The Weld County Public Works Department has reviewed this proposal. Staff comments made during this
phase of the process may not be all-inclusive, as other concerns or issues may arise during the remaining
application process. Issues of concern must be resolved with the Public Works Department. Our
comments and requirements are as follows:
COMMENTS:
General Project Information/Location:
This project plans to change the zone from commercial to industrial to ultimately operate a trucking
facility on site.
These properties are defined as parcel numbers 0961 10300010 and 096110300012 and are located south
of HWY34 and east of Cherry Ave near Greeley.
Roads:
Access is from CDOT HWY34.
No traffic counts are available.
General Site Plan Requirements:
Geologic hazard Area:
This site is NOT in a Geologic Hazard Area.
Floodplain:
The project site is NOT within a known floodplain.
CONDITIONS OF APPROVAL:
Prior to recording the plat:
A. The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to
the state highways. Please contact CDOT to verify the access permit or for any additional
requirement that may be needed to obtain or upgrade the permit.
The map shall be amended to delineate the following:

number if applicable.
B. The applicant shall indicate specifically on the plat any right of way and/or easements and
indicate whether they are dedicated, private, or deeded and label with recorded document,
book and page and/or reception number to provide adequate access to the parcel.
DEVELOPMENT STANDARDS
1. Should noxious weeds exist on the property, or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II, of the Weld County Code.
2. The historical flow patterns and runoff amounts will be maintained on the site.

CASE NO.: COZ14-0007 NAME: Luther Rentals
Environmental Health Services has reviewed this proposal to rezone 8.5 acres from the
C-3 (Business Commercial) Zone District to the I-1 (Industrial) Zone District. The City
of Greeley provides water (meter 09216215) and an individual septic system provides
sewage disposal to the existing residence on site (G19700604). A septic permit
application has been received that will serve the existing office building and the existing
house (SP-1400350). The system is sized for 30 full time employees and 50 drivers.
The proposed building on the east lot will be served by the City of Greeley for water and
an individual septic system.
Once a site plan review is submitted, this Division will require specific items such as;
dust and waste handling plans.
The Department recommends that the following conditions be part of any approval:
Prior to recording the plat:
1. Septic permit SP-1400350 shall receive final approval from Environmental
Health Services.
The following should appear as notes on the change of zone plat:
1. Water service shall be obtained from the City of Greeley.
2. The parcels are not served by a municipal sanitary sewer system. Sewage
disposal shall be by septic systems designed in accordance with the
regulations of the Colorado Department of Public Health and Environment,
Water Quality Control Division and the Weld County Code in effect at the time
of construction, repair, replacement, or modification of the system.
3. Language for the preservation and/or protection of the absorption field shall
be placed on the plat. The note shall state; Activity or use on the surface of
the ground over any part of the OWTS must be restricted to that which shall
allow the system to function as designed and which shall not contribute to
compaction of the soil or to structural loading detrimental to the structural
integrity or capability of the component to function as designed.
4. During development of the site, all land disturbances shall be conducted so
that nuisance conditions are not created. If dust emissions create nuisance
conditions, at the request of the Weld County Health Department, a fugitive
dust control plan must be submitted.
5. If land development exceeds 6 months in duration, the responsible party shall
prepare a fugitive dust control plan, submit an air pollution emissions notice, and
apply for a permit from the Colorado Department of Public Health and
Environment.
6. Weld County's "Right to Farm" as provided in Appendix 22-E of the Weld County
Code shall be placed on any recorded plat.
7. A stormwater discharge permit may be required for a
development/redevelopment /construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area. Contact
the Water Quality Control Division of the Colorado Department of Public Health
and the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more
information.

Upon review of my case files and computer, an active Zoning Violation (ZCV14-00167)was noted. This
violation was initiated due to the operation of commercial oil&gas related business and storage of related
equipment without first completing the necessary Weld County Zoning Permits. This case has not been
presented to the Weld County Court Magistrate through the Violation Hearing process. Since this
application was submitted prior to an actual court date being scheduled, NO investigation fee is required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staff's policy to no longer accept staff initiated complaints.
If this application if approved by the Board of County Commissioners and once a plat is recorded, this
would partially correct the violation. There are still site specific land use permits which are required after
and if the change of zone is approved. If this application is denied,the commercial vehicles, storage and
all operations shall be removed from the property within 30 (thirty) days of denial or the violation will
proceed in court accordingly.

General Comments
❑ Advisory. City of Greeley has concerns that the industrial use of the oil and gas
equipment storage facility is in close proximity to Bella Romero Elementary School off
of East 20th Street. Although not directly adjacent to the school,please consider the high
degree of incompatibility that the use would bring to the area and the school. Best Zoning
practices suggest that gradual change, through zoning steps, from one extreme to the
other is more ideal than what might perhaps become a hodgepodge of disparate zones in
this area.

General Comments
❑ Advisory. The site is within City of Greeley's Long Range Expected Growth Area.
Traffic
❑ City of Greeley's 2035 Comprehensive Transportation Plan indicates that Highway 34
Business will be a 2 lane minor arterial roadway along the north side of the rezoning map
boundary, requiring a 100 foot total right of way (50 foot half right of way). Please
ensure that the rezoning map calls out 20 feet of future right of way south of and adjacent
to the existing 30 foot half right of way of Highway 34 Business and that all proposed
structures are set back a minimum of 25 feet from the future right of way line.
❑ The submitted rezone application indicates that a traffic study is being generated for the
associated special use permit application for the site. Please provide a copy of the traffic
study to City of Greeley as soon as it is available.
❑ Advisory. The number of access points along minor arterial roadways should be
minimized. If there are any opportunities to combine access points, they should be
pursued.
Water and Sewer
❑ Advisory. The City of Greeley currently provides water service to both parcels proposed
to be rezoned via 3/4 inch water taps.

❑ The eastern (1510 East Highway 34) water service is currently considered a residential
water service. Once a new building is constructed and the use becomes non-residential,
the water service will be considered non-residential and water consumption will be
subject to the annual water surcharge.
❑ Non-residential water uses require the property owner to install the appropriate backflow
prevention assemblies on the domestic service lines. Please note that these assemblies
must be tested by a certified tester upon installation and a copy of the test report needs to
be submitted. Annual re-testing of all backflow assemblies is required by Federal and
State Health Department regulations implemented through City ordinance for cross-
connection control.

❑ A Conceptual Site Plan provided to the Water and Sewer Department indicates that site
improvements may be proposed in locations that would interfere with the existing water
services. Please make sure these services, including the existing curb stops and water
meters, are located and shown on the Site Plan and that the plans call for relocation of the
service(s), curb stop(s), and meter(s) if necessary. The curb stops and meters should be
located in landscaped areas whenever possible.
