RE: RECORDED EXEMPTION NO. 273 - JAMES P. AND BARABARA J. PREBISH.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is 'vested with the authority of administering the
affairs of Weld County, Colorado; and
WHEREAS , it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
on the 31st day of August, 1977 , in the Chambers of the Board
of County Commissioners of Weld County, Colorado, that a certain
parcel of land, being the property of James P . and Barbara J.
Prebish, located in the W4 of the NE4 of Section 28 , Township 4
North, Range 64 West of the 6th P.M. , Weld County, Colorado, more
particularly described as follows :
A Tract of land being the West Half of the North-
East Quarter (WZ NE4) of Section 28 , Township 4
North, Range 64 West of the 6th P.M. , Weld County,
Colorado. Said Tract of land containing 80 acres
more or less ;
does not come within the purview of the definition of the terms
"subdivision" and "subdivided land" as set forth in Section 30-
28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and Section 2-1A(3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land owned by James P. and Barbara J . Prebish,
be exempt from the definition of the terms , "subdivision" and
"subdivided land" pursuant to its authority under Section 30-28-
101 (10) (d) , CRS 1973.

Dear Commissioners :
The attached application, plat, and related items are in reference to
a request by James P. and Barbara J. Prebish for a recorded exemption.
The parcel of land in question is described as the Wz of the NE-?-f of
Section 28, T4N, R64W of the 6th p.m. , Weld County, Colorado. Said
property is located 7 miles south of Kersey. The subject property con-
tains 80 acres of Class III , IV, and VI irrigated soils.
The request is to split the property into parcels of 12. 50 acres and
67. 5 acres. As indicated in a letter dated August 12, 1977, from
William Albion Carlson, there is currently one residence in a commercial
hog operation located on the proposed 12. 50 acre parcel . The proposed
lot containing 67. 5 acres is currently unimproved irrigated agricultural
ground. As is indicated in the reference letter, the Prebish' s desire
to sever the residence and hog operation from the irrigated agricultural
land.
Based upon the information submitted and the adopted policies in the
county, the Department of Planning Services staff recommends the request
be approved for the following reasons:
1. The proposed split conforms with the intent clause of the recorded
exemption procedure (Section 9-2 of the Weld County Subdivision
Regulations) , the intent clause of the Agricultural District (Section
3. 3(A) of the Weld County Zoning Resolution) , and the Weld County
Comprehensive Plan since the proposal would be promoting agricultural
use by severing the independent farm operations (i . e. , the
commercial hog operation in the irrigated agricultural land) and
providing for their independent development and advancement.

Gentlemen:
We submit herewith an application for Recorded Exemption re-
lating to the W4 NE4 28-4-64, Weld County, and submit for your
consideration this additional information.
Division of the 80 acre-tract into Lots A and B is asked pri-
marily because the owners James P. Prebish and Barbara J. Pre-
bish are in the process of securing a Dissolution of their
marriage. In connection with this Dissolution of Marriage,
a property agreement has been entered into, and it appears
that it is necessary to sell the property. The Prebishes have
this 80 acres and another 160 acre-tract which is a considerable
distance away from and is not contiguous to this property.
The Prebishes have operated a commercial hog operation on the
area designated as Lot A. This operation is one which can be,
and usually such operations are, operated independently of the
farming operation. They have invested a great deal of money
and time in the improvement of Tract A for the hog operation.
Tract A has several buildings and other improvements which are
specially constructed for the hog operation, and which would
be of much less value for any other purpose. There are the
following buildings and improvements on this property:
( 1 ) Farrowing barn approximately 30 ' x 60 ' , of cement block
construction, cement floor, divided into 12 farrowing pens and
4 farrowing crates. It has a 3 ' alleyway running the length
of the barn, and 2 granaries and an office on the end. The
partitions within the barn are made of cement block, and are about
4 ' high. The granaries and the office area are partitioned off
with plywood. There are 2 doors and B windows in the barn.
Water is piped into the building. Hog feeders are attached to
the walls in each of the pens and each of the crates. Waterers
are also attached in each of the pens and each of the crates.

( 2 ) There is one fattening barn 26 ' x 144 ' , also of cement
block construction. Contained in this barn are 4 pens 8 ' x
32 ' each, and other specialized areas for this type of use.
( 3 ) There is a nursery building 32 ' x 32 ' of generally the
same type construction as above set forth, built for the
specialized use of the hog operation.
(4) There is a grain dryer and storage bins with 5 ,000 bushel
capacity, and a 1600 bushel steel granary.
( 6) There are also 3 gestation pens, each 32 ' x 32 ' of sheet
metal and pole construction. Two of these pens have cement
floors and 1 has an earthen floor.
( 7) There are loading chutes and other specialized hog opera-
tion equipment. The fattening pen has automatic feed augers
and feed bins.
The specialized hog buildings and equipment are located in the
southerly portion of tract A.
(8) The dwelling house is located in the northerly portion of
tract A. There are 6 rooms on the main floor, full basement,
a portion of which is used as a garage. The dimensions of the
house are 26 ' x 50 ' . Water supply is by domestic well located
on tract A. This well supplies water for the residence and for
the hog operation. There is also a septic tank located on
Tract A.
Tract A has a frontage on County Road 42 of 550 ' . Tract B has
a frontage on the same road of 770 ' . There is no irrigated
farm land on tract A. All of tract B is irrigated farm land.
There are no residence improvements on tract B; however, there
should be no problem in obtaining domestic water through a well ,
and there should be no problem in providing septic tank fa-
cilities on tract B in the event those things become necessary.
Both tract A and tract B are located within the boundaries of
the Weld Central Water District.
Tract A is a commercial hog operation and can be best used for
that purpose. The operation has heretofore been permitted by
Weld County, and I would assume that the subject operation
properly operated would be permitted to continue.
