Explain, in detail, the proposed use of the property. BJ Hot Oil is an oilfield Service company that has been located on the site for eleven years. They have used the site to park seven hot oil trucks and personal vehicles for six employees. There are also two small sheds that are used to store pump parts and other miscellaneous items. A 2,000 gallon fuel tank, 250 gallon methanol tank and a 300 gallon diesel exhaust fuel tote are stored on the site. The office for this business is not located on-site. No washing of trucks or oil changes are done on-site. All maintenance beyond very minor issues will be done off-site. 2 . Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan. The proposal is consistent with following sections of the Weld County Comprehensive Plan: A. Policy 7.2. Conversion of agricultural land to nonurban residential, commercial and industrial uses should be accommodated when the subject site is in an area that can support such development, and should attempt to be compatible with the region. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. Section 23-S allows for any use permitted as a use by right, an accessory use, or a Use by Special Review in the commercial or industrial zone districts, provided that the property is not a Lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of any regulations controlling subdivisions, to be located in the agricultural district upon approval of a Use by Special Review permit. 4. What type of uses surround the site? Explain how the proposed use is consistent and compatible with surrounding land uses. The surrounding properties are agricultural with homes in close proximity to the west and south. The existing residences to the south is largely screened from the parking by the residence on the site. Screening of the parking area from the home to the west is complicated by the location of the oil and gas structures on the site. The business has been in close proximity to these homes for the last eleven years without any complaints. 5.a. Number of people who will use this site Up to 6 truck drivers will park on the lot. The site also has an existing home which is being rented by one individual not associated with the business. 5. b. How many employees are proposed to be employed at this site. Upto6 5.c. Hours of operation. Normally employees arrive at the site at 6:30 a.m. and return around 5:00 p.m. Employees do not stay on site. On rare occasions a driver may pick up his truck as early as 5:00 a.m. and return as late as 10:00 p.m. The applicant is requesting operating 24 hours per day, 7 days per week, 365 days per year given that the extended hours will have little, if any, impact on the surrounding property owners. 5.d. Type and number of structures to be erected (built) on this site. No additional buildings are being proposed. Building and electrical permits for the sheds and electrical service have been finalized with Weld County Building Inspection. Hill Petroleum is obtaining the applicable State permits for the fuel tanks. The building permits for the fuel area will be obtained upon approval of the State permits. There will be no signage or lighting on the site. 5.e. Type and number of animals, if any, to be on this site. No animals will be housed on the portion of the site used to park trucks. The existing home may at some point in the future wish to have a pet or farm animal in accordance with Weld County Code. 5.f. Kind of vehicles (type, size, weight) that will access this site and how often. The vehicles on-site include 7 hot oil trucks, 6 employee's personal vehicles and 1 tractor and box blade. The occupant of the home also has personal vehicles which are stored along the fence line. Six of the hot oil trucks are 40 1/2 feet bobtail units. The seventh truck is a semi with trailer frac heater that is 63 feet long. The bobtail units are picked up by their drivers in the morning and return at the end of their work day. The seventh larger truck is rarely moved from the site. Last year it only left twice. When in use, it will be stored off site for months at a time During the colder months propane, which is used in the trucks, will be delivered daily. In warmer weather the propane is delivered weekly. Fuel is typically delivered weekly. Traffic and parking areas have been covered with road base. Traffic from the site is approximately 85% traveling west on CR 40 to Highway 85, 5% traveling east, 10% traveling south and none traveling north along County Road 31 . Two accesses currently exist to the site along CR 40. The western access will be designated an entrance and the eastern access will be designated an exit. A preliminary agreement with Anadarko Petroleum Corporation indicating they will share the two access points has been included. 5.g. Who will provide fire protection to the site. Gilcrest Fire Protection District. 5.h. Water source on the property (both domestic and irrigation). Central Weld County Water District serves the existing home. No water is needed for the business. 5. 1 . Sewage disposal system on the property (existing and proposed). The existing residence is appropriately permitted under # SP-9900142. A port-a-let will serve the drivers. 5j. If storage or warehousing is proposed what type of items will be stored. Two small storage sheds are used to store pump parts, approximately 8 gallons of motor oil in case an engine is low, and miscellaneous business equipment. 6. Explain the proposed landscaping for the site. No additional screening or landscaping is proposed. 7. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. The trucks and fuel tanks will be removed. 8. Explain how the storm water drainage will be handled on the site. The site slopes to the northeast where stormwater will be captured. Water quality feature calculations have been included. See the attached drainage information. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. Construction of the drainage area will commence upon approval of the USR. Construction of the fuel storage area will begin upon approval of the USR, State of Colorado Fuel Storage Permits and Building Permits. 10. Explain where storage and/or stockpile of wastes will occur on this site. A trash can is pieced within one of the two sheds. Any larger items will be taken directly to a landfill. The dumpster adjacent to the residence is not used by the business. A Waste Handling Plan has been included with the application. All storage beyond the fuel storage will be within the two storage sheds. 11 . Please list all proposed on-site and off-site improvements associated with the use (example: landscaping, fencing, drainage, turn lanes, etc.) and a timeline of when you will have each one of the improvements completed. Storage area for the fuel tanks will begin immediately upon approval of the USR and State of Colorado permits. Digging of the drainage area will commence immediately upon approval of the USR. It is hoped that all work will be done before the end of summer. Dust Abatement Plan The site is accessed from County Road 40 which has been treated with magnesium chloride. Road base covers all traffic areas on the site. Dust should not be a factor. However, should surrounding property owners complain about dust and the complaint is verified by Weld County staff, dust will be controlled by reducing the speed of vehicles. Waste Handling Plan 1 ) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). The only waste on site would be trash from employee vehicles and empty motor oil, antifreeze and W-D 40 containers. 2) A list of the type and volume of chemicals expected to be stored on site. 6 gallons of motor oil 4 gallons of antifreeze 4 cans W-D 40 2-55 gallon drums of EB506 Pro Treat 2000 gallons fuel 250 gallons methanol 300 gallon diesel exhaust fuel 3) The waste handler and facility where the waste will be disposed (including the facility name address, and phone number. The trash accumulated on the site is placed in a trash can within one of the sheds. The small amount collected does not warrant trash service. The trash can is taken home by Josh Pearson and placed with his trash for pick-up. WITNESSETH: Whereas, Anadarko operates, accesses and/or owns their respective wells, pipelines, gathering systems, easements, rights-of-way and other interests in real property and Anadarko accesses its interests by the use of approximately 25 feet of the facility turn around road (hereinafter referred to as "Road"), as identified and shown on the map attached hereto as Exhibit "A" and made a part hereof. Whereas, Anadarko and Surface Owner desire to enter into an Agreement for the joint use of the Road for the Surface Owner and the Tenant; Therefore, for and in consideration of the premises contained herein, Anadarko and Surface Owner hereto agree that, as Road users, they will be subject to the following terms and conditions: 1 . The surface width of the road shall remain at its existing approximate width of 25 feet plus additional frontages for the construction of shoulders and ditches. No widening or narrowing of the road shall be done without the mutual consent of the Parties. The Road will be finished to an all weather surface. Road work will be performed in conformity with all applicable Surface Use Agreements, Access Agreements, Easements, Rights-of-Way, Temporary Use Permits or such other agreements as may govern the various Parties' rights to use the Road. 2. All Parties shall use the Road with due regard for the rights of others. Their continued use of the Road shall not interfere or impair the road use of any other Party to the Agreement. 3. Anadarko shall be responsible for such construction, repair and maintenance of the Road. In the event that an act of God shall render the Road unsafe, unusable or impassable, Anadarko shall be authorized, without written authorization, to undertake the necessary steps to restore the Road to the approximate same condition and usage prior to the occurrence and neither Surface Owner or Tenant shall use the Road during this time. 4. Expenses for repairs of abnormal damage caused by Anadarko, the Surface Owner, or tenant's negligent acts or use of the Road shall be borne one hundred percent (100%) by the Party causing such negligent acts. Further the negligent Party agrees to indemnify the non-negligent Party against all claims, liabilities, fines, alleged or otherwise, including reasonable attorney fees as a result of such negligent acts or willful misconduct. 5. Should any of the Parties have safety concerns regarding the Road, that party shall present those safety concerns to the other for the review and acceptance by the other Party and collectively shall remedy those concerns. 6. Where either Party desires to terminate its participation in this Agreement and no "Successor Party" assumes the terminating Party's interest, the terminating Party shall provide a sixty (60) day written notice of termination to the other Party. 7. Neither Party warrants or represents the operational condition of the Road. Each Party hereto shall exercise its privileges under this Agreement at its own risk and shall hold the other Party harmless, and hereby releases and indemnifies the other Party from any and all liability for damages and expenses resulting from use of the Road, except damages resulting from gross negligence or willful misconduct. 8. The Parties shall meet quarterly to discuss continuing maintenance plans for the Road. 9. Unless otherwise terminated pursuant to paragraph 6, this Agreement shall remain in force for an initial term of one (1 ) year. At the end of the one (1 ) year term, this Agreement will automatically be extended for an additional one (1 ) year and shall be extended thereafter from year to year with the mutual written consent of the Parties. 10. Each Party shall pay its or their own expenses incident to the preparation, execution or performance of this Agreement. 11 . It is understood and agreed that the construction and interpretation of this Agreement shall at all times and in all respects be governed by the laws of the State of Colorado. In addition, all parties hereto agree that proper jurisdiction and venue in any actions brought on by this Agreement shall be in Weld County, Colorado. 12. All rights, privileges and obligations created in this Agreement shall inure to the benefit of and be binding upon each Party's respective contractors, representatives, agents, successors, assigns and/or heirs. Each Party shall have the right to assign its interest(s) in this Agreement in whole or in part so long as assignee adopts and ratifies the Agreement and provides the other with written notice and documentation of their ownership within thirty (30) days of execution of the assignment. 2 13 . This Agreement is relative to the Road only. No variations, modifications or changes hereof shall be binding hereto unless set forth in writing and agreed to by the Parties.
