HomeMy WebLinkAbout20153914.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING REQUEST TO PURSUE AN INJUNCTION AGAINST LAWRENCE KERR FOR VIOLATION OF THE WELD COUNTY CODE - ZCV15-00153 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Lawrence Kerr, ZCV15-00153, is allegedly in violation of the Weld County Code, specifically operating a commercial business that is not permitted, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 14th day of December, 2015, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Lawrence Kerr, property owner, was present at said hearing and presented testimony, and WHEREAS, the Board of County Commissioners deems it advisable to bring legal action against those individuals named above to correct said violation and refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until January 13, 2016, to allow adequate time for the property owner to submit a complete Use by Special Review application, with instruction that no additional materials be brought onto the site. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that ZCV15-00153 be, and hereby is, referred to the Weld County Attorney's Office for legal action against Lawrence Kerr to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until January 13, 2016, to allow adequate time for the property owner to submit a complete Use by Special Review application, with instruction that no additional materials be brought onto the site. 2015-3914 PL0824 VIOLATIONS - ZCV15-00153 - LAWRENCE KERR PAGE 2 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 14th day of December, A.D., 2015. I was given the material by a local tile manufacturer that went out of business and did not want to dispose of it. There is no need to have staff onsite on a regular basis. Water flows south and west within the property. 6 . I have only owned the property for a couple months and have not noticed a low spot where water accumulates. Environmental Health : 1 .
