Dear Mt. Weigand,
Following is the general operating procedure of planning in Weld
County:
-the initial request from person(s) , business or industry for
a change of zone, land use permit or land use exemption is
made to an employed planning staff member;
-the employed planning staff member then sets procedural dates
and gives the client forms which have to be completed for
informational purposes; before the client's request can come
before the appointed Planning Commission, the planning staff
member must have thoroughly researched the request and all
informational items asked of the client must be answered;
-when the planning staff member is satisfied with findings, they
are presented to the appointed Planning Commission at a public
hearing; at that hearing the Commission has three choices:
(1) recommend approval to the Board of County Commissioners because
the request meets with Comprehensive Plan and Zoning regulations of
Weld County; (2) recommend denial to the Board of County Commissioners
because the request does not meet with the Comprehensive Plan or
Zoning regulations; (3) hold over decision making due to lack of
adequate information from the client or other involved public entities;
-after the Planning Connnission's recommendation, regardless of whether
it is for approval or denial, a public hearing is scheduled before •
the Board of County Commissioners, which follows approximately the same
procedure as the Planning Commission in deciding whether the Comprehensive
Plan and Zoning regulations are met and whether the change in land use is
desirable based on public input from people in the area;

-upon denial by the Board of County Commissioners, the
applicant can appeal the decision to either the courts
or the Board of Adjustment if the request is of a
nonconforming nature; the Board of Adjustment then has
the authority to approve or deny the request.
This brief outline of planning procedures should answer most
questions, however, for more detail the Planning Commission
By-Laws and Board of Adjustment By-Laws may be reviewed.

IV. Recommendations:
A. Terms of Planning Commission members. In reviewing Colorado Statutes
it was determined that members terms are now inconsistent with the terms
specified by law. It is recommended that this inconsistency be reviewed by
the County Attorneys Office, and if required by law, the terms of commission
members be changed from four (4) to five (5) years.
B. Appointment of Ex-officio Member from Board of County Commissioners to
Planning Commission. Colorado Statute specified that the Board of County
Commissioners shall appoint one member of the Board as an ex-officio member
of the Planning Commission. It is recommended that such a member be
appointed, in order that closer and more effective communications may be
developed between the members of the Planning Commission and Board of County
Commissioners.
C. Associate members. It is recommended, that whenever possible, associate
members he considered for positions as regular members on the Commission,
when positions of regular members are terminated, either through expiration
of a regular members term or for other reason. It is felt that where this
is possible, it would give both the Planning Commission and Board of County
Commissioners an opportunity to benefit from the experience gained by
associate members as they served in the capacity of associate member.
•D. Common Membership on Planning Commission and Board of Adjustment. It is
recommended that one individual be appointed to serve as a member of both
the Planning Commission and Board of Adjustment so that more effective
communications may be established between these tWo appointed boards with
reference to their activities and the over-all goals and interest of land
use planning in Weld County today.
E. Board of Adjustment. It is recommended that an over-all study be made of
the powers and functions of the Board of Adjustment as defined by State
Statute and the Weld County Zoning Ordinance. It is further recommended
that the membership of that Board be consulted regarding the results of
the proposed study and be given the legal and professional staff support
necessary, to effectively meet their responsibilities as defined under law.
F. Planning Commission Staff. Though the functional organization of this
staff seems adequate to handle staff responsibilities, it is recommended
that greater efforts be made to integrate the various functional elements.
More specifically, efforts must be made to insure that all staff members
are aware of the total responsibilities of the Department. Only in this
manner can we insure the highly integrated effort necessary in meeting our
responsibilities. It is suggested the ht-monthly or monthly meetings of
the total staff be established as one means for meeting this goal.
G. Educational Efforts. It is recommended that an over-all educational effort
be undertaken to make the public aware of planning programs and appreciate
regulations concerning land-use in Weld County today.
if. Enforcement of Regulations. It is recommended that efforts be strengthened
to enforce existing land-use regulations in Weld County. In doing this,
effective procedures must be established for processing violations and
ensuring such violations are corrected.

Meeting held with Planning, Zoning, Board of Appeals and Building Inspection
Departments at 7:30 P. M. January 21, 1975 in County Commissioners hearing room.
Committee members present: Weigand, 1Srowm, White, Southard, Schissler.
Member absent: Altergott.
Meeting was called to order by Chairman Weigand at 7:30 P. M. Present from
Planning and Zoning commissions, Chairman, Mr. J. Ben Nix, Ron Heitman, Margaret
Yost, Harry Ashley. Charles (Chuck) Carlson present together with Planning
director, assistant director and planner one of the administrative staff. Present
from Board of Appeals, Chairman of Board of Appeals, Mr. Harry Claus, Robert
Siegfried, Ted Funk, SamRank, Jerry Cogburn. Associate. members: Mrs. Pat Thomas,
Ray Sarchet, Frank Stewart. News media, Ron Tollefson.
Mr. Gary Fortner of the administrative staff prepared and delivered to each
member of the committee a complete organizational and financial chart of the
offices showing different branches and the chain of command of their offices
which clearly setforth State and other statutes the office must work under, together
with a copy of budget of 1972, 73 and 74 and proposed budget of 1975.
Mr. Glenn Billings, chairman of the Board of County commissioners presented
each member with a letter showing chain of command and outline of duties.
A general discussion was entered into with the planning, zoning staff, and
commission members together with the members of the Board of Appeals committee, as
to structure and functions of all facets of business carried on through their
offices.
Then the Chairman called on Mn. Harry Claus, Chairman of Board of Appeals,
who gave a summary of the function of his board and its coordination with the
planning and zoning department as to the structure and functions administered
through their department.
It was called to the attention of the Committee that the building inspection
department, while officed in the same office of planning, zoning, is a separate
department and carry its own budget. Present from the inspection department was
Mr. Virgil McKee and the newly appointed building inspector who indicated they
intended to staff three full time inspectors and gave the committee a thorough
report on what the inspection department should be doing and the many problems
they anticipate in the future.
Meeting was adjourned at 10:15 P. M.
The committee re-convened for a summary of the information brought forth in
the hearing and will review the documented information produced. It was the
decision of the committee that after each had had time to review both information
furnished at the hearing and documented information they would make their recommen-
dations through the Home Rule Committee and final recommendations at a later date.
