RESOLUTION RE: APPROVE FOUR (4) VARIOUS COMMUNITY DEVELOPMENT BLOCK GRANT APPLICATIONS AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with four (4) Community Development Block Grant Applications listed below from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, to the Colorado Department of Public Safety, Division of Homeland Security and Emergency Management, commencing upon full execution, with further terms and conditions being as stated in said application, and 1) Emergency Protective Measures (FEMA) 2) Boulder Creek Breach (FEMA) 3) Natural Stream Clearance (FEMA) 4) County Roads 53 (FHWA) WHEREAS, after review, the Board deems it advisable to approve said applications, a copy of which is attached hereto and incorporated herein by reference. Project— Eligible Activity Description: Describe the proposed project. Explain how the proposed project will address recovery and/or resilience needs in your community either independently or as part of a larger project. In an effort to achieve resiliency from the severe storms and minimize risk to the general public, Weld County addressed severe damage to local roadways, bridges, culverts. removed hazardous roadway debris, made emergency repairs to paved and gravel roadways , addressed river embankments/dangerous conditions to the public and made repairs to emergency response vehicles that were damaged during the Incident Period . FEMA Categories B were addressed in this Weld County FEMA Match NOI Application . CDBG funds are needed to be applied towards the Weld County FEMA Local Match for the emergency work that was identified on previously submitted Project Worksheets . All projects covered under the Weld County Project Worksheets were vital for Weld County to clear hazardous debris from roadways/creeks/streams and enhance their infrastructure , river embankments, equipment and roadways . Page 3 of 20 I CDBG-DR Infrastructure Application Colorado Division of Homeland Security and Emergency Management PART A — NOI : CDBG-DR FUNDING QUALIFICATIONS Community Development Block Grant — Disaster Recovery (CDBG-DR) funding can be approved for a project in which ALL of the following requirements are met The physical location of the activity must be within a county listed in Table 1 of the program Recover Colorado Infrastructure Grant Program Guidelines (Guidelines). 1. Connection to Disaster Recovery CDBG's Disaster Recovery funds must be used for necessary expenses related to disaster relief, long-term recovery, restoration of infrastructure and housing, economic revitalization, and mitigation from future damages.. The activity must show a direct link to damages received during one or more of the events listed in Table 1 of the Guidelines. Please provide a brief explanation of how the proposed acquisition activity: (1) was a result of the disaster event: (2) will restore infrastructure or revitalize the economy; or will (3) mitigate future damages. During the incident period of September 11 , 2013 to September 30 , 2013, Weld County, Colorado received heavy rainfall and debris in the creeks, streams and rivers which caused surface gravel removal and scour damage to numerous roads and bridges in Weld County. Compliance with National Objectives State recipients receiving allocations under the CDBG-DR program must certify that their projected use of funds will ensure, and maintain evidence, that each of its activities assisted with CDBG-DR funds meets at least one of the three National Objectives. a) Which of the National Objectives are met by proposed project? r, Will benefit low and moderate income (LMI) persons; or Will aid in the prevention or elimination of slums or blight; or ✓ Is an Urgent Need in which meet community development needs having a particular urgency because existing conditions pose a serious and immediate threat to the health or welfare of the community where other financial resources are not available to meet such needs. b) How will the proposed project meet the above checked National Objective(s). See attached LMI data for the Project. In addition to the LMI data attached , the State of Colorado (according to ACS 2008-2012 5Y ) lists Weld County at a 41 . 0% LMI . In reviewing the LMI data for this Project NOI , the PW's associated LMI % AVERAGE was 42 . 3% . However, this percentage does not accurately capture the total number of service areas that are either directly or indirectly impacted by the FEMA Match Projects . The entire community benefited from the proactive emergency work by Weld County and the removal of hazardous debris and the work/repairs made to the roadways, bridges, equipment and culverts thus the County believes that a higher LMI % should be given for this FEMA match Projects . The general vicinity of FEMA Match Projects encompasses the entire County and greatly benefits the entire LMI population for this project, which is why the County believes that this project not only meets. but exceeds the 50% requirement for meeting the National Objective . The emergency work/repairs that were made under the WELCO PW's for the Local FEMA Match drastically reduced hazardous conditions for the general public and enabled Weld County to focus on resiliency efforts post storm . It is believed that the service area for Project Site Locations benefited multiple LMI tract sections and thus a higher weighted percentage of over 50% should be noted for this p Attach any continuations or additional items as an Attachment to the electronic application and e-mail submittal. As indicated in the Guidelines: "A proposed project's benefits to LMI persons will be an important factor in evaluating potential infrastructure projects. A total of 20% of the Recover Colorado Infrastructure project funding must benefit LMI persons. Due to the very low percentage of LMI projects submitted in the first round of infrastructure funding, it is estimated that approximately 25% to 30% of the funding available in this second allocation must meet the LMI requirement to make up for the deficit." This section does not need to be completed if the project does not meet this National Objective. The primary objective for using CDBG Disaster Recovery funds is benefitting, by at least 51 percent, persons of low and moderate income. Community Hazards Review: Please list and briefly describe in rank order of importance the natural or man-made hazards in your (the Applicant's) service area. The hazards identified within these Projects for the FEMA County Match would be ranked in the following manner: Flood , Erosion and Subsidence . The hazards caused significant damage and posed a severe risk to the community for the designated incident period . 2. High Risk Hazards Addressed by the Project: Describe how, and the degree to which, the proposed project mitigates high risk hazards. Include damage history, source and type of problem, frequency of event(s), and severity of damage information, if available. Hazard 1 Flooding caused the most severe damage to Weld County during the designated incident period which caused multiple roads to be closed and residents to be displaced . Weld County had to work quickly to get the roads back opened so residents could get to their houses. 1lazard 2 Erosion also caused a severe issue for the County . This Project addressed and mitigated against severe erosion damage to local roadways, shoulders, and embankments. The work that was conducted by the County mitigated against any immediate threat/hazard to the damaged infrastructure and restored the infrastructure back to its pre-disaster condition in accordance with regulations . Page 6 of 20 - CDBG-DR Infrastructure Application Colorado Division of Homeland Security and Emergency Management Hazard 3 Subsidence was another critical hazard that caused dangerous conditions for the community. This Project addressed and mitigated against severe subsidence damage to local roadways , shoulders, bridges and embankments . The work that was conducted by the County mitigated against any immediate threat/hazard to the damaged infrastructure and restored the infrastructure back to its pre-disaster condition in accordance with regulations . Note: If your proposed project addresses more than three Hazards, please provide that information as an attachment. 3. Elimination of Risk: Does the proposed project result in the elimination of a hazard from your (the Applicant's) service area? If so, please describe. If not, please estimate the degree to which this project will mitigate the risk from the hazards identified in Item #2. This Proposed FEMA Local Match Project for the Category B PW's eliminated any and all hazards from the County's service area by opening roads and providing emergency response measures to the residents . These types of hazards that occurred in Weld County and throughout Colorado are truly an act of mother nature and the County was as prepared as it could have been but the severity/duration of the incident was of an unprecedented nature . However Weld County cannot eliminate the risk of future flooding , erosion or land subsidence , but Local Officials can ensure that their community is prepared for future incident, take the necessary precautions and that their infrastructure is restored properly to its pre-disaster condition . 4. Environmental Quality Improvements: Does the proposed project result in an improvement in the quality of the natural environment in your (the Applicant's) service area? 1f so, please describe. Yes; the damages that attributed to the designated incident period and FEMA-DR 4145 were addressed via the attached PW's and the work conducted to restore the infrastructure back to its pre-disaster condition was implemented . The work done at each site location (see previous attachment for lat/long coordinates ) addressed not only repairs made to the infrastructure, but also repairs to the river embankments and any potential erosion or subsidence issues that could have worsened if the County had not taken the proactive mr�oei 'rncc +int +him Aid 5. Climate Change Improvements: Does the proposed project reduce or ameliorate a projected impact of climate change in Colorado? If so, please briefly describe the benefit of the project. This Proposed Project reduces a projected impact climate change due to the proactive mitigation measures that were undertaken by Weld County during the designated incident period . This was accomplished by ensuring that each damaged site location was addressed as soon , but as safely , as possible , and not to sustain any further impacts to the site locations or environment that would enable the damage to enhance the projected impact of any potential climate changes. Community Process: Does the proposed project include a community planning or involvement process that increases community resiliency? If so, please briefly describe the process. This Proposed Project was initiated by County Officials in an effort to achieve resiliency from the severe storms and also to minimize risk to the community, Weld County addressed the severe flood damage and debris that accumulated on the roadways and infrastructure by ensuring that dangerous conditions for the public were addressed and mitigated properly and efficiently. 7. Reduction in the Costs of Future Response or Recovery: Will the proposed project result in a reduction in the cost of response or recovery from an incident occurring due to one or more of the hazards identified in Item #1 or #2? If so, please briefly describe how response or recovery costs will be reduced. For a small scale flooding incident, yes ; however, the flooding that occurred during the designated incident period was catastrophic and the PW's associated with the NOI FEMA Local Match Request were completed to address the damages . 8. Floodplain/Floodway/Substantially Damaged Properties: Does the proposed project include a property or properties located in a floodway or floodplain; or not located in a regulatory floodplain but which were substantially damaged or have a history of damage from at least two disaster events? If so, please identify those properties below. No; the Proposed Project is for the FEMA Local Match from CDBG-DR in regards to expenses from CAT B for the designated incident period for FEMA-DR 4145 . 9. Yes; the Proposed Project complies with all local community plans and this Project integrates into the Plans because the County addressed the damages to local roadways and infrastructure and mitigated damages that posed a serious risk/hazard to the community during the incident period . All FEMA PW's were initiated by Weld County and via this Proposed Project, the County requests that CDBG funds be applied towards the local FEMA Match for this Project. 11. Environmental / Historic Preservation Issues: Please describe any significant environmental, historic, or cultural features that may be affected by the project. Please also describe any features that may be improved by the project. There were no significant environmental , historic or cultural features that were affected by this project. Community Resilience: Please describe how this project will increase the resilience of your community. As defined in the Guidelines: "Resilience incorporates hazard mitigation and land use planning strategies; critical infrastructure, environmental and cultural resource protection; and sustainability practices to reconstruct the built environment, and revitalize the economic, social, and natural environments." In an effort to achieve resiliency from the severe storms and minimize risk to the general public, Weld County addressed severe damage to local roadways , bridges, culverts, removed hazardous roadway debris, made repairs to paved and gravel roadways, addressed river embankments/dangerous conditions to the public and made repairs to emergency response vehicles that were damaged during the Incident Period . This Proposed Project addresses proactive work initiated by Weld County during FEMA-DR 4145 enabled the community to recover in an expeditious manner and increased the resilience of the community by incorporating nearly every aspect of sustainability and revitalizing the community . The community was able to recover quicker due to the proactive work done through this Proposed Project and the associated PW's . 14. This proposed project reduced the hazard risk to the community and increased resiliency by the work conducted through the PW's in correlation with FEMA-DR 4145 . Decision-Making Process: Describe the process you used to decide that this project is the best solution to the problem. Explain why this project is the best alternative you considered. Address questions such as: • Are you focusing on the area in your community that has the greatest potential for losses? • Have you considered the risks to critical facilities and structures and benefits to be obtained by mitigating this vulnerability? • Have you considered those areas or projects that present the greatest opportunities given the current situation(s) of interest in your community? • Are you addressing a symptom or the source of the problem? Addressing the source of the problem is a long-term solution which provides the most mitigation benefits. • If impacts to the environment, natural, cultural or historic resources have been identified, explain how your alternatives and proposed project address, minimize, or avoid these impacts. The Site locations within the two WELCO PW's in the Proposed Project were identified due to the high dollar amount of funds that were expended by Weld County to ensure the safety of the community and also restore county infrastructure back to its pre-disaster condition . This Proposed Project has site locations across the entire community and service area and it was determined that a large percentage of the LMI population was impacted by the severe flooding incident and the proactive work by County Officials enabled the community to recover quicker, thus allowing the community to sustain resiliency and return operations to normal . 2. Weld County's total 2015 budget is $307 ,031 , 089 . The impact of the September, 2013 flooding has primary been on the damage to the county's road and bridge system . The damage has resulted in Weld County having to transfer $5 million from the Contingency Fund to the Public Works Fund in 2013 and in 2014 for a total of $ 10 million dollars . Without assistance from FEMA, FWHA, and CDBG the amount would have several million more. The impact has also forced the county to shift local resources from projects unrelated to flooding to deal with the emergency situations created by the flood in both the 2013 and 2014 fiscal years . Even in 2015 5he county still using local resources to recover from the flooding . Fortunately, Weld County has always been fiscally conservative and budgeted responsibly . The aftermath of the flood waters resulted in the deposition of large quantities of sediment. fallen trees and infrastructure wreckage from improved public and private infrastructure along the natural stream channels. Such deposition resulted in the narrowing of loss of floodplain drainage pathways and blockages at bridges and culverts. The State and FEMA have advised the County that procurement of services must be in conformance with requirements noted in CFR Part 13. 36. Removal of flood related hazards from streams has the potential to affect federally listed threatened and endangered (T&E) species and their habitat. In order to avoid and minimize potential impacts applicants should implement conservation measures provided by USFWS to the extent possible. Conservation measures include. but are not limited to: locate access routes, staging areas. etc. within previously disturbed areas: avoid disturbing or burying any existing riparian (streamside) habitat: restore any disturbed areas using native riparian plant species to prevent erosion. integrate native vegetation into rip rap slope protection. avoid fragmenting or isolating riparian corridors or wetlands, and identify areas of ground disturbance and conservation measures implemented. RIGHTS OF ENTRY ON PRIVATE PROPERTY: The County must secure permission from the private property owners to remove hazards from streams which flow through the private property. When removing debris from private property or entering private property to remove hazards. in addition to the general assertions of corporate indemnification of FEMA from the County: the County must also secure indemnification of FEMA from the private property owners. Changes in Scope: The applicant must notify the state if there are any changes in the SOW prior to starting the repairs. Failure to notify the State Division of Emergency Services may jeopardize receipt of federal funds. RECORD RETENTION: Complete records and cost documents for all approved work must be maintained for at least 3 years from the date the last project was completed or from the date final payment was received, whichever is later. Applicant is responsible for retention of all documentation associated with this project. The State and FEMA have advised the County that procurement of services must be in conformance with requirements noted in CFR Part 13.36. The water continued to rise over the course of several days with new and worsening flooding in several areas, making additional time and effort from staff a necessity. Damage Description and Dimensions: At the peak of flooding, Weld had 60 impacted paved roads and bridges, and over 100 impacted gravel roads & culverts. Flood waters covered these roads and bridges making them unsafe for travel: damages were uncertain. As flood waters passed peaks at the western edge of the county. reconnaissance for road and bridge damages started on each of the named major drainages (Boulder Creek. Big Dry Creek. St. Vrain Creek. Little Thompson. Big Thompson. Poudre River and the Platte). Each of these rivers peaked in succession following the northward moving rainstorms in the mountains. Morgan (downstream of Weld County). Many damaged areas remained inaccessible for another week delaying repairs and road re-opening. Due to the severe flooding. power lines were down and citizens were forced out of their homes due to flooding or the threat of flooding. PROCUREMENT: The applicant is required to adhere to State and Federal Government Procurement rules and regulations and maintain adequate records to support the basis for all purchasing of goods and materials and contracting services for projects approved under the Public Assistance program, as stated in 44 CFR 13.36. The applicant has advised they have/will follow their normal procurement procedures. PA-08-CO-4145-PW-01001 (0): Work Completed The applicant used force account labor, equipment, materials. contract services and rental equipment to place barricades and cones on roads that had been flooded. direct traffic and pump water from flooded areas. Applicant activated its Emergency Operations Center on a 24 x 7 basis from 9/12/2013 to 9/18/2013. All departments were responsible for providing staff and assisting with the EOC operation. Due to a power outage at the South Weld Sub Station Shelter, the Applicant requested St. Vrain School District to open an alternate Shelter on September 12. 2013. Mead High School located at 12750 County Road 7. Longmont. CO. (40. 18589, -104.99834). was used for an alternate Shelter starting on September 12. 2013 at 5:30am until September 17. 2013 at 2:30pm. While the Shelter was open over 200 evacuees and numerous pets stayed at the Shelter. See attached St. Vrains School District letter that describes the events in detail. Also find an attachment with backup documentation for all of the costs claimed for the Shelter. Three Weld County gravel roads (CR38 at location 40.26266. -104.97774, CR44 at location 40.30571 , -104.88685 & CR50 at location 40.34893, -104. Scope of Work: 94349) had to be used for detours until flooding receded or damage roads were repaired. Due to increased heavy traffic the roads had to be hardened with Magnesium Chloride (The Weld County code for this product is - DAM1GMCO and WATGIE) to prevent continual damage and increased maintenance. See attached spread sheets from the Applicant for force account labor. equipment and materials. LONGITUDE: 40.451188 104.697884 PA-08-CO-4145-PW-01001 (0) GPS Coordinates From Weld County Offices DAMAGE DESCRIPTION AND DIMENSIONS PA-08-CO-4145-PW-01001 (0) During the incident period of September 11th to September 30th, 2013. severe storms and heavy rain caused flooding, landslides and mudslides throughout Weld County that required emergency response measures in order to protect public health and safety. Weld had 60 impacted paved roads and bridges. and over 100 impacted gravel roads & culverts. Flood waters covered these roads and bridges making them unsafe for travel, damages were uncertain. As flood waters passed peaks at the western edge of the county. reconnaissance for road and bridge damages started on each of the named major drainages (Boulder Creek. Big Dry Creek. St. Vrain Creek, Little Thompson. Big Thompson. Poudre River and the Platte). Each of these rivers peaked in succession following the northward moving rainstorms in the mountains. As flows from each of these tributaries combined. the St. Vrain peaked at Platteville on September 14, the Platte peaked on September 13 at Fort Lupton and on September 15 at Ft. Morgan (downstream of Weld County). Many damaged areas remained inaccessible for another week delaying repairs and road re-opening. Due to the severe flooding power lines were down and citizens were forced out of their homes due to flooding or the threat of flooding. PROCUREMENT The applicant is required to adhere to State and Federal Government Procurement rules and regulations and maintain adequate records to support the basis for all purchasing of goods and materials and contracting services for projects approved under the Public Assistance program. as stated in 44 CFR 13.36. The applicant has advised they have/will follow their normal procurement procedures. SCOPE OF WORK PA-08-CO-4145-PW-01001 (0) Work Completed The applicant used force account labor equipment, materials, contract services and rental equipment to place barricades and cones on roads that had been flooded. direct traffic and pump water from flooded areas. Applicant activated its Emergency Operations Center on a 24 x 7 basis from 9/12/2013 to 9/18/2013. All departments were responsible for providing staff and assisting with the EOC operation. Due to a power outage at the South Weld Sub Station Shelter. the Applicant requested St. Vrain School District to open an alternate Shelter on September 12, 2013. Mead High School located at 12750 County Road 7. Longmont. CO. (40. 18589. -104.99834). was used for an alternate Shelter starting on September 12, 2013 at 5.30am until September 17, 2013 at 2 30pm. While the Shelter was open over 200 evacuees and numerous pets stayed at the Shelter. See attached St. Vrains School District letter that describes the events in detail. Also find an attachment with backup documentation for all of the costs claimed for the Shelter. Three Weld County gravel roads (CR38 at location 40.26266. -104.97774. CR44 at location 40.30571 . -104.88685 & CR50 at location 40.34893, - 104. 94349) had to be used for detours until flooding receded or damage roads were repaired. Due to increased heavy traffic the roads had to be hardened with Magnesium Chloride (The Weld County code for this product is - DAM1GMCO and WATGIE) to prevent continual damage and increased maintenance. See attached spread sheets from the Applicant for force account labor equipment and materials. Labor = $187.700.64 Material = $22.573.02 Rental Equipment = $9.015.00 Contract = $39.379.67 Road Detour Repair CR38 = $8.. 140.59 CR44 = $15,620.00 CR50 = $9.244.70 Sub Total = $33,005.29 Total cost = $291 ,673.62 Labor costs were taken out of the Road Detour Repair costs due to work was completed during regular time hours. At the time the project worksheet was written the Applicant was not able to furnish an invoice for the road detour materials. Invoice will be required at close out. See attached force account material, contract and rental equipment summary with backup documentation. There will be three spread sheets attached that show A. The breach resulted in diversion of a major portion of the creek's floodwaters at high velocity across private property owned by Armestad Ranch and a second parcel owned by Asphalt Services Corporation operating as Turnpike Aggregate and Mines (599 State Highway 52. Erie. CO). The rapidly flowing floodwaters eroded a channel across the referenced properties up to 150ft wide and 10ft deep. After crossing Asphalt Services' property, the floodwater impacted and breached critical infrastructure. including 150ft Damage Description and width of the southerly. 35ft wide embankment of the City of Erie's 40 acre Dimensions: North Water Reclamation Facility reservoir. Floodwaters filled the reservoir and overtopped the facility's northerly embankment. This raised concern regarding stability of the northerly embankment. which if it failed. would result in release of 40 acres water at an average depth of over 10ft. A sudden release of such a quantity of water would represent an immediate threat to public safety and improved public and private properties in the vicinity of the reservoir. The purpose of this PW is to address sufficient work to plug the breach, thus reducing the immediate threat to the City of Erie's 40 acre North Water Reclamation Facility reservoir and downstream improved public and private properties. This PW does not address repair of Erie's reservoir. nor does it address restoration of eroded private property other than replacing a sufficient quantity of material to plug the breach (estimated at 170ft L x average 125.2 ft W x 10ft D = 7.884cy x 1 .4tons/cy = 11 , 037tons - discrepancies due to rounding). Finally. this PW does not address restoration of the unimproved and unmaintained stream bank to its pre-disaster condition. WORK COMPLETED: A Weld County Commissioner visited the site during the flood and determined the breach and subsequent threat to improved public and private property. including the City of Erie's North Water Reclamation Facility Reservoir. had created an emergency situation requiring immediate emergency protective measures. The Commissioner concluded that a complete breach on the overflowing north side of the Reservoir would create a major Weld County catastrophe. and that water from that breach would have flooded downstream improved private and public property (See photos attachment 9). The Commissioner authorized Asphalt Services to mobilize their adjacent labor and equipment to take necessary action to close the breach in the stream bank. The Commissioner determined that it would it would be more expedient to address the threat in this manner, since Weld County's labor and equipment was committed in various locations, county-wide. The Commissioner obligated the County to pay the cost of the work on a time and materials basis. since the nature of the threat did not allow for a delay to obtain competitive proposals. There was no formal contract created for contract service repairs made on private property. Contractor received a verbal communication to proceed from a Weld County Commissioner on a time and materials basis. While the emergency protective measures extended beyond 70 hours. the in-place cost of materials appears to be reasonable. when compared to CDOT cost of in- place fill materials. The applicant indicated that prior to this work Weld County did not have a contractual relationship with the contractor service provider Asphalt Services (See attachment 7 / Boulder Creek Determination). This Time and Material Contract was performed from 9/21 through 9/27/13. The work was conducted on property belonging to Armstead Ranch only. no construction or restoration occurred on Asphalt Services property. Documentation Retention: Pursuant to 44 CFR 13.42. Grantees and Sub-grantees are required to retain records. including source documentation. to support expenditures/costs incurred against the grant award. for 3 years from the date of submission to FEMA of the final Financial Status Report letter. Scope of Work: Permits: Due to the emergency nature of the repairs and the decision to proceed at the site without delay the applicant was unable to obtain permits from any agency for the scope of work. The breach resulted in diversion of a major portion of the creek's floodwaters at high velocity across private property owned by Armestad Ranch and a second parcel owned by Asphalt Services Corporation operating as Turnpike Aggregate and Mines (599 State Highway 52, Erie. CO). The rapidly flowing floodwaters eroded a channel across the referenced properties up to 150ft wide and 10ft deep. After crossing Asphalt Services' property. the floodwater impacted and breached critical infrastructure. including 150ft width of the southerly. 35ft wide embankment of the City of Erie's 40 acre North Water Reclamation Facility reservoir. Floodwaters filled the reservoir and overtopped the facility's northerly embankment. This raised concern regarding stability of the northerly embankment. which if it failed. would result in release of 40 acres water at an average depth of over 10ft. A sudden release of such a quantity of water would represent an immediate threat to public safety and improved public and private properties in the vicinity of the reservoir. The purpose of this PW is to address sufficient work to plug the breach. thus reducing the immediate threat to the City of Erie's 40 acre North Water Reclamation Facility reservoir and downstream improved public and private properties. This PW does not address repair of Erie's reservoir, nor does it address restoration of eroded private property other than replacing a sufficient quantity of material to plug the breach (estimated at 170ft L x average 125.2 ft W x 10ft D = 7.884cy x 1 .4tons/cy = 11 ,037tons - discrepancies due to rounding). Finally. this PW does not address restoration of the unimproved and unmaintained stream bank to its pre-disaster condition. SCOPE OF WORK: Current Version: WORK COMPLETED' A Weld County Commissioner visited the site during the flood and determined the breach and subsequent threat to improved public and private property. including the City of Erie's North Water Reclamation Facility Reservoir, had created an emergency situation requiring immediate emergency protective measures. The Commissioner concluded that a complete breach on the overflowing north side of the Reservoir would create a major Weld County catastrophe. and that water from that breach would have flooded downstream improved private and public property (See photos attachment 9). The Commissioner authorized Asphalt Services to mobilize their adjacent labor and equipment to take necessary action to close the breach in the stream bank. The Commissioner determined that it would it would be more expedient to address the threat in this manner, since Weld County's labor and equipment was committed in various locations, county-wide. The Commissioner obligated the County to pay the cost of the work on a time and materials basis. since the nature of the threat did not allow for a delay to obtain competitive proposals. Project Notes Procurement: Applicant has indicated. county official directed the contractor to perform work on an emergency basis. making the decision to make repairs on site at time damages were occurring. There was no formal contract created for contract service repairs made on private property. Contractor received a verbal communication to proceed from a Weld County Commissioner on a time and materials basis. While the emergency protective measures extended beyond 70 hours, the in-place cost of materials appears to be reasonable, when compared to CDOT cost of in-place fill materials. The applicant indicated that prior to this work Weld County did not have a contractual relationship with the contractor service provider Asphalt Services (See attachment 7 / Boulder Creek Determination). This Time and Material Contract was performed from 9/21 through 9/27/13. The work was conducted on property belonging to Armstead Ranch only. no construction or restoration occurred on Asphalt Services property. Documentation Retention. Pursuant to 44 CFR 13.42. Direct Administrative Costs The subgrantee is requesting direct administrative costs that are directly chargeable to this specific project. Associated eligible work is related to administration of the PA project only and in accordance with 44 CFR 13.22.
