SUBJECT: USR14-0063, Gonzales truck parking
The Weld County Planning-Engineering Department has reviewed this proposal. This project falls under
the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23.
Staff comments made during this phase of the Use by Special Review process may not be all-inclusive,
as other issues may arise during the remaining application process.
COMMENTS:
This project is west of and adjacent to CR59 and is north of CR50. Parcel number 096336000028.
Access is from CR59.
An access permit has been approved for the access to the site (AP14-00409).
The traffic information provided with the submittal states that four drivers will use the property for the sole
purpose of parking the commercial trucks. Two semi-tractor/trailers and two bobtails will access the site
up to four times a day.
Access improvements are required and shall include 60ft radii to accommodate turning trucks and double
cattle guards across the accesses to prevent the tracking of mud onto the County maintained roadway.
A traffic narrative shall be submitted detailing the type and number of vehicles per day, expected haul
routes, trip distribution along the haul route (i.e. 50% of traffic will come from the north, 20% from the
south, 30% from the east), improvements triggers — the Traffic Engineer will review the narrative and
advise the applicant if more information or an engineered traffic study is required.
A drainage narrative and water quality feature were provided with the application material. The site plan
must be updated to show the water quality feature. The water quality feature must be labeled as "Water
Quality Feature, No-build/storage area"
The applicants will be required to maintain historic drainage flows and run-off amounts on the property.
A Weld County Grading Permit will be required if disturbing more than 1 acre. Contact the Planning
Department for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-
692-3575.
CONDITIONS OF APPROVAL:
The plat shall be amended to delineate the following:
A. County Road 59 is designated on the Weld County Road Classification Plan as a paved
collector road, which requires 80 feet of right-of-way at full build out. There is presently 60
feet of right-of-way. An additional _ feet shall be delineated on the plat as future right-of-
way. All setbacks shall be measured from the edge of future right-of-way. The applicant
shall verify the existing right-of-way and the documents creating the right-of-way and this
information shall be noted on the plat. If the right-of-way cannot be verified, it shall be
dedicated. This road is maintained by Weld County.
B. Show the approved access(es) on the plat and label with the approved access permit
number (AP14-00409)
C. Show and label standard tracking control onto publically maintained roadways on the map,
show 60ft radii at the access.
D. The applicant shall label the approved water quality feature on the plat as "Water Quality
Feature, No Build/Storage Area"
Prior to Construction:
A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to
the start of construction. Contact the Planning Department for application information.
DEVELOPMENT STANDARDS (NOTES ON THE PLAT)
1. Should noxious weeds exist on the property, or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II, of the Weld County Code.
2. The historical flow patterns and runoff amounts will be maintained on the site.
3. Weld County is not responsible for the maintenance of onsite drainage related features.
4. There shall be no parking or staging of vehicles on County roads. On-site parking shall be utilized.

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Use by Special Review Permit for any use permitted as a use by
right, an accessory use, or a use by special review in the commercial or industrial zone
districts (truck parking including; two tractor-trailers along with outside
equipment/vehicle storage (three bobtails), and staging) provided that the property is
not a lot in an approved or recorded subdivision plat or lots parts of a map or plan filed
prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone
District.
The application indicates there are four drivers who park at the site. Water is supplied
by Central Weld County Water District (acct. 001297-01). Sewer is provided by an
existing septic system (G-19889095) which was sized for 2 bedrooms/4 people. Any
additional hydraulic load to the existing septic system which exceeds sizing
requirements shall require a review by a Colorado registered professional engineer and
in the event the system is found to be inadequately sized or constructed, the system
shall be brought into compliance with current regulations.
The following section is from Environmental Health Services, Weld County Department
of Public Health & Environment, Septic Policies.
2.2.K Use of portable toilets and bottled water (revised 5/8/12)
Purpose: To define when portable toilets and commercially bottled water are
allowed.
Policy: Portable toilets and bottled water from a commercial source are allowed
in the following circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2 consecutive
hours a day
Note: Records of maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed in
Weld County and shall contain hand sanitizers.
As indicated above, it is the policy of this Department that portable toilets are allowed
when employees or contractors are on site for less than 2 consecutive hours a day. As
drivers will be on site for a short duration, in accordance with Environmental Health
Services policy the use of portable toilets is allowed.
The waste handling plan indicates that no maintenance or repair of vehicles will occur
on site. There is a trash container which is serviced by Northern Colorado Disposal Inc.
The onsite dust abatement plan states that all parking areas are graveled and a water
truck will be staged on the property to control dust if necessary.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The applicant shall operate in accordance with the
approved Waste Handling Plan, at all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved Dust Abatement
Plan, at all times.

5. This facility shall adhere to the maximum permissible noise levels allowed in the
Non-specified Zone as delineated in Section 14-9-30 of the Weld County Code.
6. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Onsite Water Treatment Systems.
7. In the event the existing septic system is utilized for business use, the septic
system shall be reviewed by a Colorado registered professional engineer if the
usage surpasses septic permit G-19889095 sizing limitations. The review shall
consist of observation of the system and a technical review describing the
system's ability to handle the proposed hydraulic load. The review shall be
submitted to the Environmental Health Services Division of the Weld County
Department of Public Health and Environment. In the event the system is found
to be inadequately sized or constructed, the system shall be brought into
compliance with current regulations.
8. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. As employees or contractors
are on site for less than 2 consecutive hours a day portable toilets are
acceptable. Records of maintenance and proper disposal for portable toilets
shall be retained on a quarterly basis and available for review by the Weld
County Department of Public Health and Environment. Portable toilets shall be
serviced by a cleaner licensed in Weld County and shall contain hand sanitizers.
9. Any vehicle or equipment washing areas shall capture all effluent and prevent
discharges in accordance with the Rules and Regulations of the Water Quality
Control Commission, and the Environmental Protection Agency.
10.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Upon review of my case files and computer, an active Zoning Violation (ZCV14-00112)was noted. This
violation was initiated due to the operation of a commercial trucking business without first completing the
necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court
Magistrate through the Violation Hearing process. Since this application was submitted prior to an actual
court date being scheduled, NO investigation fee is required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staff's policy to no longer accept staff initiated complaints.
If this application if approved by the Board of County Commissioners and once a plat is recorded will
correct this outstanding violation. If this application is denied, all associated storage and/or parking shall
be removed from the property within 30 (thirty) days of denial or the violation will proceed in court
accordingly.
