WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public hearing held on the 2nd day of May, 1979 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of a certain parcel of land, as shown on the plat known as Recorded Exemption. No. 388 , being the property of John and Fred Ullmann, et al, described as part of the Southeast Quarter of Section 22 , Township 4 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows : A parcel of land being the Southeast Quarter of Section 32 , Township 4 North, Range 67 West of the Sixth Principal Meridian, Weld County, Colorado. COLORADO May 2, 1979 Board of County Commissioners Weld County, Colorado 915 10th Street Greeley, CO 80631 RE: Recorded Exemption #388 Dear Commissioners: The attached application, plat , and related items are in reference to a request by John and Fred Ullmann, et al . , for a recorded exemption. The parcel of land on which this request has been made is described as Pt . SE$ Section 32, T4N, R67W of the 6th P.M. , Weld County, Colorado. This property is located 4-1/2 miles south of Johnstown. The property contains 115 acres of Class II , III and IV irrigated soils. The request is to split the property into parcels of 5 acres and 110 acres. The 5 acre parcel does have an existing residence and other improvements located on it . Mr. Phillip Camenisch has purchased the 110 acre parcel prior to applying for this recorded exemption. Mr. Camenisch owns other agricultural property in the area and his headquarters unit is located diagonally across the road from this property. Because of the proximity of the 110 acre parcel to the Camenisch headquarters unit , Mr. Camenisch has no need for the improvements situated on the 5 acre parcel. The Ullmanns have various other farms in the area and wish to retain the improvements site for the use of a long term employee who has been with them for approximately 25 years. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the re- quest be approved for the following reasons: 1. The proposed request conforms with the intent clause of the recorded exemption procedure (Section 9-2 of the Weld County Subdivision Regulations) , the intent clause of the Agricultural Zone District (Section 3. 3 A. of the Weld County Zoning Resolu- tion) , and the Weld County Comprehensive Plan in that the uses will be compatible with the surrounding agricultural uses. The Board of County Commissioners Page 2 May 2, 1979 request will allow agriculture and related uses to be the pre- dominant land uses . There will be no reduction in the amount of land currently being used for agricultural production based upon the stated intent of the involved parties. 2.
