ORDINANCE NO. 3 Mate of Colorado, Weld County Clerk & Recorder
IN THE MATTER OF APPROVAL OF CONTRACT BETWEEN WELD COUNTY DIVISION
OF HUMAN RESOURCES AND WELD MENTAL HEALTH CENTER, INC.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY,
COLORADO:
WHEREAS, the Weld County Division of Human Resources has
presented to the Board of County Commissioners of Weld County,
Colorado a contract between said Division of Human Resources and
the Weld Mental Health Center, Inc. , a copy of said contract
being attached hereto and incorporated herein by reference at
this point, and
WHEREAS, said contract is for the establishment and opera-
tion of a coordinated transportation service for the use of
Mental Health clients, Senior Citizens, the handicapped and low
income of Weld County, and
WHEREAS, the term of said contract is from November 15, 1978
through December 31, 1979.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Com-
missioners of Weld County, Colorado that the aforementioned
contract between the Weld County Division of Human Resources
and the Weld Mental Health Center, Inc. be, and hereby is,
approved.
BE IT FURTHER ORDAINED by the Board of County Commissioners
of Weld County, Colorado that an emergency exists which requires
that this Ordinance be enacted forthwith in that normal Ordinance

procedures would prevent said contract from being executed due
Co', to the lack of time, and therefore, this Ordinance is declared to
Nbe an emergency Ordinance under the provisions of Section 3-14
of the Weld County Home Rule Charter.
The above and foregoing Ordinance No. 38 was, on motion duly
- made and seconded, adopted by the following vote on the 4th day
of December, A.D. , 1978.

MEMORANDUM OF AGREEMENT
THIS AGREEMENT, made and entered into this 15
day of November , 1978, by and between the Weld County
Division of Human Resources - Transportation Program,
hereinafter referred to as "Human Resources" and Weld
Mental Health Center, Inc. , hereinafter referred to as
"Mental Health, "
WITNESSETH
WHEREAS , Human Resources implements a transportation
program for Senior Citizens, the handicapped, and low
income individuals, and
WHEREAS, Mental Health implements programs for residents
of Weld County , and
WHEREAS , the parties hereto are desirous of formalizing
an Agreement which will operate to the benefit of both parties
in the establishment and operation of a coordinated trans-
portation service for the use of Mental Health clients ,
Senior Citizens, the handicapped, and low income of Weld
County ;
NOW THEREFORE, the parties hereto agree and convenant
as follows :
1. Mental Health shall supply to Human Resources a
vehicle which has the capacity to carry at least 12
passengers for the use of transporting Mental Health clients,
Senior Citizens, the handicapped, and low income of Weld
County on each day of the week (Monday through Friday) ,
commencing November 15, 1978 Such vehicle
shall be stationed, with other Human Resources vehicles ,
at the Weld County Shop, 1500 Second Street , Greeley ,
Colorado, on each day to serve the transportation needs
of Mental Health clients and Human Resources clients as
hereinafter defined, between 8 : 00 a.m. and 5 : 00 p.m.

2 . Human Resources agrees to provide transportation •
priority to Mental Health clients at an average rate of
20 hours per week. Human Resources shall retain the
flexibility to provide these transportation services through
its transportation system.
3. Mental Health shall provide insurance in accordance
with laws of the State of Colorado . The vehicle as provided
by the Agreement shall remain the property of Mental Health.
Human Resources shall operate the vehicle in accordance with
the Transportation Policy of Human Resources.
4. Human Resources and Mental Health agree to fund a bus
driver position according to the following method:
a. From a period commencing November 15, 1978 , through
December 31 , 1978, Human Resources shall provide
$140. 50 monthly and Mental Health shall provide
$140. 50 monthly towards the salary of a bus driver.
The On-the-Job Training Program of the Compre-
hensive Employment and Training Act shall pro-
vide $281 . 00 monthly towards the salary of the
bus driver.
b. From a period commencing January 1 , 1979 , through
May 15, 1979, Human Resources shall provide
$147. 53 monthly and Mental Health shall provide
$147. 53 monthly towards the salary of a bus driver .
The On-the-Job ,Training Program of the Compre-
hensive Employment and Training Act shall pro-
vide $295 . 05 monthly towards the salary of a bus
driver .
c. From a period commencing May 16, 1979 , through
December 31 , 1979, Human Resources and Mental
Health agree to each provide $302 . 50 monthly
towards the salary of the bus driver.
5. The bus driver shall be the employee of Human Resources .
The bus driver shall possess a Class (S) and a standard first
aid card.

6. Human Resources shall purchase a Radio Communications .
Receiver at a cost of $1, 650 from the Weld County Communications
Office. The Radio Communications Receiver shall be located in
the vehicle and shall be a part of Human Resources communication
system. Upon termination of this Agreement , Human Resources
shall retain all rights of ownership of the Radio Communications
Receiver.
7. Human Resources shall purchase gas and oil from
the Weld County Shop . The purchase of gas and oil shall
be charged and billed to Human Resources by the Weld County
Shop . Human Resources shall purchase maintenance services
from Gow Auto Salon. Human Resources shall in turn bill
Mental Health on a monthly basis for gas , oil , and maintenance
services prorated to Mental Health as hereinafter defined in
Item #8.
8. Human Resources agrees to submit daily mileage
and passenger reports to Mental Health on the 15th working
day of the following month. The daily mileage and passenger
reports shall identify passengers carried at specified
distances to be prorated to Mental Health.
9. It is agreed between the parties that either party
hereto has the right to terminate this Agreement within thirty
(30) days after service is instituted upon thirty (30) days
written notice given to the other party.
10. This Agreement may be amended given the written
consent of both parties.
IN WITNESS WHEREOF, the parties hereto .have set their
