RE: RECORDED EXEMPTION NO. 225 THOMAS C. WATSON
WHEREAS, it has been determined by the Board of County
Commissioners , Weld County , Colorado, that a certain parcel of
land, being the property of Thomas C. Watson, Route 1, Box 144 ,
Platteville, Colorado , and more particularly described as follows ,
to-wit:
The West Half (WI) of the Southeast Quarter (SP') together with the West 40 feet
of the East Half (f";) of the Southeast Quarter (SEf) of Section 16, Township 4
North, Range 66 West of the 6th P.M. , Weld County, Colorado described as follows:
Beginning at the South Quarter Corner (5% Cor) of said Section 16, and
considering the South Line of said Section 16 as bearing South 89° 51' 27"
East, with all other bearings contained herein relative thereto;
Thence South 89° 51 ' 27" East, along said South Line, 1347.49 feet;
Thence North 00°04 '21" East, 2642. 56 feet;
Thence North 89°47' 15" West, 1346.08 feet;
Thence South 00° 06' ll" West, 2644.21 feet to the Point of Beginning.
Said described parcel of land contains 82.926 Acres, more or less,
including a- strip of ground 30 feet in width along the South Line of
said Section 16 reserved for County Road ROW purposes and is subject
to any rights-of-way or other easements as recorded by instruments of
record or as now existing on said described parcel of land.

30-28-101 (10) , C.R.S. 1973 , as amended, and
WHEREAS , the Board of County Commissioners of the County
of Weld, State of Colorado, desires to exempt this particular
deivision of land upon the recommendation of the Weld County
Zoning Administrator, for the reasons as stated and pursuant
to its authority under Section 30-28-101 (10) (d) , C.R.S. 1973 ,
as amended.
NOW, THEREFORE , BE IT RESOLVED, that the hereinabove
described parcel of land owned by Thomas C. Watson, Weld County,
Colorado, be exempt from the definition of the terms "subdivision"
and "subdivided lands" as provided for in Section 2-1A (3) of
the Weld County Subdivision Regulations .

RE: Recorded Exemption 225
Dear Commissioners:
The attached application, plat, and related items are in reference to a re-
quest by Thomas C. Watson for a Recorded Exemption. The parcel of land is
described as part of the SEa of Section 16, T4N, R66W of the 6th P.M. ,
Weld County, Colorado. . Said property is located 12 miles west of Peckham
on the north side of State Highway 256. The subject property contains
82.926 acres of Class II irrigated cropland. The request is to split the
property into parcels of 1 .198 acres and 81 .728 acres. Each of the two
resulting parcels would contain one set of improvements.
Based on the information submitted and the adopted policies in the County,
the Planning Commission staff recommends approval for the following rea-
sons:
1 . The proposed split conforms with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County
Subdivision Regulations), the intent clause of the Agricul-
tural District (Section 3.3(A) of the Weld County Zoning
Resolution), and the Weld County Comprehensive Plan in that
each resulting parcel would have an existing set of improve-
ments. The use would be compatible with surrounding agri-
cultural uses.
2. The Town of Gilcrest Planning Commission has indicated they
have no objections to the request.
3. The request is in compliance with Section 9-4(A) of the Weld

County Subdivision Regulations.
It should be pointed out that the State Department of Highways has re-
quested a minimum of 75 feet of right-of-way from the centerline of
State Highway 256 to be preserved by reservation, setback, or dedication
(preferably the latter). This right-of-way should be shown on the
Recorded Exemption plat.

Dear Mr. McWilliams:
The Colorado Division of Highways has reviewed the application for recorded
exemptions from Robert Lebsack (located in Part of NE/4 of Sec. 3, T. 4 N., R.
68 W.) and Thomas Watson (located in Parts of W/2 SE/4 and E/2 SE/4 of Sec. 16,
T. 4 N. , R. 66 W.) and has the following comments which apply to both' exemptions.
Right of Way
Due consideration should be given to the preservation of at least 150 feet
of minimum right of way (75 feet each side of center line) that will be needed
for improvement of the highway system. Any additional right of way needed to
meet this requirement should be protected by reservation, setback or dedication
(preferably the-latter) as local zoning laws and regulations permit.
Approaches
Driveway permits will be required by the Division if:
1. additional driveways are wanted
2. existing driveways are relocated
These Permits are available through Mr. Dave Fraser, District Maintenance
Superintendent, p. 0. Box 850, Greeley, Colorado 80631. Requests for Driveway
Permits should include a sketch of the proposed location indicating width of
driveway, distance from property lines, and distance in miles from a prominent
land mark (road intersections, bridges, towns, etc.) as well as the State High-
way number. It should be noted that this is an application for a permit and
all requests are cleared through the local entity prior to the Division's
approval. -
Drainage
A change in drainage patterns which will result in an increased runoff or
rate of runoff onto Highway right of way will not be allowed. The owner or
developer must provide necessary on-site drainage retention ponds to hold the
increased runoff attributed to any development of site.

Environmental
Due consideration should be given to what impact the traffic on the high-
way will have on noise and air pollution levels at the site of any development.
As a general rule for meeting Noise Standards, residental improvements should
generally be setback a minimum of 160 feet to 210 feet from centerline and
business improvements should generally be setback a minimum of 110 feet to 160
feet from centerline, unless some other type of noise abatement measures (walls,
earth berms, noise insulated walls and windows, etc.) are constructed. A more
specific determination can be made only after the parameters for the highway
involved are evaluated.
As might be expected, the degree of air pollution decreases as the dis-
tance from source increases. Although this item consists of so many variables,
such as meterology, emission valves, etc. , there are presently no definite
parameters to so by. The best course of action is to keep improvements as far
away as possible from air pollution sources.
