastern 80% draining west to east to the Neres Canal and the western 20% draining to the north northwest to WCR 47 due to a slight rise in the southwest corner of the proposed site. Drainage of the property adjacent to the north and south of the proposed site both drain west to east to the Neres Canal as well. Flow across the proposed site is sheet flow with no natural drainage channels or ditches evident on the site except along WCR 47. Slopes on the site are approximately 1-2% across the site. The proposed site falls within a FEMA Zone C area. Proposed grading for the site is designed to generally smooth out the slight rises and depressions across the site to give an even sheet flow for the site draining from west to east southeast leaving the slight north south ridge described above intact. The grading for the western 20% of the site will follow the natural drainage, again smoothing out the slight knobs and depressions in the site. In addition to the grading of the site for drainage, structural fill will be imported to construct the secondary containment berm around the planned storage tanks. The area inside the containment berms will be lined with clay or HDPE and will drain to a sump in the southeast corner of the containment such that it can be pumped out of the containment area in the case of a major storm. The Inside area of the containment berm is approximately 2.75 acres. The proposed grading design includes one Water Quality Feature on the southern portion of the east side of the site to intercept the drainage from the working areas of the site. This water quality feature is one foot deep and has a volume of approximately 9,600 cubic feet with a required volume of 3,701 cubic feet for the entire site. There is also a Water Quality Feature planned between the north and south truck unloading drives with a volume of approximately 6,600 cubic feet to collect water from the western 20% of the site which requires a volume of 740 cubic feet. See the calculation below for the required Water Quality Feature volume. The total site imperviousness(I)Is 0.083. The proposed grading and drainage for the project will not cause increased impacts to properties downstream of the project site. These include motor vehicles for operations personnel;crude oil trucks loading from the truck rack;rotating equipment associated with the trucking Lease Automatic Custody Transfer("LACi")units,booster pumps,and mainline pumps;mixers on the API 650 storage tanks;and motor starters and associated switchgear for starting and operating the respective electric motor drivers on the pumps,in addition to the noise generated from the crude oil flowing through the terminal piping and the motor operators on the actuated valves. The planning and design of the terminal incorporates several mitigating measures to reduce and/or eliminate the noise generated by the terminal facilities at the property fence line in order to minimize the impacts to the surrounding properties. These include laying out the facilities within the terminal site,so that the larger noise generating equipment such as the pumps and associated switchgear are located more towards the center of the terminal property in order to maximize their distance from the property line. The motors for these pumps will also be located in weather proof enclosures incorporating a Class F or better insulation,providing a level of additional noise abatement. The motor starters and associated switchgear for the booster and mainline pumps will also be housed in a pre-fabricated,approximately 14'wide x 40'long,motor control center("MCC")building,reducing the noise level generated by this equipment. All piping within the facility will be designed to maintain fluid velocities below the specified choke velocity and erosional velocity for the selected piping material. This in turn will reduce the noise level generated by the vibration of the terminal piping during normal operations. Vehicular traffic will generate the greatest degree of noise within the terminal site. Efforts to mitigate vehicular noise include the design and incorporation of properly compacted roadways and parking areas throughout the terminal site,along with lower posted speed limits of 5 mph within the terminal property. In addition,trucking operations will be maintained during daylight hours only,eliminating noise from truck traffic in the evening and overnight hours. Below are Saddle Butte's response to the Planning Services' conditional recommendations. 1A. Saddle Butte currently has an application before the Colorado Department of Water Resources (attached) requesting the change of use of the existing well from domestic to commercial (non-exempt). 1B. Saddle Butte is in the process of reviewing an example Agreement and have been in contact with Mr. Rich Hastings. It is our understanding from Mr. Hastings that the final Agreement will not be submitted to Saddle Butte until the USR process is complete and an approval from the BoCC is granted. At that time, it is Saddle Butte's intention to sign the Agreement. 1C.. FRICO ROW does not access property owned by Saddle Butte, thus their ROW will not be used for access to the Milton Terminal. Any water discharged on the Milton Terminal site will not be allowed to enter in to the canal adjacent to the Saddle Butte property. Current grading plans direct stormwater from the terminal site to a retention pond in the southeast corner of the property, preventing the stormwater form flowing into the canal.
