RE: GRANT CHANGE OF ZONE FROM A-AGRICULTURAL DISTRICT TO
C-COMMERCIAL DISTRICT AND APPROVAL OF UNIT DEVELOPMENT
• PLAN FOR TOM SCHEIRMAN, 2130 24TH STREET ROAD, GREELEY,
COLORADO 80631.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home

Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and

WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public hearing on the 21st day of February, 1979
at the hour of 2 : 00 o' clock p.m. for the purpose of hearing the

rado 80631 for a change of zone from A-Agricultural District
to C-Commercial District and for approval of a unit development
plan for the following described real estate, to-wit:
A tract of land in the Southwest Quarter of the
Southwest Quarter of Section 3, Township 5 North,
Range 66 West of the Sixth Principal Meridian,
Weld County, Colorado, more particularly described
as follows:
Commencing at the Southwest Corner of Section 3,
Township 5 North, Range 66 West of the Sixth Prin-
cipal Meridian and considering the West line of
said Section 3 to bear North 07°55'11" East;
thence North 07°55'11" East a distance of 55.82
feet to the True Point of Beginning;
Thence South 89°40'22" East, a distance of 377.71
feet;
Thence North 01°12'00" East, a distance of 857.01
feet;
Thence North 88°46'00" West, a distance of 275.99
feet;
Thence South 07°55'11" West, a distance of 868.89
feet to the True Point of Beginning, said tract
containing 6.449 acres more or less and subject to
all rights-of-way of record.
WHEREAS, Section 8 . 2 and Section 8 . 3 of the Weld County
Zoning Resolution authorizes the Board of County Commissioners
to grant a change of zone upon the showing by the petitioner of
certain facts, and
WHEREAS , Section 6. 6 of the Weld County Zoning Resolution
authorizes the Board of County Commissioners to grant approval
of a Unit Development Plan upon a showing by the petitioner of
compliance with all requirements of Section 6. 6 of the Weld County

Zoning Resolution, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado heard all the testimony and statements of those present,
has studied the request of the petitioner and the recommendations
of the Weld County Planning Commission, and is satisfied that
the request for re-zoning complies with the Weld County Compre-
hensive Plan and the conditions set out in Section 8. 2 and 8 . 3
of the Weld County Zoning Resolution, and that the request for
approval of the Unit Development Plan complies with all of the
conditions set out in Section 6. 6 of the Weld County Zoning
Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the petition of Tom
Scheirman for a change of zone from A-Agricultural District to
C-Commercial District and for approval of the unit development
plan on the tract of land as set forth above be, and hereby is ,
approved subject to the conditions and development standards of
the Planning Commission dated November 21 , 1978 and as modified
by the Weld County Planning Staff which are incorporated herein
by reference and adopted by the Board of County Commissioners.
BE IT FURTHER RESOLVED by said Board that approval is also
contingent upon the requirement that there be no access on
10th Street.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 21st day of
February, A.D. , 1979.

The following business was transacted:
I hereby certify that pursuant to a notice dated January 15 , 1979 ,
duly published January 18 , 1979 and February 8 , 1979 in the
Johnstown Breeze, a public hearing was held on the request of
Tom Scheirman for a Change of Zone from A-Agricultural District
to C-Commerical District. The applicant was represented by
Gary Sears. Mr. Sears and Mr . Scheirman presented testimony
and answered questions . Wally Jacobson, representing the
Colorado State Highway Department announced that his department
would prefer that access from West 10th Street not be allowed.

After deliberation, Commissioner Steinmark made a motion to
uphold the Planning Commission' s favorable recommendation and
further eliminated the access on West 10th Street as requested.
Commissioner Roe seconded the motion. Commissioner Kirby and
Chairman Carlson voted nay. Commissioners Dunbar, Roe and Steinmark
voted yea. The motion carried. Commissioner Roe made
a motion to approve the Change of Zone from A-Agricultural
District to C-Commerical District, to approve the Planned
Unit Development, and the Development Standards as revised.
The Plan to be revised before recording. Commissioner Kirby
seconded the motion and it carried unanimously.

Based upon a review by the different referral entities of the
additional materials submitted prior to the scheduled County
Commissioners Hearing , the Department of Planning Services staff
recommends that the following statements be incorporated into the
Development Standards as recommended by the Planning Commission :
1. Development Standard #9 being amended by the addition of the
following :
A. The sanitary disposal system shall be two 1 , 500 gallon
septic tanks arranged in a series . Man-hole access ports
shall be provided for access to septic tanks for
cleaning. Each septic tank shall he a single compart-
ment . Each tank shall be designed to be load-bearing
if placed in traffic areas as shown on the unit
development area. This shall include all area
underneath service roads .
B. Sewer lines laid under traffic areas shall be cast iron .
The following sewer lines shall be constructed of cast
iron :
1 . Sewer line from building to first tank.
2 . Line connecting first and second tank.
3 . Line from second tank to leachfield area.
C. The leachfield area shall be a minimum of 10 feet from property
lines . If this separation cannot be accomplished, a variance
from the Board of Health with adjacent landowner approval must
be granted.
2 . Replace Development Standard #14 with the following :
The perimeter slope stability of the filled portions
of the site shall be in compliance with the recommendations
contained in the Soils and Geologic Investigation Report
prepared by Empire Laboratories , Inc . , Project No .
3389-78 .
These recommendations include the following :
The fill slopes constructed at the site be flattened to
slopes no steeper than 2 : 1 . The channel of the small
intermittent stream which flows adjacent to the fill
slope in the northeast portion of the site should be
properly designed and sized to carry peak flows during
periods of flooding . The lower portion of the fill
embankment adjacent to the stream should be properly
riprapped to prevent erosion of the toe of the fill
slope by the stream. The riprap should be placed three
(3) feet above the flood elevation of the stream.
A small ditch or berm should he provided around the
top of the fill slopes to prevent surface water from
running over their surface . All cuts should he
designed for slopes no steeper than 2 : 1 . All cut and
fill slopes should be vegetated to minimize erosion .
3 . Change existing Development Standard #14 to #15 .
The Department of Planning Services staff recommends the Board not
issue a final approval of the change of zone and PUD plan until the
applicant revises the PUD plan to incorporate the recommendations
found in the Preliminary Soils and Geologic Investigation report
prepared by Empire Laboratories, Inc . The recommendations include
a 2 : 1 slope requirement which appears to affect the location of the
service road and therefore the buildings as shown . Also the Empire
investigation recommends riprap at the toe of the slope to three
feet above the flood elevation of the intermittant stream which
flows adjacent to the northeast portion of the site . The channel
should be designed and sized to carry peak flows during periods of
flooding.
The PUD plan should indicate the location of the toe and top of the
fill slope . Also the plan should show detail of the stream channel
and location of riprap as recommended by the Empire investigation
prior to final approval by the Board and subsequent recordation of
the PUD plan .

1 . It is the opinion of the Planning Commission that the applicant has
complied with Section 8 . 3 of the Weld County Zoning Resolution

evidence that such rezoning is necessary. Recent
findings and oral statements by petitioners should
show very clearly that either the original zoning
was faulty or that changing conditions in the area

PLANNING COMMISSION RECOMMENDATION
November 21, 1978
It is the opinion of the Planning Commission that the applicant
has demonstrated that changing conditions in the area now
justify a new zoning classification . This determination is
based, in part , on the fact that since the approval of the
original county zoning in May , 1961 , for this property ,
conditions in the area have changed and will continue to
change as the City of Greeley ' s growth pattern continues in
a westerly direction toward this property . This is evidenced
by the fact of the Country Club West - Westmoor West
Annexation by the City of Greeley in April , 1978, which
annexed approximately 315 acres . This annexation is located
within a 4 mile of the property under consideration .
Additionally, the county has approved similar change of zone
requests in November , 1966 , and January , 1978 , on property
located just to the west and southwest of the property under
consideration .
2 . The rezoning request agrees with the policies contained within
the Weld County Comprehensive Plan in that the request for
commercial development is in compliance with the use designation
for this area as outlined in the Greeley Comprehensive Plan .
The Planning Commission recommendation for approval is conditional
upon :
1. The access on 10th Street (U. S . Highway 34 Business as now shown
on the plans being deleted. The City of Greeley Planning
Commission in a letter dated November 16 , 1978, has indicated
the following :
"At its November 14 meeting the Planning Commission
reviewed the revised plan for the commercial rezoning
and voted unanimously to recommend to the County
denial of the revised plan on the basis of the access
to Tenth Street which is unacceptable . The Commission
feels that access limitations were an integral part of
the original plan which accompanied the rezoning
request upon which the Commission had no objection .
If the rezoning includes access to Tenth Street , then
the Commissioner ' s motion should be interpreted as a
recommendation of denial . If access is limited to
59th Avenue , then the previous Commission recommendation
of no objection may stay . It was emphasized that the
accessibility to the property from 59th Avenue is more
advantageous due to the orientation of the development
toward 59th Avenue and the improved safety and
circulation that is anticipated with signalization of
the intersection . "

PLANNING COMMISSION RECOMMENDATION
November 21 , 1978
A copy of the Greeley Planning Commission minutes and the
letter indicating the Greeley Planning Commission ' s previous
recommendation are included in the attached materials .
The Planning Commission feels that driveway access to or from a
major arterial such as West 10th Street is not condusive to safe
movement of traffic . This problem is compounded by location of
an at grade intersection 300 feet west of the proposed driveway .
As pointed out in the Weld County Comprehensive Plan, the purpose
of transportation arteries is the rapid and safe movement of large
volumes of traffic . Disruption of controlled access deters the
proper functioning of arterials .
The Unit Development Plan shall be revised to reflect no access
from Tenth Street (U .S . Highway 34-Business) prior to the scheduled
County Commissioners hearing.
2 . Submission of a Slope Stability Study for the perimeter of the
filled portions of the site . Refer to the letter dated

5. Construction of a deceleration lane into 59th Avenue . This
has been requested by the Colorado Division of Highways in
letters dated August 23 , 1978 , and October 16 , 1978 . Con-
struction of the deceleration lane shall be at the developer ' s
expense and built in accordance with the specifications of
the Colorado Division of Highways .

adopted for the unit development area.
7 . No building or electrical permits shall be issued on the
unit development area until the Development Standards for the
unit development have been placed on the Unit Development
plat and said plat has been delivered to the office of the
Department of Planning Services .
SUNDOWN PLANNED UNIT DEVELOPMENT
DEVELOPMENT STANDARDS
1 . All aspects of the proposed uses shall not produce effects such
as industrial noise , dust , smoke, vibration , odor, fumes , radia-
tion, or other environmental impacts which will be observable
with the natural senses at the P.U.D . boundary.
2 . No outdoor storage shall be permitted. Storage areas must be
completely enclosed.
3 . Setbacks shall be as shown on the plan or shall be a minimum
setback of 25 feet from the 59th Avenue and West 10th Street
Reservation lines as shown on the plans or lot lines .
4 . Landscaping shall be provided as follows :
A. Lawn areas -with trees and shrubs shall be established as
shown on the plans .
B. A ten (10 ) foot landscape strip shall be maintained on the
portions of the lot adjoining public right-of-way.
C. A minimum of 15% of the total lot area shall remain open
(not covered by buildings or asphalt ) . Public right-of-way
parkways which are permanently landscaped and maintained by
the developer may be included in the 15% requirement .
D. Parking areas shall be landscaped with one tree per 4 , 000
square feet of asphalt area. Trees shall meet a minimum
diameter of three inches and shall have a minimum 25 square
foot planter area. The landscape plan shall he devised so
that large 'expanses of parking lot are segmented by the
planter areas .
E. No trees shall be planted in the southwest corner of the
property that will impair sight distance.
5 . Parking shall be provided for gross floor area of the buildings
based upon the following ratios :
retail - 1 : 200 sq . ft . ; office-1 : 300 sq. ft . ; wholesale-1 : 600
sq. ft . ; restaurant-1 : 4 seats
If over 50% of a business floor area is devoted to storage , then
that floor area may be exempted from application of the parking
requirement . All parking areas must be paved with asphalt or.
concrete.
6. A total of 1 , 244 square feet of sign surface area is permitted
on the site. This includes both sides of free standing double
face signs and single face signs attached to the building . Signs
may not exceed 30 feet in height nor he larger than 200 square
feet on any one face.
7 . As shown on the unit development plans, additional right-of-way
shall be reserved for 50 feet on the east side of the 59th Avenue
centerline and 75 feet on the north side of West Tenth Street
(US Highway 34-Business ) centerline.
8 . Access to the site shall be limited to 59th Avenue as shown on
the unit development plan . All accesses shall have the approval
of the Weld County Engineering Department . All accesses shall
be constructed in accordance with the recommendations and/or
requirements of the Weld County Engineering Department .
9. Use of property shall comply with all County and State Health
Standards and Regulations pertaining to air quality , water quality ,
noise emission , and sanitary disposal systems .
10. The unit development area shall be maintained in such a manner
so as to prevent soil erosion , fugitive dust and the growth of
noxious weeds.
11 . Drainage design of the site shall be in compliance with the
Drainage Report for Sundown PUD and Rezoning , Project No. 1978-474
prepared by Freese Engineering on file with the Weld County Depart-
ment of Planning Services .
12 . All construction and electrical work shall he done in accordance
with the Weld County Building Code.
13 . Prior to construction of any structures a soil and foundation
investigation shall be conducted to determine proper foundation
design on the site.
14 . The unit development plans shall be limited to the plan submitted
and governed by the Development Standards stated above and ap-
plicable Veld County regulations . Any material deviations from
the plans and/or Development Standards as shown or stated above
shall require the approval of an amendment to the Unit Development
Plan by the Planning -Commission and the Board of County Commis-
sioners before such changes from the plans and/or Development
Standards shall be permitted. Any other changes from the plans
and/or Development Standards shall be filed in the Office of the
Department of Planning Services .

ANSWERS TO THE QUESTIONS ON CHANGE OF ZONING
1. Yes, it is impractical, impossible, and undesirable to develop
this land at the present time. The land is currently zoned
agriculture which limits the use of the land. This tract will
need a commercial planned unit development type of zoning to
accommodate a variety of businesses, which would meet the needs
and changing conditions of the area. Greeley is growing to the
west and since this tract is in the cities comprehensive plan a
commercial planned unit development would be the most beneficial
zoning for the developer and the community.
2. Yes, the proposed rezoning would benefit the entire county.
This development is needed in this specific area and connot be
located in other parts of the county. The land adjacent to this
parcel of ground will be zoned for a housing development accord-
ing to the cities comprehensive plan. To locate the development
elsewhere would be of know benefit to the housing development and
would not fit into the cities comprehensive plan for the population
growth of west Greeley.
3. Yes, the proposed rezoning would benefit the lands adjoining the
area requesting the change. It would give the area residents
shopping and services needed and would compliment the proposed
housing development to the east. The housing development would
then have excellent access to the businesses and services which
would be provided by the development.
4. The main feature of this parcel that makes it logical to rezone
and not the surrounding parcels is the location. It is located
adjacent to the proposed housing; development which is in the cities
comprehensive plan as an area suitable for housing. The property
has excellent access since it is located on the northeast corner
of Highway 34 and 59th Avenue. Highway 34 gives it east west
accessibility and 59th Avenue gives it the north south accessibility.
Prime location for the housing development is located to the east of
the development.

5. The other areas in the county already zoned in this classification
are unsuitable for the proposed development since they are not
located next to the proposed housing development. This site has
also been proposed for a business site by the cities comprehensive
plan. This site offers accessibility with an ample amount of
space for a business - commercial development.
6. The changing conditions that justify this property to be rezoned
is that it is located in the path of our cities comprehensive plan.
This plan is for future growth and development of the city. The
parcel in question needs a change in the zoning from agriculture
to commercial planned unit development to accommodate the businesses
which are planned for this area. The property is presently zoned
agriculture whick makes it unsuitable for these businesses. The
changing conditions have out dated the present use of the property
for all practical purposes. If the cities comprehensive plan is to
be used then it is justified to change the zoning to commercial
planned unit development.
7 . The economic evidence that the area covered by the petition needs
additional businesses is evidenced by the -fact that there will be
a large housing development adjacent to the property. The housing
development will use the goods and services provided by the businesses
in the development. As the city of Greeley grows toward the west
and the area becomes more populated this development will see a
large economic growth, provided it is developed properly. New
businesses will create more jobs and give people more buying power
increasing further enconomic growth in this area.
8. The owner of the property has been contacted to build sites for
several businesses, light commercial and other small businesses.
The owner feels very confident that at least five additional firms
are willing to locate in this prime location. The land has been
surveyed and leveled for building purposes. Further development
would probably start in the early month of 1479 and continue until
all ;,usiness spaces are leased. Please refer to the plat of the
proposed commercial planned unit development for this area.

RE: Sundown PUD Storm Drainage Plan
Gentlemen:
The requirements for developing a storm drainage plan were discussed
with Rod Hutchinson of the County Engineers Office. He indicated that
a detention volume be determined by the difference between the site's
developed and undeveloped conditions using a 100 year storm. Allowable
release rate from the site would be that of the 5 year undeveloped
runoff.
Analysis of the site indicates that the required volume, approximately
26,000 cubic feet, can be detained on site. This may he achieved by
a combination of a detention pond and water detention on each rooftop.
This method would require adequate provisions such that water may be
held at a determined depth on each rooftop without structural damage.
Allowable release from the site has been determined to be 2 cfs.
Release from each pending location will be proportional to its volume
of the total being retained. I believe this runoff will not be a
hazard or nuisance to the surrounding area when properly controlled.
I foresee no problems in developing a final drainage plan which will
meet the City of Greeley and Weld County requirements.

Absorption Field Area
The absorption area required for each area is determined using the formula on page
33. I assumed the. daily flow as above and a percolation rate of 30 min/in (to be

require 3950 sq.ft.
There is adequate area Lo the West of each building to be used as an absorption
field. A series of two tanks in each area with a system of trenches will meet
the County requirements and regulations.

that not reserved for ROW) being 5. 31 nrres, more or loss , and presently
undeveloped. IL is proposed to construct two commercial and retail
buildings on the site and provide parking for them. The ground slopes
generally to the North and is formed by two terraces , the South being
the higher. This report encompasses the entire developable area as
shown on the site plan.
DESIGN CRITERIA
The "'4orlilied Rational NeIhod" as referred to in a report for the
Design of Detention Facilities as prepared by Frasier and Gingery Inc.
of Denver was used as the basis of this report . The rainfall intensity
curves, as prepared he Hogan and Olhausen P.C. for the City of Greeley
were used for the respect lee design storm frequency and intensities.
The requirements of the Weld County Engineer were that 100 Year storm
frequency he used as hhe basis for design of the detention areas and
that the dischdrg,e from these arras he equal to or less than the
historical runoff tar a 5 wear storm.
A runoff coefficient at . 20 was selected for the site under present
conditions. A rnnefl coefficient of . 86 was selected for the site
when fitly developed . An antecedent coefficient of 1 . 25 was used in

• eIAA be required, This volume may be retained on site by a combination of
f rooftop storage and a detention pond . It is proposed to grade the
site so that runoll loaves the parking area, and is then carried by swale
into the detention pond. By making use of the rooftops as detention
areas, the building must be on a level grade and he designed against
structural failure. It is proposed to select one of the following

6. Parking must be provided for gross floor area of the buildings based upon
the following ratios:
retail- 1: 200 sq. ft. ; office- 1 : S00 sq. ft. ; wholesale- 1 :600 sq. ft. ;
restaurant- I :4 seats
If over S0°; of a business floor area is devoted to storage, then that floor
area may he exempted from application of the parking requirement. All
parking areas must he paved with asphalt or concrete.
7. Parking areas most he landscaped with one tree per 4000 square feet of
asphalt area. Trees must meet a minimum diameter of three inches and
must have a minimum 25 square foot planter area . lhe landscape plan must
he devised so that large expanses of parking lot are segmented hp the
planter areas.

This includes both sides of free standing double face signs and single

II . RL:ONING : AGRICULTURE TO BUSINESS
LOCATION: 59th Avenue and U . S . 34 Bypass
Jack Coy was present with a client interested in purchasing a
seven acre parcel located at the northeast corner of 59th Avenue
and U . S . 34 Business on a portion of the Mosier farm. The
property is approximately 377 feet in width and 913 feet in length
and fronts primarily upon 59th Avenue .
Darryl Alleman explained that water service is not presently
available at the site and that a 20 inch line located 1500 feet
east of the 59th Avenue intersection must be extended . The water
transmission line has inadequate pressure for additional water
taps . In addition , raw water transfer would he required with any
taps . There is no sewer service available .
Al Chotvacs of the State Highway Department commented that access
onto U. S . 34 Business ' is discouraged and that any access would
probably be limited to right turns in and out of the property
because much of the frontage along 34 Business will be taken up
in aecel - decel lanes and left turn pockets .
Max Karner explained the City ' s drainage detention requirements
of a 100 year detention and a five year release rate . There is a
drainage pathway that runs north and south through a portion of
the property.
Planning Staff and the Highway Department expressed concerns for
extensive commercial development occuring at 59th Avenue . The
Mosier farm located just west of the subject seven acre parcel
consists of 22 acres of land fronting on 34 Business . The staff
suggested that the County ' s business :one could be considered
on the seven acre parcel in order to develop a neighborhood shop-
ping center. It was also suggested that the Business Unit Develop-
ment zone he considered by the County as a means for inclusion of
City zoning and drainage standards in the zoning requirements .

We have reviewed the rezoning request of Mr. Tom Sheirman for property
located in Section 3, T5N,R66W. The major geologically related concern
is the safe disposal of sewage. Mr. Scheirman indicates that septic
systems will be located on the north and south sides of the developments.
The preliminary plat indicates that these areas are proposed as service
roads. We recommend that the method and location of sewage disposal
systems be ascertained and noted on the plat prior to approval of the
rezoning application. Additionally, we recommend that the sewage
disposal areas not be placed in the detention pond area and that an
operation and maintenance program be developed.
Drainage and soil foundation conditions also should be considered
during subdivision development. Drainage conditions could influence
the layout of lots , detention pond size, and grading operations.
We suggest that a drainage study be conducted prior to PUD approval .
In addition, foundations should be designed for the specific soil
conditions present in the building area. We recommend that a soils
and foundation investigation be conducted prior to any construction.
In conclusion, we suggest that sewage disposal methods and locations
be fully discussed by the applicant. This should include the devel-
opment of an operation and maintenance program. Until a safe method
has been formulated , we cannot recommend approval of this rezoning
request.

We have reviewed the application from Tom Scheirman for a change of zone
from agricultural to commercial with a planned unit development. This property
was previously reviewed as a recorded exemption and comments were submitted
to your office in a letter dated August 23, 1978 (copy attached) .
We note that our requested 75-foot half right of way is indicated on plans
for Sundown P.U.D. As mentioned in our previous letter, we ask that this right
of way be dedicated, since developments to the east of this site have done so.
The plan also shows no direct access to State Highway 34, as was recommended
in our previous letter. However, we would like to re-emphasize our request for
the construction of a deceleration lane into 59th Avenue. This lane would be
of real value as a means to allow right-turning vehicles to leave the westbound
lane of S.H. 34 and avoid potential rear-end accidents.
We would further bring to your attention our concern with regard to potential
development to the east of this site with regard to access to the highway. Again,
as mentioned under Item 2. , paragraph 3 of our previous letter, it is very impor-
tant to coordinate the street systems on the north side of S.H. 34 so as to
minimize or, preferably, avoid the need for additional access to the highway
on Mosier Hill . Sight distance on this hill is not good, and additional access
points would be potential hazards.

N.e have rcvie?;ed the application from East Greeley Land Company for a recorded
exertion, and wa ask for your consideration of the following comments.
1. Traffic projections for this portion of State Highway 34 indicate the need
for 150 feet of right of ray, 75 feet each side of the highway centerline.
We ask that 75 feet be protected on the north side of the highway centerline
by setback, reservation, or dedication (preferably the latter) as local zoning
laws and regulations permit.
2. We feel that access to Lot A should be obtained from 59th Avenue rather than
from the highway. To better accommodate vehicles entering 59th Avenue from
the east, we also ask that a deceleration lane be provided. This lane will
allow right-turning vehicles to move out of the through lane and thus avoid
potential rear-end accidents.
This lane would be constructed at the developer's expense and would require
a Driveway Permit. Application for this permit should be made upon final
approval of the site development plan to: Mr. David N. Fraser. District IV
Maintenance Superintendent, P. O. Box 650, Greeley, Colorado 80632. The
attached sheets provide specifications to which this lane should be built.
Any potential access to Lot B from the highway will be viewed by the Division
as a major access requiring extensive highway improvements such as those being
provided by Webhan Corporation at 50th Avenue and 48th Avenue. It is important
to anticipate at this time how access to this development will be coordinated
with other subdivisions and other access points along the highway.
3. The impact of highway noise on this property should be addressed by the
developer in future site planning. The generally recommended setback for
comrercial development is 100-150 feet from the centerline and 150-200 feet
for residential uses. These distances assume no other abatement measures
such as walls, earth berms, or noise-insulated construction.

Dear Mr. Cunliffe:
We have reviewed the revised version of Sundown P.U.D. which indicates an
access to State Highway 34 (Business) . It has been our recommendation that there
be no direct access to the highway, but an access did exist at this location prior
to this zone change and P.U.D. application. The District IV Maintenance Superin-
tendent has determined that this access can continue to be used, as indicated on
the attached copy of an October 30, 1978, letter to the applicant.
However, we feel that certain safety features must be incorporated into this
access. The developer will be required to build a deceleration lane according
to the standards shown on the attached sheet. This access is to allow right turns
only and must be signed as such. Left turns from the highway will be prohibited,
and this will also require proper signing.
Application for a Driveway Permit should be made only after this P.U.D. is
approved and the developer is ready to begin construction work. Three copies of
the approved plan showing details of the driveway reconstruction and the decelera-
tion lane construction should be submitted with the completed permit to: David N.
Fraser, District IV Maintenance Superintendent, P. 0. Box 850, Greeley, Colorado
80632.

This office has reviewed your verbal request for permission
to change a field entrance to a 35 ft. wide commercial driveway
on SH.H. 34 business route west of Greeley at 59th Avenue.
The State Highway would issue a permit upon receiving an
approved plat and written request from the property owner.
We would require the driveway on S.H. 34 be a right turn

has been reviewed by Environmental Health staff and the following
comments are submitted:
1 . The Preliminary Septic Sewer Report prepared by
Freese Engineering is unacceptable to this
department for the following reasons:
a. The septic system cannot be located
under a parking lot (paved or unpaved) ,
(paragraph 5.4. 6. 1 , Weld County Individual
Sewage Disposal System Regulations) .
b. Average daily flow for restaurants
(with kitchen wastes) should be •
10 gal ./person/day instead of
3 gal . /person/day as stated on page one
of the report. Also, figures on this
page are misleading due to incorrect
multiplication.
2. The septic system will require Colorado Department of
Health approval due to its size (design exceeds
2000 gals./day) .

Commissioner Clift seconded the motion . Vote was taken and the

IV . FINAL PLAT: SOLAR RIDGE SUBDIVISION
LOCATION : 19th Avenue and 24th Street
John Given presented the final plat of Solar Ridge Subdivision .
Commissioner Cummins asked to see a copy of the approved preliminary
plat . Mr . Given showed this to the Commission and noted that the
major change to the plat is that a portion of 19th Avenue was built
but never dedicated so this is now being done. It was therefore
necessary to widen lot 2 . Commissioner Cummins noted that there
had been some problems with lot 2 discussed at the time of review
of the preliminary plat . Jay Freese explained that Waldorf School
will probably be keeping lot 2 . Chairman Dietz expressed concern
for the private drive in the area which has been named, as well
as the access to the property . He asked i £ the lots still meet
R- ill requirements . Mr . Given replied that they do . Commissioner
Clift asked if drainage for the area has been taken care of.
Mr . Freese replied that drainage will he handled as each individual
lot is developed. Commissioner Clift asked if the grade of the
street would cause problems . Mr . Freese replied that it would
meet minimum requirements . Max Earner , City Engineer, commented
that the street does meet all the requirements although it will not
he a typical street . Chairman Dietz asked for further clarification
on the handling of the drainage . Mr . Earner explained that each lot
will have to pro- rate drainage from the street for that lot so the
water will still run off the property hut no more than would histori-
cally drain off . Commissioner Cummins made a motion to approve the
final plat. Commissioner Roeth seconded the motion . Vote was taken
and the motion carried unanimously .
VI REFERRAL FROM COUNTY : Revised Preliminary Plat of Bird Subdivision
LOCATION: 2120 71st Avenue
John Given explained that this item has been reviewed previously
and the Commission recommended denial , with the request that
provision be made for access to adjoining property . The present
plat accommodates this request . Chairman Dietz asked if 24th Street
is anticipated to extend through this property . Mr . Given pointed
out the location udie re 24th Street will likely extend through .

from 24th Street be the primary access to future interior subdivision .
Mr . Freese suggested that a temporary turn-around should be shown
where the street is stubbed . Mr . Given noted that the geometries

before and recommended no objections to it . Since that time the
applicant has returned to the County with a revision of the plat
showing a right-turn only access to Tenth Street and a reduction
in the size of a building to allow additional parking off of Tenth
Street . Staff has expressed concern that if the development does
not have controlled access off of Tenth Street problems could
arise . Signalization at 59th Avenue is anticipated . He presented
a ,letter to Chairman Dietz which was just recently received from the
Highway Department . Staff would continue to recommend the C . 11 .1) .
Man as originally submitted and recommended against the revision
to the plan .

Commissioner Clift noted that there was a concern when this item
was heard before that Tenth Street should not he allowed as access .
Jack Coy commented that he had approval from the State for the
entrance onto Tenth Street . Commissioner Cummins asked if the
letter changed the staff ' s recommendation . Mr . Given replied that
it did not . The indication all along has been that the highway
department opposed the access onto Tenth Street . Traffic could
bottleneck in the arch and the best access would be from 59th
Avenue . The acceptibi ] ity of the proposed commercial uses was
tied into design aspects such as this . Chairman Dietz asked why
the developer was persuing this revision . Mr . Coy replied that
the request came from the prime tenants of the property . Mr .
Karner noted that he has no problem with right-hand access but
is concerned with possible left turns . He would like the access
to be designed to prevent left turns from occurring . Mr . Sasaki
asked if this design would require the developer to put in curb ,
gutter , and sidewalk . Mr . Karner replied that it would require
some type of delineation, hut this could be done with a delineator
post . Commissioner Cummins questioned the number of parking
spaces provided . Mr. Given replied that 235 are shown , hut 28
cannot be used according to zoning standards . Mr . Freese
commented that he would guess that a traffic light would eventually
he required. Commissioner Cummins noted that he would feel better
about the proposal with a light at the intersection and ingress
from Tenth Street.
Mr . Given expressed concern with revisions taking place after
the staff clearly indicated that this wasn ' t as desireable as what
was previously proposed . Mr . Sasaki explained that the land use
was recommended on the basis of the C . U . D. which would control
access . Now the developers are requesting access in the place
where it is least desireable . Chairman Diet: stated that this
could set the area up for future problems . Mr . Sasaki noted a
problem which would he created to the east where Mr . Mosier ' s pro-
perty is located with the only existing access onto Tenth Street
further up the hill . Mr . Given commented that he would anticipate
residential development on the Mosier Property .
Commissioner Cummins asked if it was stated in the October 24
motion when the item was considered before that access should not
he allowed off of Tenth Street . Mr . Given read the portion of
the minutes discussing Tenth Street. access . The letter sent to
the County regarding the Planning Commission review of the item
did list this as a concern of the Commission . Commissioner
Cummins asked if there had been any comments from the County
regarding this access . Mr . Scheirman replied that there had not
and that he had a letter from the State saving that the access
would he acceptable to then . Mr . Cnv commented that he just
recently found out. that the access was necessary . Mr . Sasaki
asked if the County P1annino Commission has reviewed this item yet .

Commissioner Rocth made a motion to recommend to the County denial
of the plan on the basis of the access to Tenth Street which is
unacceptable . There are no other problems with the development .
Commissioner Clift seconded the motion . Commissioner Roeth noted
that he could appreciate the position with the potential tenant
hut he objects to the access on Tenth Street which could create
hazards since it is so close to the 59th Avenue intersection .
VII . STAFF REPORT
Mr . Sasaki noted that at the last Planning Commission meeting
the Commission mot with the City Council regardinr the Comprehensive

V. REFERRAL FROM Tllli COUNTY: PRELIMINARY PLAT OF BIRD SUBDIVISION
LOCATION: 2407 71st Avenue
Mr. Given explained that this item has come before the Commission
previously and was deferred. A meeting was held with the County
Planning Commission and following this meeting the Planning Commis-
sion has asked that a study he done into the feasibility of construct-
ing a street through the wet area . Regardless of the question of
where 24th Street should be built , there is a problem with the long
cul de sac and the fact that it does not stub either north or south .
Included in the agenda is alternative 1 , which is staff' s recommenda-
tion. Staff is recommending denial until a redesigned plat is
brought to the Commission.
Commissioner Clift made a motion to recommend denial . Commissioner
Roeth seconded the motion. Commissioner Keirnes commented that
development of 24th Street by jogging it north would still be good
land use planning, and jogging it north or south would cut down on
the costs . Mr. Bird asked if there was any way that the revised
plat could be shown to staff without going through the whole meeting
process again. Mr. Given replied that he didn' t want the Commission
in a position of accepting something that they had not seen.
Commissioner Clift commented that he felt comfortable with alterna-
tive 1. Vote was taken and the motion carried unanimously.
VI REFERRAL FROM COUNTY: REZONING "A" (AGRICULTURE) TO C.U .D.
(COMMERCIAL UNIT DEVELOPMENT) '
LOCATION: 59th Avenue and West Tenth Street
John Given explained that the site has been graded and a five •
acre area is developable for a proposed small commercial area at
the corner. This development would have to conform to what would
be allowed inside the City limits and the area is anticipated to
be coming into the City in the next year. Staff has worked with
the County on this proposal to develop the zoning and feels that
the County 's business zone would he most conforming to the City' s
commercial zone. The uses proposed by the developer would not
be allowed in the County' s business zone so County commercial
zoning was necessary. Since the County ' s commercial zone is not
the same as the City' s, the uses to be allowed have been specified
and are intended to he all of those allowed in the City C- 4 zoning •
district. Staff worked with the developers with this understanding , •
and Mr. Given felt that the development standards of the C.U.D. •
as submitted would control development. Staff is recommending no
objections to this proposal .
There was some concern expressed that if an industrial use was
allowed the City would have difficulty zoning the property C-4
when it is annexed to the City. Commissioner Clift asked if
staff would recommend approval of the rezoning if the developers
abide by the restrictions of the City' s C- 4 zone . Mr. Given replied
that they could not be legally held to this . The Commission could
recommend denial and allow only a business unit development .
Chairman Dietz asked if there would be a problem with the City
zoning upon annexation of the land. Commissioner Keirnes replied
that it would depend on the use of the property at the time of
annexation . Commissioner Modlin asked what the time frame was
for the realignment of the City and County Zoning Codes . Mr. Given
replied that this would probably he at least a year away . Tom
Scheinnan noted that they have prepared a list of the uses allowed
under the City' s C-4 zone . Commissioner Keirnes commented that
industrial uses would probably not he allowed because of the land
values . romnissioner Modlin asked if the development heuld be

listed and included in the letter to the County Planning Commis-
sion regarding the City' s recommendation. Vote was taken and the

VII. REFERRAL. FROM COUNTY: RECORDED EXEMPTION
LOCATION: U. S. 34 and Weld County Road 45'-: •
•
Mr. Given explained that this recorded exemption involves a 120
acre parcel which the developer is requesting to split 6 . 8 acres
from. This 6. 8 acre site is to be known as Lot A. The lot split
would allow the existing residential unit on Lot A to be removed
and a new one built as well as a transfer of ownership within the
family. Staff recommended no objections to this proposal , hut
noted that a north-south arterial street is designated in the
Comprehensive Plan to run along the east of the property and
suggested that the land should be reserved for this street. Ed
Carlson told the Commission that the purpose of the recorded
exemption is to allow transfer of the property and building of
the new home after removing the present one. Commissioner Keirnes
asked if the highway department has drawn plans for the road.
Mr. Carlson replied that they do have plans for the continuation
of the highway to the north . Commissioner Modlin made a motion
to recommend no objections tothe proposed recorded exemption.
Commissioner Clift seconded the motion. Vote was taken and the
motion carried unanimously.
VIII . DISCUSSION REGARDING THE PROPOSED UPDATE OF THE INDUSTRIAL
ELEMENT OF THE COMPREHENSIVE PLAN I i
John Given explained that the reason for the meeting with the 1
Economic Development Advisory Board of the Chamber of Commerce
and the Planning Commission was to get their input into the
report that staff prepared. This report is intended to become
an update to the industrial element of the Comprehensive Plan,
and the next step will be a final draft which staff hopes to he
able to release to the public in November in preparation for two
public hearings . Planning staff members then explained further
the individual sections of the draft which they had worked on, and
• opened discussion to the EDAB and the Planning Commission.
Bob Tointon, Chairman of the EDAB, noted that there is a limited I
- choice for prospects available in the community, and encouraged
more flexibility especially to the west of the City. The economic
growth over the last fifteen years has been UNC, Monfort , Kodak,
and Farm Hand, before they moved out . All of these have matured
except Kodak and UNC, which has a cap on it by the government .
Monfort is looking outside of the State for expansion so it is
unlikely that they can be looked at as a source of additional jobs .
Kodak has been on a plateau so at least temporarily it cannot he
considered as a source of additional jobs either. The image
prospects have may be higher than the amount of funds available
and the campus- like park may not fit the pocketbook , hut this
should he an alternative. He commented that they arc presently
seeing more prospects who fit the campus setting with the view
of the mountains , and they have a different idea for their image
than what the feedlots or sewage treatment area provide .

the owners of a 22 acre parcel of land located in the SW1 /4
of Section 3 , Township 5 North , Range 66 West of the 6th
P .M. , Weld County , Colorado .
This property is adjacent to the property owned by
Tom Scheirman. There is a request to change the zoning
of the Scheirman property from "A" Agricultural to "C"
Commercial with unit development.
The Scheirman property is Lot A of recorded Exemption
No . 0959-3-3 RE 335 .
We do not object to the zone change provided the
following three items are checked and properly corrected :
1 . There is an apparent discrepancy as to where the
boundary line is between the Scheirman property and the
Mosier-Connell property and the location of an Interstate
Gas Easement . The recorded exemption does not fit with the
recorded descriptions .
2 . The natural drainage has been substantially changed
by earth moving of Scheirman . Now the water from the South
including the Greeley Reservoir and flood water will be
forced upon the Mosier-Connell property . This could cause
substantial damage in the future . Historical drainage
should be re-established .
3 . Scheirman has changed the natural slope with a
dirt barrier that will wash down on the Mosier-Connell
property preventing the use of a portion of the property , making
it difficult or impossible to install and maintain a fence
close to the property line . This barrier should be removed
and the same slope re-established .

It appears these problems could be corrected by the
developer . We desire orderly development , but certainly do not
believe one landowner should be permitted to change the
topography to suit his needs , but damage his neighbor.

In light of the possible drainage problem you brought to my
attention yesterday , I have the following comments .
The drainage ditch which ran through the northeast corner of
the property has been swaled around the recently placed fill .
It appears that this swale is located on the developer ' s
property and does not pose a major problem at this time . Never-
theless , a 60 inch diameter culvert has been placed under
Highway 34 , upstream of the area of concern . This indicates a
sizable expected flow through the relocated swale . This flow
is especially important considering the fact that one bank
of the swale was formed by the fill and was placed at the
natural. angle of repose .
I recommend that the developer be required to resolve the
problem with the Engineering Department ' s review , prior to
final approval by the Commissioners. Hydrology computations
and design recommendations based on the 25 year event will
be required .
