Accept Request to Withdraw Application for Change of Zone, COZ25-0007, from the
A (Agricultural) Zone District to the 1-2 (Medium Industrial) Zone District —

Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
Whereas, the Board of County Commissioners held a public hearing on the 10th day of
December, 2025, at the hour of 10:00 a.m., in the Chambers of the Board, for the purpose
of hearing the application of Dustin Gartrell, 31156 County Road 50, Kersey, Colorado
80644, for Change of Zone, COZ25-0007, from the A (Agricultural) Zone District to the
1-2 (Medium Industrial) Zone District on the following described real estate, to-wit:
Lot A of Recorded Exemption, RECX18-0069; being part of the NW1/4 of
Section 5, Township 4 North, Range 63 West of the 6th P.M., Weld County,
Colorado
Whereas, at said hearing, the Board was presented with an email, received on
November 25, 2025, from the applicant's representative, requesting the withdrawal of the
application, due to the passage of Ordinance #2025-11, which will allow him to apply for
a Zoning Permit for Certain Uses in the Agricultural Zone District (ZPAG), and
Whereas, the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and all of the exhibits and evidence
presented in this matter, and having been fully informed, deems it advisable to grant the
applicant's request and thereby accept the withdrawal of the application.
Now, therefore, be it resolved by the Board of County Commissioners of Weld County,
Colorado, that the request of Dustin Gartrell to withdraw the application for Change of
Zone, COZ25-0007, from the A (Agricultural) Zone District to the 1-2 (Medium Industrial)
Zone District, on the parcel of land described above, be, and hereby is, accepted, and the
matter be, and hereby is, dismissed.

The Board of County Commissioners of Weld County, Colorado, approved the above
and foregoing Resolution, on motion duly made and seconded, by the following vote on

Ordinance 2025-11 was approved yesterday. As you'll see in the ordinance, you can now apply for a ZPAG permit for a
trucking company with up to 15 commercial vehicles.

If you'd like, please submit your withdrawal request for COZ25-0007 in writing (email is fine) so that the Clerk to the Board
can put it into the record.
