The Weld County Department of Planning Services-Engineering has reviewed this proposal. Staff
comments made during this phase of the application process may not be all-inclusive, as other issues
may arise during the remaining application process.
COMMENTS:
General Project Information/Location:
(TRUCKING AND TRUCK REPAIR ALONG WITH OUTSIDE EQUIPMENT, VEHICLE STORAGE AND
STAGING; AND MATERIALS ASSOCIATED WITH THE CONSTRUCTION BUSINESS)
APPROXIMATELY 1 MILE SOUTH OF COUNTY ROAD 50 AND EAST OF AND ADJACENT TO
COUNTY ROAD 39
Roads:
County Road 39 is a Paved road and is designated on the Weld County Road Classification Plan as a
Collector road, which requires 80 feet of right-of-way at full buildout. The applicant shall verify and
delineate on the plat the future and existing right-of-way and the documents creating the existing right-of-
way. If the existing right of way cannot be verified it shall be dedicated. All setbacks shall be measured
from the edge of future right-of-way. This road is maintained by Weld County.
Traffic counts on CR39 were 1773 vpd on 3/15/13 with 23%trucks.
Traffic:
The traffic information provided with the submittal states that the site will have approx. 21 trucks/day with
misc deliveries during the week as well.
O Traffic Narrative with Triggers:
A Traffic Impact Study can be waived and a detailed Traffic Narrative submitted if the applicant
agrees to traffic triggers. Any triggers based upon the traffic narrative or the traffic study will be included
within the improvements and road maintenance agreement. The Traffic Narrative must include at the
minimum:
1. The type (i.e. trucks/passenger vehicles etc...) and number of vehicles per day
2. Peak hour traffic numbers
3. Expected routes
4. Trip distribution along the routes (i.e. 50% of traffic will come from the north, 20% from the south,
30% from the east)
5. Specifically agree in writing to the below improvements triggers.
A. 10 vph during peak hour turning left into the facility-left deceleration lane
B. 25 vph during peak hour turning right into the facility-right deceleration lane
C. 50 vph during peak hour turning right out of the facility-right acceleration lane.
Access:
An access permit has been approved for the access to the site (AP15-00001).
The gate (if applicable) must be set back a minimum of 75 feet from future right-of-way to allow a truck
and trailer to pull completely off of the roadway and open the gate after the future road widening.
Tracking control is required to prevent tracking from the site onto the County Roadway.
o Standard tracking control for accesses onto paved roads includes either 300 feet of pavement
onsite OR 100 feet of pavement plus double cattle guards.
o Alternatives such as recycled AC, gravel/road base, may be considered with lighter traffic impact
projects.
The applicant is using a combination of recycled asphalt and the open bridge deck for tracking control.
Other PW Permits:
A Right-of-Way Use Permit is required for any work in the Weld County Right-of-Way. Contact Weld
County Public Works at 970-304-6496 ext. 3764.
A Transport Permit is required for any oversize and/or over weight vehicles. Contact Weld County Public
Works at 970-304-6496 ext. 3764.
General Site Plan Requirements: i.e (IA, RMA, City Town Agreement, etc..., offsite auxiliary lanes)
-Improvements Agreement:
An Improvements Agreement between the Applicant and the County will be required for this project. It will
detail the approved haul route(s), outline when offsite improvements will be triggered, and include a
maintenance agreement for the haul routes.
-Geologic hazard Area:
This area IS NOT in a Geologic Hazard Area.
-Floodplain:
This area IS NOT in a Floodplain.
Drainage Study:
A drainage narrative and water quality feature design is required and full Drainage Report and detention
pond waived because the stormwater drainage impacts of the project will be insignificant.
o Narrative: The applicant shall provide a short description of the historic stormwater flows across
the property and how their application will affect those flows. The description shall include but not
be limited to:
1. where the water originates if it flows onto the property from an offsite source
2. where it flows to as it leaves the property
3. the direction of flow across the property
4. if there have been previous drainage problems with the property
5. The overall site imperviousness
o Water Quality Feature Design: A Water Quality Feature is required onsite downstream of the
business activities such as parking, buildings, storage areas etc... The area can be an existing
low point or excavated area that will capture the stormwater and contaminants prior to flowing
offsite. Methodology for sizing is outlined in Volume 3, Section 3.3.0 of the Urban Storm Drainage
Criteria manual. The web site address is as follows www.udfcd.orq. Please contact Planning

The applicants will be required to maintain historic drainage flows and run-off amounts on the property.
Grading Permit
A Weld County Grading Permit will be required if disturbing more than 1 acre. Contact the Planning
Department for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-
692-3575.
CONDITIONS OF APPROVAL:
Prior to recording the plat:
A. An Improvements Agreement and Road Maintenance Agreement is required for offsite
improvements at this site. Road maintenance including dust control, damage repair,
specified haul routes and future triggers for improvements will be included.
The map shall be amended to delineate the following:

QUALITY FEATURE, NO-BUILD OR STORAGE AREA.
E. Show and label the drainage flow arrows, turning radii, and parking and circulation on the
map.
Prior to Construction:
A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to
the start of construction. Contact the Planning Department for application information.
Prior to Operation:
NA
DEVELOPMENT STANDARDS (NOTES ON THE PLAT)
1. Should noxious weeds exist on the property, or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II, of the Weld County Code.
2. The historical flow patterns and runoff amounts will be maintained on the site.
3. Weld County is not responsible for the maintenance of onsite drainage related features.
4. There shall be no parking or staging of vehicles on County roads. On-site parking shall be utilized.

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Use by Special Review Permit for any Use Permitted as
a Use By Right, an Accessory Use, or a Use By Special Review in the Commercial or
Industrial Zone Districts (trucking and truck repair along with outside equipment, vehicle
storage and staging; and materials associated with the construction business) provided
that the property is not a lot in an approved or recorded subdivision plat or lots parts of a
map or plan filed prior to adoption of any regulations controlling subdivisions and
mineral resource development facilities including oil and gas support and service
(storage of clean empty frac tanks) in the A (Agricultural) Zone District.
There will be up to 25 employees accessing the site, 23 drivers and 2 on-site
mechanics.
The property will be served by Central Weld County Water District and a septic system.
An engineer review, dated October 24, 2014, of the existing septic system was done by
Alles Taylor and Duke, LLC. The review indicates the existing system is adequate for
the business use.
The dust abatement plan indicates the internal roads and truck parking area will consist
of recycled asphalt.
The waste handling plan indicates that employee waste will be collected by B & C
Refuse. There is minor maintenance of vehicles that occurs on site and the waste
handling plan addresses the disposal of batteries, scrap metal, tires and oil. If there are
floor drains in the maintenance shop the drains must discharge to a watertight vault,
and contents removed for proper off-site disposal. If vehicle and equipment washing
occurs onsite, the wash water discharge must also be contained for proper offsite
disposal. Fuel storage must include secondary containment. Frac tanks must be
stored empty and clean. Fill dirt must be managed to prevent nuisance conditions.
We have no objections to the proposal; however, we recommend that the following
requirements be incorporated into the permit as development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final
disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions. The applicant shall operate in accordance with
the approved Waste Handling Plan, at all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved Dust Abatement
Plan, at all times.
5. This facility shall adhere to the maximum permissible noise levels allowed in
the Non-Specified Zone as delineated in Section 14-9-30 of the Weld County
Code.
6. Sewage disposal shall be by septic system. Any septic system located on the
property must comply with all provisions of the Weld County Code, pertaining to
On-site Wastewater Treatment Systems.
7. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. A permanent, adequate
water supply shall be provided for drinking and sanitary purposes.
8. All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling. All chemicals must be stored secure, on an
impervious surface, and in accordance with manufacturer's recommendations.
9. Process wastewater (such as floor drain wastes) shall be captured in a
watertight vault and hauled off for proper disposal. Records of installation,
maintenance, and proper disposal shall be retained.
10.Any vehicle or equipment washing areas shall capture all effluent and prevent
discharges in accordance with the Rules and Regulations of the Water Quality
Control Commission, and the Environmental Protection Agency.

11.The applicant shall comply with all provisions of the State Underground and
Above Ground Storage Tank Regulations.
12. Only empty, decontaminated frac tanks shall be stored onsite.
13.The applicant shall remove, handle, and stockpile fill dirt in a manner that will
prevent nuisance conditions.
14.The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.

Upon review of my case files and computer, an active Zoning Violation (ZCV14-00123)was noted. This
violation was initiated due to the operation of a Commercial Trucking operation without first completing the
necessary Weld County Zoning Permits. This case has been forwarded to the County Attorney's Office
and we have initiated legal action; therefore, an investigation fee is required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staff's policy to no longer accept staff initiated complaints.
If this application if approved by the Board of County Commissioners and once a plat is recorded will
correct this outstanding violation. If this application is denied,the Commercial Trucking operation shall be
removed from the property within 30(thirty)days of denial or the violation will proceed in court accordingly.

To Whom It May Concern:
The LaSalle Planning Commission,LaSalle Town Board and Town Engineer have reviewed the above
referenced Use by Special Review.This parcel is in LaSalle's Secondary Growth Boundary and appears
(from Google Earth)to be approximately 3,500'south southeast of the nearest Town residence.
Perhaps the biggest issue of concern for LaSalle for proposed operations is the application statement that
50%of the truck traffic leaving the site will go north. This most likely means about 10 to 12 trucks will
be traveling through the east side of LaSalle to get to WCR 50 or to get to Highway 85. Increased traffic,
truck noise,and road surface wear will result.In addition to these issues,this will increase the amount of
congestion at the 1'Avenue Railroad crossing only compromising travel through the community further.
Emergency services will be additionally challenged with large amounts of traffic to converse around if the
crossing is blocked by additional vehicles.
While there are several other matters outlined within the referral,many will not impact LaSalle at this
time;such as utilities, drainage,waste handling, wastewater disposal and stormwater drainage. With this
being said our emphasis remains on the traffic situation,and strongly suggest the traffic leaving the site
reach their destinations via another route perhaps to WCR 44 to Highway 85 then northbound.
Please give our recommendation for averting traffic your most serious consideration for our community's
welfare. Thank you in advance and should you have any questions do not hesitate to contact me at
