There are many factors that we have experienced over the years that are relevant to this USR. Ryan Gallatin, property owner at 19300 & 19316 WCR 76, has been running a business that has not properly zoned or permitted for quite some time. This became unbearable to live next to over this past winter. Thus, I filed a complaint with the Zoning department on January 10, 2O14. The current situation is not accurately presented in the application that was filed for the above USR. We would like to express our concerns as the adjacent home owners, as more home owners in the area will be doing the same. • Traffic Safety - the entrance and exit that the 4 semis currently are using is not capable of handling this type of traffic. The entrance is located on the west side of a hill, with no clear view to the east. Upon exiting any vehicle that is driving west, could have a major accident. Upon semis entering property, in order to make the tight right turn, they must drive in the west bound lane to enter the driveway. There is a double yellow line the length of the road. This is presents a driving condition that is not safe for any driver on the road. Clearly this property should not be conducting trucking business. • Bus Stop - there are 3-5 bus stops on this section of the mile. Our bus stop is 114 feet from driveway of the above property. Child safety should be of the utmost concern at all times. Allowing any type of semi traffic in and out of this property is quite alarming. • Drainage from existing building - This property currently has a 60x40 metal building that changed the natural drainage of the property. The natural drainage would typically flow north to the county road and hit a bar ditch and culvert. The drainage now is flowing to the south and west, flooding out the outlying neighbors. For a building this size there should be appropriate drainage required (i.e. detention pond). We have had to build up a berm on the east and south side of our property to protect our property from repeated flooding during rainstorms. This was caused us to incur a great deal of expense in order to protect our property. In addition, to help alleviate the massive amounts of run off from 19300 EXHIBIT ese14 - oe k Kim Ogle August 21 , 2014 Page 2 WCR 76, underground pipes have been placed to direct the water to the correct places. • Current Operations — The current operations at the location are running 4 semi trucks daily. The trucks will enter and exit multiple times a day. These trucks arc washed on site, stored, staged and mechanical work performed from the metal building (built for storing tractor, not mechanic shop). Currently, this operation has been running anytime from 2 am to 10 pm at night. • Hours of Operation & Noise — In the winter months, the semi trucks would frequently be started and run for 30+ minutes warming up before then fueling up, prior to leaving. This would start up as early as 2:30 am. This has disrupted all sleep in our house! The semis drive within 35 feet of our bedroom window with headlights directly into our bedroom window. They are 45 feet from of our children's rooms. On many occasions our 5 & 8 year old children have woken up when the semis arc running, during the middle of the night. The noise that 6 semi trucks would generate from all running at the same time is not a small footprint as mentioned in the USR application. The noise that the current 4 generate continues to wake up multiple neighboring properties as well as more properties as the semis drive down the road. • Fuel tanks — There are three fuel tanks on site that were not properly permitted. • Employees — The USR is asking for potentially 25+ employees, 6 semi truck drivers, 15 landscapers and the mechanics that service the vehicles. This causes concern after seeing information posted about Gallatin Turfs business practices. We have lived with in a block of intersection 39 &76 since 1966. The amount of traffic has increased 10 fold since 1966. These big rigs of Ryans' start the engines at approximately 3:00a. m. in and run for 30 minutes before they leave the yard. The hours that are stated on his application is way too early for a small neighbor hood like ours. It bothers my wife and I every time they fire up the engines. The traffic hazard with the trucks coming and going on a two lane road creates the potential for a serious accident since they pull into a drive on the south side of the highway with a small entrance. They have to cross the double yellow lines going up the hill to East and it creates a blind hazard for traffic going West. The speed has increased on 76 going east and west since the road has been paved going east. Cars will come over the hill doing 55 -65 miles per hour. There will be a serious accident , it is just a matter of time. I know that the water after rains has caused flooding problems for a couple of the neighbors. With the addition of another building that is longer than what he has now that will cause more run off going to the west toward the homes. I just read in the paper about a 75.999 acres that will be annexed in the next few weeks to the city of Eaton. That property is just across the road from our house and Ryan's. This will create more traffic in the neighbor hood with in a few years . We hope you consider the feelings of all the neighbors before allowing this addition since it affects many of us. The noise from the few tractor trailers can be heard here from 3: 00 AM when he warms them up until 11 :00PM when he sometimes arrives home. An increase in the number of semi tractor trailers would increase the noise. The addition of a larger repair shop would not only increase the noise, but increase the traffic in this area. The entrance to his property is at the crest of a hill and to make the turn into his property, the semis have to go to the wrong side of the road creating a hazardous situation . More semis increase the possibility of serious accidents. Even though the area where my property located is zoned Agricultural, the area is a unique residential area located catty-cornered from the Hawstone Subdivision which is part of Eaton, Colorado. If the Planning Services approve a Commercial/Industrial property in the midst of this residential area, the property values that now range from $200,000 to nearly $400,000 will be compromised.Thank you for considering our concerns and hopefully the Planning Services will not grant a special permit for this increased semi truck and repair business. The semi truck company that is operating out of 19300 & 19316 WCR 76, Eaton is concerning to me. I live to the west of the USR address and have experienced awful noise issues since late last year. I have an 8 year old son that is autistic. The semis drive west past my house at all hours of the morning, between 2 am — 8 am. They are so loud that they wake up my son and me. As you know, sleep is an important part of one's health. This is especially true for children with autism. When my son wakes up from semis using their Jake brakes on the road right next to our house during the middle of the night, he doesn't understand where that sound is coming from. It is then difficult for him to go back to sleep, given that another semi may be leaving 30 minutes later. Insufficient sleep definitely has an impact on the welfare of my child's behavior during the daytime hours. Another point that needs to be addressed is safety. There are several school bus stops along this county road. A business with semi traffic constantly exiting and entering the property with such close proximity to the bus stops worries me. The semi business that is being conducted is detrimental to the health, welfare and safety of all of the neighboring properties, not just the ones within 500 feet of 19300 & 19316. I know that Ryan has reached out to you regarding his plans for the property, and I understand that some of you have expressed concerns regarding the impact, both short-term and long, of Ryan's business. Ryan has been working closely with Weld County to address some of those concerns and to limit the impact of his business on the surrounding area. First and foremost, due in part to the concerns you have expressed, Ryan has decided to search for a new location for his company, and intends to limit the scope of his USR request significantly. Ryan is still requesting county approval to operate his business until he can find that new location, but he has scaled back his request to only reflect his current levels of activity - i.e. a maximum of four trucks and 14 employees on site, as opposed to the six trucks and 24 employees originally requested. Moreover, it will be a condition of approval of the USR that the trucking component of the USR will be terminated once Ryan does relocate. Ryan is extremely motivated to find a new location where he can continue to grow his business. Locating and purchasing a new property may prove difficult however, and Ryan is requesting this limited USR in order to ensure that his business can continue until the new location is secured. In addition to significantly scaling back his USR request, Ryan is working with Weld County on the following items, and he hopes these changes will limit the impact of the trucking operation until it is relocated: • Hours of operation will be limited from 5 a.m. to 8 p.m., and no trucks or employees will be on the premises outside those hours. • Driver rules and procedures have been put into place, requiring, among other things, that drivers: o (a) limit use of their headlights; o (b) never use jake brakes on CR 76 or CR 39; o (c) limit speeds while on CR 76; o (d) fuel trucks on the afternoon before departure, in order to limit idle time in the mornings; and o (e) no washing of vehicles on the property. • Regarding the hill on CR 76, Ryan's trucks are high enough that his drivers have perfect visibility of ongoing traffic, but Ryan is working with the county on options to accommodate other drivers on the road. It is our hope that these efforts — along with Ryan's decision to scale back his USR request and ultimately relocate the trucking business — will go a long way in addressing the concerns some of you have expressed.
