If the applicant has everything associated with the business removed from the site prior to the court date, then there will be no court hearing. Should we not be able to make the meeting, I would like this letter to serve as notification of our disapproval for Mr Delgado to receive any further considerations for his inability to act within the confines of the laws established by Weld County. The constant noise and smell coming from his property located across the street from us has been an unwanted burden for months now and should he ask for additional considerations, we feel as if we have endured his unwanted noise, dirt, and smell for the maximum we should. As indicated in the application, the site is located on WCR 15, south of SH 52. This right-of-way is under the jurisdiction of the City of Dacono. Maintenance of the road is provided by the City of Dacono. Specifically, the City has concerns regarding the number of vehicles, weight limits, and the amount of traffic on the WCR 15. The applicant should be directed to the City of Dacono and submit a full traffic impact study and detailed information about weight of vehicles associated with the proposed use. A Cost Agreement will be required to be submitted with the City of Dacono to cover the full cost of review and evaluation of the Traffic Impact Study and other information as requested herein. The proposed use, internal circulation and drainage plans are unclear from the submitted application. Specifically, the City of Dacono is requesting specific details regarding neighborhood compatibility. The narrative in the application states, "this proposal will be established and operated in a manner that is compatible with the existing and planned land uses in the neighborhood" (#3 narrative application). The City of Dacono is requesting detailed information on hours of operation, outside storage, screening and landscaping plans. The City of Dacono would like to review the landscaping plan as referenced in the application. The City of Dacono would like to review the proposed storm water drainage facility. The proposed use is inconsistent with the City's adopted Comprehensive Plan. The Comprehensive Plan identifies this area as future residential medium density. This medium-density residential zone is intended to preserve the traditional building patterns of mixed-sue residential development. This district provides for attached residential dwelling units in addition to single-family homes. Location criteria for this future land use area areas next to arterial or collector streets or accessible to such without passing through less intensive land uses; areas where medium-density land uses are compatible with adjacent land uses; and areas where blight exists, medium density residential is appropriate for revitalization. A trucking operation is clearly in conflict with this future land use. The City of Dacono finds the proposed use as presented in the USR 14-0062 conflicts with existing uses and proposed future land use. The residents of the Glens, including myself are against this Project due to the attached reasons I list. I moved here in early 2012 to be in a peaceful neighborhood that had agricultural zoned areas directly to the east where Johnson's farm is and where an empty lot to the south of me exists where birds and wildlife were abundant. I moved here with he understanding that these areas would remain agricultural and quiet with only occasionally tractors and farming equipment passing by. Now that this truck stop has come in without proper permitting, working on the weekends and after hours has made by home very uncomfortable.and most birds have left the area. This is due to the pounding of hammers on the trucks on a Sunday. Sunday, trucks coming by to this area today made it impossible to talk to my son without getting directly in front of him. This is ridiculous and unacceptable to me. The Planning Commission needs to know that Mr. Geldado may be trying to deceive them by saying its a storage yard when its not. Mr. Gelgado is trying to fool you guys into believing this was his intent when really it is to have seven to 20 trucks there in the morning when they open and during the day be down to maybe 2 to 4 trucks then back up to 7 to 20 trucks again. This is unethical and unlawful conduct by him attempting to make an Industrial Park out of our neighborhood and cares nothing about the his neighbors to the West. I believe I made my point that this is not a storage yard but a truck stop, and the only way I would even consider accepting this would be with compensation and strict enforcing of rules. I for one will be calling police if this continues: Rules would be: • No noise or work after 5 PM weekdays and work from 10 am to 2 pm Saturday and no work on Sunday • No operating noisy equipment after 5 PM and this includes engine type heaters for diesel trucks • No running of trucks after 8 pm weekdays and none whatsoever on weekends. • No trucks crossing the 10 ton limit bridge directly south of the truck stop (it shakes my home apart). • No more than 3(?) trucks may leave and come back the same day or this is not a storage yard, its a truck stop. Also, Unsafe for school kids • No storage of chemicals or materials on site. • Proper containment is in place for any materials that washes from vehicles or is spilled. Falls under the Storm Water Permitting process) • No Jake brakes allowed o Road 15 • No excessive idling of trucks in storage yard. • No visual of trucks from Road 15 (this is the code for storing cars so trucks should be no different) • No more than 3(?) employees or this again is not a storage yard but a truck maintenance yard • No excessive noise that disrupts our day or causes lack of joy due to disturbing the quiescence to be able to get the birds back, which have all left • No backup beepers before 8 AM everyday and non after 5 pm every day. Truck Traffic 1 Reference these requirements when disputing or arguing against having this truck storage /come and go operation across the street. My strategy is that they need to be denied the business and condemn this project all together as the owner willingly broke the laws of Weld County on almost every aspect of the permit application process outlined below. The operation/project/all equipment/trucks/debris needs to be immediately removed and vacate the agricultural property, and return the land to the original condition due to the violation of almost every category of the permit process (below) which includes the following: • Improper Public Notification of the project prior to construction. • Damage of environment of the citizens in east Glens subdivision • Improper construction procedures followed. • Due to not pulling permits per Weld County permitting process. • Increased truck traffic on road 15, which is a safety concern for pedestrians. • Improper notification of driveway to the neighbor prior to installation. • Medal fencing use in agricultural land within Town Limits? • Due to the excessive noise after 5pm and witnessed welding noise on fence until 10 pm. • Due to the amount of over-weight truck traffic driven across the bridge that has already been an issue with needing recoated with asphalt in summer-2014 showing cracking of asphalt again in Sept. 2014. • Due to the impacts of our citizens living in the Glens from noise and pollution affecting the environment. This has disturbed our livelihood and we had not a chance to do anything about it as shown in emails to the Town of Dacono by Joe Kleffner and ?????this being put in. Now on September 23, 2014 we are constantly disturbed from the noisy trucks coming and going directly across the street from our residence. • Due to non-storage use ( pictures need taken) already is proven by trucks coming and going in the same hour or within the same day. • Due to the amount of employees of ?? Working in the newly built truck stop and go. • Due to the storage of construction debris and dirt on the property when this is zoned agricultural no industrial. • Due to maintenance activities being done on trucks impacting the land and surrounding communities • Due to increased pollution from trucks running for hours on end • Due to the drainage impacts of oil and diesel spills into the adjoin water way/ditch • Due to the primary use of this land is agricultural and not industrial. • Due to no signage prior to construction • Due to seller not disclosing what his intent for the sale of this property was to the residents and neighbors across the road. • Due to construction and digging on road 15 on weekends by the property owners • Due to impacts of stopping traffic on road 15 for illegal construction activities. • Due to lack of or no inspections done to maintain compliance with Weld County codes • Improper ethics of business pertaining to non-caring permit process • Due to non-disclosure and lack of assisting citizens in getting answers on this truck stop that was being put in from Weld County to Howard as well as from the Town of Dacono not looking into Diana Aungst From: Phillip Brewer Sent: Wednesday, January 07, 2015 4:50 PM To: Diana Aungst Subject: FW: Complaint of Diesel Fumes Diana : See message that I sent below. This location is South of Hwy 52 and just East of Road 15 at the location of a proposed project of Case #: USR14- 0062 near Dacono. On the morning of Friday the 21st of November I was awakened at 7:30 AM by the strong smell of diesel exhaust in my home. I discovered that there were trucks running (not moving) at the location of a proposed project of Case #: USR14-0062 I am estimating that the temperature that morning was around 50 degrees. It was not cold enough to see exhaust vapors. These trucks were emitting thick white smoke from the exhaust stacks. The smell of diesel fumes in my home became so strong that I started to become nauseous. I grabbed my camera and took some pictures. See attached. Also, on the morning of Wednesday the 7th of January I was awakened at 7:30 AM by the noise of these trucks banging the dump beds up and down. Shortly after that at least three of the trucks were running their engines (not moving) and the fumes were infiltrating my home. The smell of diesel fumes in my home became so strong that I started to become nauseous. There were anywhere from one to three of the trucks running (not moving) from 7:54 until after 10:00 AM! Again I captured some pictures of the trucks emitting thick white smoke, which is not normal for a diesel engine. I have no idea what they are running in these trucks. My concern is allowing this man to operate his business illegally for an additional 90 days. This puts another 3 months of undue stress on my neighbors and 1. I don't think some one who breaks the law should be treated better than the innocent bystanders who have had to suffer because of his actions. Would it be correct procedure to go to the meeting on the 20th to address this when his application is withdrawn? I live right next to Mr Homer, and I have had to endure the noise at all hours of the day and night and the smell that goes with those trucks. I do not think that someone who deliberately opened a business with no regard to the law should be awarded such a lavish consideration. Thank you for your assistance in the matter. This past Sunday and this Monday morning are the first days in many that I have been able to wake up and let my dog outside and not be greeted by the putrid stink of diesel exhaust fumes from the trucks from USR 14- 0062 Lujan Trucking. I have read the "Request to withdraw application" letter for AGPRO Project #2218-01 . I still have a concern that the applicant has requested that they be able to operate at the current location for the length of 90 days. Do these people not understand that they are violating zoning code and that their operation is affecting the quality of life of many people in the vicinity? Or do they just not care? If this operation is allowed to operate for any time then Weld County Staff has failed. Do you want to set a precedent that it is OK to violate a zoning code and continue to do so for an extended period of time? These trucks should be allowed to start their engines only one more time at this location. That is to vacate the location and not to return. I will be appalled if this request to continue to operate with no regard for the zoning code and the well being of the residents living nearby is granted. If the people of the Weld County Staff had to be subjected to this terrible odor of strong diesel fumes every morning in their neighborhood, I'm sure they would much more understanding of my concerns. My name is Howard Horner. My wife Val and I own and reside at 1210 Macoy Ct. Dacono, which is directly across the street from Mr Delgados illegal trucking operation . He has been torturing us with his noise, vibrations, dirt, and odors for 7 months. Being awakened every day by sub woofers and dump trucks 30 feet from our bedroom has been extremely stressful for us and we have spent many hours preparing video and audio tapes and sound pressure readings for the hearings which have now been cancelled . We respectfully imlpore you to deny this 90 day extension . We are amazed, shocked, and appalled that this assault on the enjoyment of our home has been allowed to continue for 7 months, and cannot imaging that we will be asked to endure another 90 days. We have shown great restraint in patiently allowing the County application process to run its course, and now it is done. It will take one day to move these trucks and that is the amount of time he should be granted . (We have no problem if the trucks stay PARKED for 90 days, but the trucking operations must stop immediately. ) There really should be a daily fine for the seven months of illegal operations, plus the time he continues operations in the future. Do you have any information regarding the court case against this business?
