ORDINANCE NO. 7
RE: IN THE MATTER OF AUTHORIZATION TO PAY FROM THE COUNTY CON-
TINGENT FUND, THE SUM OF FIFTEEN THOUSAND DOLLARS ($15 ,000 . 00)
FOR THE PURPOSE OF SETTLING TWO SEPARATE CIVIL ACTIONS IN-
VOLVING WELD COUNTY, COLORADO.
BE IT ORDAINED by the Board of County Commissioners of Weld
County, Colorado, pursuant to Colorado statute and the Weld County
Home Rule Charter, being vested with the authority of administering

the affairs of Weld County, Colorado, and,
WHEREAS, on the 2nd day of March, 1977, the Board of County
F- Commissioners of Weld County, Colorado authorized the Weld County
Attorney and Special Counsel to settle two separate law suits for

the total sum of FIFTEEN THOUSAND DOLLARS ($15,000 .00) , which law-
suits were Civil Action No. 22846 pending in the District Court of
Weld County, Colorado, in which Clyde O. Bennetts is plaintiff,
and Weld County, Colorado is the defendant, and Civil Action No.
23948 now pending in the District Court of Weld County, Colorado
in which William F. Almer, et al. , are plaintiffs and Weld County,
Colorado is defendant, and
WHEREAS, the Weld County Attorney and Special Counsel have
advised the County Commissioners that they have now concluded all
negotiations, and are prepared to enter into a settlement agree-
ment settling both actions which involve thirty-one separate
plaintiffs, for the total sum of $15 ,000. 00 .
BE IT THEREFORE ORDAINED by the Board of County Commissioners,
that Weld County pay forthwith, the sum of FIFTEEN THOUSAND DOLLARS
($15, 000. 00) in full settlement of the abovementioned law suits ,
and that said sum of $15 ,000 . 00 be paid from the Weld County Con-
tingency Fund.
BE IT FURTHER ORDAINED by the Board of County Commissioners
of Weld County, Colorado, that an emergency exists which requires
that this Ordinance be enacted forthwith, and therefore, this
Ordinance is declared to be an emergency ordinance under the pro-
visions of Section 3-14 of the Weld County Home Rule Charter.

The above and foregoing Ordinance No. 7 was, on motion duly
made and seconded, adopted by the following vote on the 6th day
of April, A.D. , 1977.
