Any time there is an issue to confront, we have been able to resolve our differences amongst ourselves. But this last year has been one of extreme frustration, annoyance, nuisance and of safety issues that we have not been able to resolve. And this is seemingly due to the indifference on the part of the Carillo's and even perhaps Weld County. Someone asked me recently why I never lodged a formal complaint and my response was that I really did not think it would change anything. The Carillo's have been in violation for a year now and complaints have been filed by other neighbors. Yet for some strange reason, beyond what I can fathom, Weld County has allowed M & E to continue to operate their business in non-compliance regardless of the impact that it has on their neighbors. Even since the unanimous decision by the planning commission on March 3, 2015 the Carillo's have obviously done very little in the way of attempting to make amends with their neighbors, or by cleaning up the property, or changing the way they have been doing business. EXHIBIT ) L,Q 1.t Interestingly enough even before the planning commission's decision, neither the Carillo's or their lawyer attempted to make any concessions, peace offerings or offer to discuss what could make for better relationships. This is a huge red flag that sends a signal that M&E will continue to operate their business with a single focus on themselves. I would now like to focus attention on the "Use by Special Review Questionnair Answers" that was filed with Weld County by the Carillo's. Even by just glancing at the first page it is obvious that the Carillo's have gone so far as to go against their own proposals. On the first page is listed "2 small trailers", "1 small backhoe", and "15 regular sized pickups". I have photos from yesterday that show a flatbed fifth wheel trailer that is at least 18 feet long parked by a large backhoe. As well as two large box trucks that had been there for probably a couple weeks at least up until today. There is nothing mentioned in the proposal about these box trucks. And as was testified to in the last meeting, the pickups mentioned are far from regular sized. But in fact are large 250, 350 duallies with equipment on the back. As was brought up in the last meeting, there are eyewitnesses to the fact that M&E maintains pickups and other equipment including washing, painting and oil changes. It is clearly stated that this will not occur in the second paragraph, second page. Although complaints were lodged about this issue, when Weld County inspectors came and found none of this happening at the time of inspection, the complaint was dropped. Commissioners, the decision you will make today, will affect each one of the neighbors represented here, EVERYDAY for as long as we continue to live to the west of 3600 49th Street. As I stated earlier, many of us are self-employed and forfeited time in which we could have been working and making an income to attend the previous commission meeting and this one as well in hopes that our lives will no longer be disrupted by a family who believes they are entitled to move in and do business in violation of the laws and regardless of the hardship it causes others. I hope you understand the sacrifices we have made to attend the each one of the meetings, and that you will then see how very important it is to have peace restored to our neighborhood. Questions: Carillo's have been in business since 2003, yet their lawyer states they were unaware of the need to obtain a permit to conduct business. How can someone be in business for nearly 12 years and be clueless to the laws? Where did they park vehicles and equipment prior to purchasing 3600 49th Street? Are they in violation at another property? When an inspector came in response to complaint of painting did he look for evidence of painting equipment? Or just in hopes to catch them in the act? I have counted in early morning 15 pickups, sometimes 2 or 3 big trucks, backhoe, 25 to 30 cars. I have seen them dismount sleeper cabs off of big trucks and replace them, welding, grinding, painting, changing tires wheels, relining brakes, and lots of noise. With regards to case number USR14-0074 we would like to express our concerns. First and foremost at no fault of the applicants we fault the realator that promoted this property as a place for a business as the promotional flier stated, "Bring your semi" . The public needs to be more diligent when purchasing a property such as this by researching the exisiting zoning regualtions. We have lived less than a mile from this property for the lat 30 years and we drive past this property multiple times a day. This is not the first buyer in this area nor will it be the last that sees our existing zoning as an attractive alternative to combing the current residential/agricultural zoning to include a commercial business so they may get "bang for their buck" . As Mr. Carillo answered himself to the Weld County Planning Commission on March 3rd when asked why he bought that property when it was not zoned for a business such as his he answered, "Cheap" . Just because there are a very LIMITED amount of commercial uses in this area we need to stress that this is the exception and not the rule as we are not an industrial park. Our concerns with the current USR application are as outlined below: 1 . The odd shape and size of the lot is not adequate for the level of activity that this commercial business constitutes. It has one point of entry and exit acess listed even though they also currently utilize an opening on the north east corner of the property. 2 . The legal counsel for the applicant has not been accurate in their representation of the commercial activites. In cover letter dated October 20, 2014 addressed to the City of Evans Public Works Department it is stated that use is to be for "limited commercial acitivities" . It is stated that 15 small pickup trucks are to be parked on the site. We do not consider l0gty 3/4 ton and 5 qty one ton pick ups to be "small" pickups in addition to the various array of other equipmenht on site to include but not limited of semi tractors and body parts for semi tractors, dump trucks, and a tractor backhoe. We do not consider this as "limited" . 3 . We have witnessed the maintenance of vehicles at this site as well as the painting of various semi truck parts and welding which to our 03-18-15;08: 18AM;From: To' 19705080802 # 2/ 2 understanding is not approved nor being applied for under USR14-0074 . 4 . There is a walking path that sits directly to the south of the property. If the USR is approved we ask that quality fencing be required around the "entire" perimeter of where the property is. There was a fence there when the path was built and the Carillo' s felt entitled to take it down so that they could access the easement ground which as discouraged people from using the path. 5 . The surrounding properties (the property that was referred to that is directly south that is used for the same purpose) that have similar uses have more land available along with buildings to store the equipment. Again these properties are the exception and not the rule. People move to this area to live a quality country life that is close to the city and not to have to battle cases such as this. 6 . 20 to 30 emplyees parking their vehicles is an excessive amount considering the small size of the lot. This will only add to the already heavily traveled 49th Street and South 35th Avenue. Not to mention another 15 employees that are proposed to be employed at the site. The portable bathroom facilites are mentioned twice in the special review questionaire and yet where are they located? Where are they using bathroom facilites currently?? 7. Our concern for the water feature are that it is next to the walking path and we would like to know if they will be required to participate in some sort of insect control if there is standing water for the comfort of the few neighbors that they do have as well as the walkers that utilize the path. As it is currently it is unsitely and this is not the place for a commercial business to commence due to the small and odd size of the lot not to mention the location at an already busy intersection. We also want to note that they removed the sign that was required to be posted through today after the meeting with the planning commission advising the public of this hearing. Let it be noted that Mr & Mrs Carillo do not even live at this residence and that they also have another property that is out of compliance for the same reasons. I touched base with Lyle Achziger and he recommended I contact you by email. The people who purchased the property adjacent to the intersection, Enrique and Myrna Carillo, are parking approximately 30 employees cars plus equipment, semi's, generators and other equipment/tools on the 1 acre property. With that much traffic entering and leaving the property, I feel it is a very dangerous entrance/exit that close to the 3 way stop sign. As more traffic will happen once the new junior high school on 65 th ave opens, it will be that much worse. Drivers drive really fast on 49 th Street. The neighbors and I attended a Planning Commission Hearing on March 3 and the Commission found the Carillo's in violation of the zoning for that property. The Planning Commission had numerous complaint letters on the situation plus 7 neighbors were there from 1:30 PM to 6 PM to hear the case. We will next be at the County Commissioner's Meeting on March 18 th at 10 AM. Please advise if there are any rules/regulations on traffic commercial entering and leaving a property that close to an intersection. Also, I live at 4220 49 th Street and as I travel east to the stop sign, many times I see their vehicles not STOP at the stop sign when they are headed south. If they don't see a car sitting at the sign, they roll on through the intersection without stopping. The property has become an eyesore for all of the neighbors in the area who want to keep up their property values. This small property that they obtained on the corner of 35th Ave and 49th Street is not the place to have a business of this type. That corner has become congested in the mornings as 25-35 vehicles are pulling into that small acreage and large "service trucks" and dump trucks make their way in and out as well. Every time I pass by this property there is junk piled up on the lot. I see trash blowing around. Usually they are changing oil in trucks, welding etc... I see no protective screens set up to shield the welding arc from the people driving past. They have also torn down the fencing on the walking trail. A trail that I frequent in the mornings. As I understand it,that easement was given to the City of Evans. But now there are trucks parked on it, sometimes right up to the trail where I have to walk around them.This is not an industrial area that this company has moved into. It's zoned agricultural and all of the small acreages take pride in having that. Being able to have animals,grow gardens and enjoy the ground they have bought. Not too long ago I attended a hearing on behalf of a neighbor. We were asking if he could park one truck/trailer at his house. That request was denied. I fail to see how M&E can park numerous vehicles of the same type on their property not more than a mile away. Everyone has a right to make money and work. I just ask that it be done by the same rules that everyone else has to follow.
