Moved by Benjamin Hansford , that the following resolution be introduced for passage by the Weld County
Planning Commission . Be it resolved by the Weld County Planning Commission that the application for:

Sec . 27-2- 180 . - Urban development nodes .
A site location of concentrated urban development located within a one-quarter-mile radius of the
intersection of two (2 ) or more roads in the state highway system as defined in Chapter 22 of this Code and
Urban Growth Boundary Map #1 , the most recent copy of which is on file at the Clerk to the Board 's office and
the Department of Planning Services.

Sec . 27 8 30. Amendment to a PUD Zone District.
These procedures are contained in Article V of this Chapter.
Sec . 27- 8-430 . - Changes to a PUD Zone Districts and final plan .
A . Amendments. Any request to make a major change to an approved PUD zone district and/or final plan
shall be processed as a new application for a PUD zone district and/or final plan under Article VII of this
Chapter. This may include , but not be limited to requests for vacating all or parts of an approved PUD
zone district and/or final plan for the purpose of major redesign or major corrections. The Department of
Planning Services may waive application requirements which do not pertain to the proposed major
change to the PUD zone district and/or final plan .
B . Minor Modifications . The Department of Planning Services may approve a minor modification to a
PUD zone district and/or final plan . The applicant shall prove that the minor modification is required by
engineering or other circumstances not foreseen during the approval of the PUD or to remove the
building envelopes from the PUD zone district and/or final plan . The Department of Planning Services
shall not approve a minor modification if that modification does not conform to the original intent of the
PUD Zone District.
C . Applicability. All proposed amendments and minor modifications to an approved PUD zone district
and/or final plan shall be subject to the procedures stated in this Chapter and current land use
regulations . The PUD Zone District shall be subject to the requirements contained in this Chapter, and in
Chapter 23 , Articles IV and V, of this Code .
D . Corrections . The Board of County Commissioners may , without a hearing or compliance with any of
the submission , referral or review requirements of the PUD zone district and/or final plan regulations ,
approve a correction to the PUD zone district and/or final plan if the sole purpose of such correction is to
correct one ( 1 ) or more technical errors in an approved PUD zone district and/or final plan and where
such correction is consistent with its approved PUD Zone District. Notice of the meeting at which the
Board will consider approval of the corrections shall be sent to the PUD homeowners' association (if one
exists) at least ten ( 10) days prior to the meeting .

RATIONALE FOR MODIFICATION :
This code change would allow the Department of Planning Services to approve minor
modifications to the change of zone plats, for example the removal of building envelopes.

Commissioner Stille said that because he has some familiarity with the water system around Carr, he
feels that compatibility with the land use citing Section 23-2-220 . A. 3 that area is over the top of a huge
non -tributary closed basin aquifer. He added that he is also concerned with the effluents to the Spring
Creek and Lone Tree Creek .

adopt the DFIRM maps as the basis for floodplain regulation for Weld County .

design standards regarding signs for Use by Special Review permits , and criteria for subdivision

proposed code change allowing the Department of Planning Services Staff to approve minor
modifications to the change of zone plats , such as the removal of building envelopes . Additionally , this
proposed code change would allow developments within the Urban Development Nodes to develop
through USR ' s , SPR ' s , or Change of Zone requests

Tom Parko , Planning Services , presented Ordinance 2015- 15 and provided a brief outline of the
Coordinated Planning Agreement with the Town of Windsor.
Commissioner Wailes asked if this agreement will have any bearing on any planning cases that are
currently underway . Mr. Parko replied no .

Coordinated Planning Agreement with the Town of Severance .
