HomeMy WebLinkAbout20153738.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO NOVEMBER 30, 2015 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, November 30, 2015, at the hour of 9:00 a.m. IR ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Barbara Kirkmeyer, Chair- EXCUSED Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Julie A. Cozad Commissioner Steve Moreno Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly MINUTES: Commissioner Moreno moved to approve the minutes of the Board of County Commissioners meeting of November 25, 2015, as printed. Commissioner Conway seconded the motion, and it carried unanimously. El CERTIFICATION OF HEARINGS: Commissioner Conway moved to approve the Certification of Hearings conducted on November 25, 2015, as follows: 1) USR15-0040 -W3 Legacy, LLC, and 2) USR15-0045 -Warren Woodward and Davidson Company, c/o Centennial Storage, LTD. Commissioner Moreno seconded the motion, which carried unanimously. Ei AMENDMENTS TO AGENDA: Commissioner Moreno moved to approve an amendment to add #7 to New Business items. The motion was seconded by Commissioner Conway, and it carried unanimously. CONSENT AGENDA: Commissioner Moreno moved to approve the Consent Agenda as printed. Commissioner Conway seconded the motion, and it carried unanimously. El PUBLIC INPUT: No public input was given. BIDS: la 1)APPROVE BID#61500178, STADIUM LOCKERS (COMMUNITY CORRECTIONS FACILITY) - DEPARTMENT OF JUSTICE SERVICES(CON'T FROM 11/16/2015):Trevor Jiricek, Director of General Services, presented the ten (10) bids received and stated staff recommends awarding the bid to Certified Minutes, November 30, 2015 2015-3738 yo, Page 1 BC0016 Business Services, Inc. In response to Commissioner Moreno, Mr. Jiricek stated Doug Erhler wanted to inspect the products from the four (4) lowest bidders to make sure they met all the requirements and specifications. Mr. Erhler explained staff chose Certified Business Services, Inc., because the product met the specifications and needs. After a lengthy discussion, it was suggested the matter be continued. Commissioner Conway moved to continue this matter to December 14, 2015. The motion was seconded by Commissioner Moreno, and it carried unanimously. ID 2) APPROVE BID #B1500186, ISLAND GROVE DISCHARGE LINE - DEPARTMENT OF BUILDINGS AND GROUNDS: Mr. Jiricek reported staff received nine(9)bids and recommends awarding the low bid to Excavation and Construction Specialist, Inc., for the amount of$39,296.00. Commissioner Moreno moved to approve said low bid. Seconded by Commissioner Conway, the motion carried unanimously. ID 3) APPROVE BID #B1500187, UPS (BACKUP) - CENTENNIAL CENTER - DEPARTMENT OF BUILDINGS AND GROUNDS: Mr. Jiricek stated staff recommends awarding the low bid to Eckstine Electric Company for the amount of$72,227.00. Commissioner Moreno moved to approve said low bid. The motion, which was seconded by Commissioner Conway, carried unanimously. (Clerk's Note: Commissioner Cozad arrived at 9:19 a.m.) NEW BUSINESS: ID 1) CONSIDER APPLICATION FOR JAIL BASED BEHAVIORAL HEALTH SERVICES GRANT AND AUTHORIZE CHAIR TO SIGN: Roger Ainsworth, Sheriffs Office, and Matt Elbe, Sheriffs Office, explained the grant is to support the Sheriffs Office in providing services to the offender populations and transfer inmates upon release to community providers. Commissioner Conway moved to approve said application and authorize the Chair to sign. Commissioner Cozad seconded the motion, and it carried unanimously. El 2) CONSIDER CONTRACT AMENDMENT FOR END USER HOSTING AGREEMENT AND AUTHORIZE CHAIR TO SIGN - LABLYNX, INC: Mary Truslow, Department of Information Technology, presented the amendment for the software that is used by the Environmental Health Services Department. The amendment will allow an increase in the hours of support from four(4) hours to sixteen (16) hours. Commissioner Cozad moved to approve said amendment and authorize the Chair to sign. The motion, which was seconded by Commissioner Moreno, carried unanimously. El 3) CONSIDER APPLICATION FOR ENERGY AND MINERAL IMPACT ASSISTANCE PROGRAM GRANT FOR CR 44 FROM CR 39 TO CR 43 (TIER I-PHASE 2) AND AUTHORIZE CHAIR TO SIGN: Elizabeth Relford, Department of Public Works, explained the application is for a grant to cover the material costs of the project. Commissioner Conway moved to approve said application and authorize the Chair to sign. Seconded by Commissioner Moreno, the motion carried unanimously. El 4) CONSIDER RELEASE OF WEED CONTROL ENFORCEMENT LIENS - FRANKLIN HOBART: Tina Booton, Weed and Pest Division, stated Franklin Hobart paid his taxes so the lien can be removed. Commissioner Conway moved to approve said release enforcement lien. The motion, which was seconded by Commissioner Cozad, carried unanimously. IEI 5) CONSIDER RELEASE OF WEED CONTROL ENFORCEMENT LIEN - JAMES THOMPSON: Ms. Booton recommends the lien be removed since Mr.Thompson paid his taxes. Commissioner Conway moved to approve said release of weed control enforcement lien. The motion was seconded by Commissioner Cozad, and it carried unanimously. Minutes, November 30, 2015 2015-3738 Page 2 BC0016 El 6) CONSIDER CERTIFICATION OF WEED ENFORCEMENT LIEN - JAMES THOMPSON: Ms. Booton explained that Mr. Thompson is a repeat offender and hasn't paid his bill, so staff would like to pursue placing a lien on his property. Commissioner Moreno moved to approve said certification. Commissioner Cozad seconded the motion, and it carried unanimously. El 7) CONSIDER DIRECTING CLERK TO THE BOARD TO HAVE PUBLISHED EMERGENCY ORDINANCE NO. 250-B SUPPLEMENTAL APPROPRIATION FOR 2015: Barb Connolly, Controller, explained that this is to give Clerk to the Board the authority to publish the budget adjustment. Commissioner Cozad moved to approve emergency publishing of Ordinance No. 250-B Supplemental Appropriation for 2015.The motion was seconded by Commissioner Conway, and it carried unanimously. El 8) SECOND READING OF CODE ORDINANCE #2015-23, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 5 REVENUE AND FINANCE, OF THE WELD COUNTY CODE: Commissioner Conway moved to read Code Ordinance #2015-23 by title only. The motion was seconded by Commissioner Cozad, and it carried unanimously. Bruce Barker, County Attorney, read the title for the record. Ms. Connolly stated there have been no changes since the first reading. No public testimony was offered concerning this matter. Commissioner Cozad moved to approve on Second Reading. The motion, which was seconded by Commissioner Moreno, carried unanimously. 9) SECOND READING OF CODE ORDINANCE #2015-24, IN THE MATTER OF REPEALING AND REENACTING WITH AMENDMENTS, CHAPTER 2 ADMINISTRATION AND CHAPTER 17 PUBLIC PLACES, OF THE WELD COUNTY CODE: Commissioner Conway moved to read Code Ordinance #2015-24 by title only. The motion was seconded by Commissioner Moreno, and it carried unanimously. Mr. Barker read the title for the record. Ei Joshua Miller, resident of Greeley, reported he is opposed to the changes, the ordinance has been in place for a long time and it has never caused problems before. Et Christy Rodriguez, resident of Greeley, stated she is also opposed to the changes. She expressed the County buildings are not the property of the County Commissioners. She stated, in her opinion, the code is discriminatory and it is wrong to change the use of the buildin s and users of the buildings should follow certain rules and suffer consequences if protocol is broken. al In response to Commissioner Cozad's question, Mr. Barker explained the code gives the Board the ability to say which groups can use the buildings. IE Commissioner Conway expressed he believes these buildings are for the public use, and if the new ordinance is approved, it will prohibit non-profit organizations from using the buildings. He suggested starting over on the code to change the language. Commissioner Cozad expressed a need to clarify the uses of the buildings because all the offices and buildings can't be available to use whenever. Mr. Barker expressed the way the code is written now limits the ability to set rules, which could result in unintended consequences. Commissioner Moreno stated there is a need to find some middle ground. Commissioner Cozad moved to continue said matter to January 18, 2016 to allow for a full Board. The motion was seconded by Commissioner Conway, and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance#2015-23 was approved on Second Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
