RE: APPROVAL OF VACATION OF THAT PORTION OF 2ND STREET LYING
NORTH OF THE UNION PACIFIC RAILROAD RIGHT-OF-WAY AND SOUTH
OF VACATED 7TH AVENUE IN THE TOWN OF GILL, COUNTY OF WELD,
STATE OF COLORADO.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a representative of the Weld County Department of
Engineering Services has informed the Board of County Commissioners
of the request of Nick and Sally Martinez through their repre-
sentative Dean Peter, to vacate that portion of 2nd Street
lying North of the Union Pacific Railroad Right-of-Way and South
of vacated 7th Avenue in the Town of Gill, County of Weld, State
of Colorado, and
WHEREAS, the Department of Engineering Services has made
a complete study of the request and the existing problem, and
finds that the portion of 2nd Street mentioned above has never
been used for a street and that no property would be landlocked
if the vacation is to be granted, and
WHEREAS, as a result of its study, the Department of
Engineering Services does recommend granting of Nick and Sally
Martinez ' s request, and
WHEREAS, after considering the recommendation of the Weld
County Department of Engineering Services, the Board of County
Commissioners of Weld County, Colorado has determined that it
would be in the best interest of all concerned to vacate that
portion of 2nd Street lying North of the Union Pacific Railroad
Right-of-Way and South of vacated 7th Avenue in the Town of Gill,
County of Weld, State of Colorado.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the aforementioned
vacation of that portion of 2nd Street in Gill, Colorado, be, and
hereby is, approved.
The above and foregoing Resolution was, on motion duly made

Dear Mr. Olson:
On behalf of Nick and Sally Martinez, who we
represented in the recent sale of the property described
as Lot 12, Block 2, Town of Gill, I would like to
request of the County Commissioners that that portion
of 2nd Street of the Town of Gill lying North of the
Union Pacific Railroad right of way and South of
Vacated 7th Avenue be vacated.
The land in question has been used by the adjacent
land owners for many years, apparently in the belief
that they had legal right to do so. As you can tell
from the enclosed survey, a small part of the home in
Block 12 actually encroaches on 2nd Street. Since
7th Avenue has been previously vacated, no potential
exists for land locking other property owners.
It appears that vacating this parcel would be
beneficial to the two adjacent landowners and
detrimental to no one.
Your consideration will be very much appreciated.
