RE: APPROVAL OF RECORDED EXEMPTION NO. 388 - JOHN AND FRED ULLMANN,
ET AL.
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 2nd day of May, 1979 in the Chambers of the Board of County
Commissioners of Weld County, Colorado, that the division into
two parcels of a certain parcel of land, as shown on the plat
known as Recorded Exemption. No. 388 , being the property of John
and Fred Ullmann, et al, described as part of the Southeast Quarter
of Section 22 , Township 4 North, Range 67 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described as
follows :
A parcel of land being the Southeast Quarter
of Section 32 , Township 4 North, Range 67 West
of the Sixth Principal Meridian, Weld County,
Colorado.
Excepting therefrom that Parcel Four (4) as con-
veyed to John M. Erickson by Warranty Deed dated
September 26 , 1921 and recorded October 7 , 1921,
in Book 649 at Page 411, Weld County Records ,
and more particularly described as follows :
Beginning at the East Quarter Corner of said
Section 32;
Thence South 00°35 ' East a distance of 1255 feet;
Thence up the middle of a slough by the following
Eight (8) courses :
North 74°30 ' West a distance of 100 feet;
North 46°35 ' West a distance of 597 feet;
North 75°35 ' West a distance of 416 feet;
North 59°10 ' West a distance of 300 feet;
North 71°30 ' West a distance of 300 feet;
North 54°15 ' West a distance of 200 feet;
North 48°50 ' West a distance of 250 feet;

the head of the slough;

"subdivision" and "subdivided land, " pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant to
its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of Weld County, Colorado that the hereinabove described
parcel of land owned by John and Fred Ullmann, et al, be, and hereby
is , exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973 , as amended,
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 2nd day of
May, A.D. , 1979.

RE: Recorded Exemption #388
Dear Commissioners:
The attached application, plat , and related items are in reference
to a request by John and Fred Ullmann, et al . , for a recorded
exemption. The parcel of land on which this request has been made
is described as Pt . SE$ Section 32, T4N, R67W of the 6th P.M. , Weld
County, Colorado. This property is located 4-1/2 miles south of
Johnstown. The property contains 115 acres of Class II , III and IV
irrigated soils. The request is to split the property into parcels
of 5 acres and 110 acres. The 5 acre parcel does have an existing
residence and other improvements located on it .
Mr. Phillip Camenisch has purchased the 110 acre parcel prior to
applying for this recorded exemption. Mr. Camenisch owns other
agricultural property in the area and his headquarters unit is
located diagonally across the road from this property. Because of
the proximity of the 110 acre parcel to the Camenisch headquarters
unit , Mr. Camenisch has no need for the improvements situated on
the 5 acre parcel. The Ullmanns have various other farms in the
area and wish to retain the improvements site for the use of a long
term employee who has been with them for approximately 25 years.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons:
1. The proposed request conforms with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County
Subdivision Regulations) , the intent clause of the Agricultural
Zone District (Section 3. 3 A. of the Weld County Zoning Resolu-
tion) , and the Weld County Comprehensive Plan in that the uses
will be compatible with the surrounding agricultural uses. The

request will allow agriculture and related uses to be the pre-
dominant land uses . There will be no reduction in the amount
of land currently being used for agricultural production based
upon the stated intent of the involved parties.
2. The request complies with the provisions of Section 9-4 A. of
the Weld County Subdivision Regulations.

TO WHOM IT MAY CONCERN :
Pursuant to the enclosed Request for Recorded Exemp-
tion on our Weld County property as per the Plat and
Application attached hereto , we wish to set forth the
following reasons for said request .
In reviewing the Application and Procedures for Re-
corded Exemption, we find that we have not followed
the procedure in the proper manner. Subsequent to
the preparation of the Survey and Plat , the portion
of the plat described as Parcel A was conveyed to
Phillip E . Camenisch . Mr. Camenisch owns other
agricultural property in the area and his headquarters
unit is located diagonally across the road from Par-
cel A and is legally described as the NW4 of Sec-
tion 4 , Township 3 North , Range 67 West of the 6th
P .M. , Weld County, Colorado . Because of the proximity
of Parcel A to the Camenisch headquarters unit , Mr .
Camenisch has no need for the improvements situate
on Parcel B . The Ullmanns have various other farms
in the area and wish to retain the improvement site
for the use of a long term employee who has been with
them for approximately 25 years .
Therefore, we contend that since Mr . Camenisch has no
need of the improvements in the course of his farming
activities and that the Ullmanns have a need for the
improvement site in the course of their farming acti-
vities and we hereby request approval by the Planning
Commission of the enclosed Application for Recorded
Exemption.
