Sorry Chris, one other point, Encana does not agree to amend the existing access to the "Proposed Shared Access"
requested in the application. The Proposed Shared Access does not appear to have been properly planned nor designed
for the purposes that Encana would need, specifically oil and water hauling and the possibility of additional drilling Rig
activity. Encana has not agreed to changing the proposed access and would request that the board require Silicon to
work with Encana to amending all points of the access, SUA, and their application prior to board approval.

Hi Chris,
The Silicon Ranch plans do in fact conflict with the existing surface use agreement on the Lands and Encana requests
Silicon work with us to amend the surface use agreement prior to approval of the USR. I have attached the existing
surface use agreement Exhibit A (which Silicon's attorneys have been provided) for your reference. As you can see
proposed USR would conflict with the surface use area permitted in the surface use agreement (red Wellsite area).
In June Encana was contacted by the attorneys representing Silicon Ranch to discuss amending the surface use
agreement. I agreed to discuss the possibility of an amendment with them . I have not heard from Silicon or their
attorneys concerning this amendment since June.

Below is an email I sent to Silicon Ranch's legal department detailing the status of the ongoing negotiations with Silicon
Ranch on an Amended Surface Damage and Release Agreement for the Land near Mead they are requesting a USR on. I
assume you received my other 2 emails from last Monday and they will be considered by the Board of Commissioners
during the meeting this evening? I will keep you appraised of the negotiations with Silicon.
Tomorrow can you please provide me a brief summary of the outcome of the meeting tonight? (or forward any
notes/minutes that come from the meeting)

Hi Kevin,
Encana is in the process of reviewing the Amendment to the surface use agreement. At initial look I do not foresee any
major obstacles preventing us from working with Silicon Ranch in achieving a mutually agreeable Amendment, but until
our legal department has sufficient time for review I will not know for sure. I would anticipate having a redline
Amendment back to you later this week or early next. Additionally, I still have concerns with the access road that has
been proposed and how Encana would have access to their existing equipment and wellheads along with access to any
future wells and wellsite. I think it would be important for us to work on a solution that would hopefully achieve both
parties goals. At this time Encana is not in favor of what was initially proposed.
I will get back to you as soon as I get a response from my legal department with their redline changes.
