A public hearing was conducted on October 26. 2016. at 10:00 a.m.. with the following present:

The following business was transacted:
a I hereby certify that pursuant to a notice dated September 20. 2016, and duly published
September 23, 2016. in the Greeley Tribune. a public hearing was conducted to consider the
request of Alliance Investment Group — Ft. Lupton. LLC, c/o Discovery DJ Services, LLC. for a
Site Specific Development Plan and Use by Special Review Permit. USR16-0031, for Mineral
Resource Development Facilities, Oil and Gas Support and Service, including, but not limited to, a
Natural Gas Processing Facility for the processing of natural gas products, related equipment and
structures, metering equipment for the custody transfer of gas. natural gas liquids (NGLS) and
condensate; transloading. outdoor equipment and materials storage yard and more than one (1)
cargo (Conex) container in the A (Agricultural) Zone District. Bob Choate. Assistant County
Attorney, made this a matter of record.
Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and
stated the site location in relation to relevant County roads and the three (3) mile referral area of
the Cities of Fort Lupton and Brighton, and Towns of Hudson and Lochbuie, and the Coordinated
Planning Agreement Area of the City of Fort Lupton which submitted verification in two (2) referrals
that the applicant has discussed the potential for annexation but prefers to continue the
application with Weld County at this time, thereby meeting the requirements to meet with the City

of Fort Lupton. He stated the other municipalities did not respond in the referral process. Mr. Ogle
described the site and adjacent properties to include the nearest residence and explained this
application is a part of a joint venture between Discovery Mystery and Partners. LLC. and Ward
Petroleum. He stated the proposed gas plant will receive wet natural gas from regional gathering
lines via a new pipeline pending approval of application USR16-0028. Mr. Ogle reviewed the
proposed daily operations. hours of operation, and stated that 18 referrals were sent out with
seven (7) referrals received offering comments. He reported no correspondence was received
prior to Planning Commission: however, staff did receive one (1) letter from a surrounding
property owner prior to today's hearing citing concerns regarding noise and light. He displayed
images and entered the favorable recommendation of the Planning Commission into the record
as written.
P Evan Pinkham, Department of Public Works. stated access to the site has been approved
via County Road (CR) 35 and utilizing Access Permit. AP16-00371. He provided average daily
traffic counts and stated the traffic narrative that was submitted indicated 13 daily round trips. He
reviewed the proposed haul route and stated neither tracking control nor an Improvements
Agreement are being required at this time.

Hayley Balzano. Planning Services Engineer representative. presented the drainage and
grading requirements related to the Conditions of Approval and Development Standards.
Ben Frissell. Department of Public Health and Environment. reviewed the water and sewer
provisions stating the applicant has proposed to permit and install a commercial well and septic
system. He reported Development Standards (DS) #5-19 address typical Environmental Health
items.
Cory Jordan, applicant. presented a PowerPoint presentation with an overview of the
management team experience. company background and track record of development,
engineering and owning and operating crude gathering and transportation systems in several
locations. He provided an asset overview to include Texas, Louisiana. Adams County and Weld
County. Mr. Jordan explained the project is for a Gas Plant that will include inlet liquids handling,
inlet compression, gas processing, NGL storage and transfer, residue gas compression and
enclosed combustion unit with a multiple central delivery point and pipelines to minimize impact.
He reviewed the neighborhood meeting that took place on June 7. 2016. resulting in no concerns.
and explained the site selection location is in the northwest corner of the property to further
mitigate impacts to surrounding property owners.
No public testimony was offered concerning this matter.
In response to Commissioner Cozad, Mr. Jordan stated they will have compressor units
inside the buildings to mitigate noise, and tanks are connected to VRU Units to prevent emissions
and odor. He further verified they have met with the Fire District and, per their request, are
installing tanks to hold water for the fire department.

In response to Commissioner Cozad, Andy Siegfried, Zion Engineering, stated they are
providing the engineering and design for this project and they did meet with the Fire District and
will complete the project in phases. He clarified the requirement for the first phase is one (1)
50,000 barrel water tank on -site for the fire department to access in the event of an emergency
and at full buildout there will be a second identical tank added. He verified the plan has been
reviewed by the Fire Marshall and the access meets the requirement for the Fire District as well.
In response to Commissioner Moreno, Mr. Jordan explained the number of employees per
shift.

In response to Commissioner Kirkmeyer. Mr. Jordan verified a sound survey will be
completed. Mr. Frissell clarified the noise limit is residential and limited to 50 and 55 decibels. In
further response. Mr. Siegfried described the lighting for the site and stated four (4) compressors
will be on -site. each enclosed in an insulated building. He further described the location for the
tank farm to start with four (4) tanks and at full buildout it will increase to a total of eight (8) tanks.

In response to Chair Freeman, Mr. Jordan indicated no concerns with the Conditions of
Approval or Development Standards.
Commissioner Cozad recommended removing the words. -of approval." in Condition of
Approval (COA) #1.A. The Board decided to remove the second sentence. She further
recommended deleting COA #1.B.15. The Board agreed. Commissioner Kirkmeyer suggested a
change to the first two (2) sentences of DS #28 to read, "Sources of light shall be shielded so that
light rays will not shine directly onto adjacent properties. Sources of light should not cause a
nuisance or interfere with the use on the adjacent properties in accordance with the plan."
Commissioner Conway mentioned the neighborhood meeting.
Jeff Brewster, Construction Manager. reviewed the results of the neighborhood meeting and
the letter received from a surrounding property owner (SPO) and clarified that individual did not
attend the meeting: however. he personally called and spoke to him and there were no issues
regarding lights or noise but the SPO was inquiring if the applicant was interested in purchasing
their property and Mr. Brewster stated he responded not at the present time.
Commissioner Kirkmeyer clarified her reasoning for the suggested change due to the
amount of light being the problem and it needs to be addressed in general. Commissioner Cozad
interjected there was a letter received from an SPO with concerns related to light.
In response to Chair Freeman, Alliance Investment Group — Ft. Lupton, LLC, c/o Discovery
DJ Services. LLC, indicated they have reviewed. and agree to abide by, the Conditions of
Approval and Development Standards, as amended.
Commissioner Cozad moved to approve the request of Alliance Investment Group —
Ft. Lupton. LLC. c/o Discovery DJ Services. LLC. for a Site Specific Development Plan and Use

custody transfer of gas, natural gas liquids (NGLS) and condensate: transloading. outdoor
equipment and materials storage yard and more than one (1) cargo (Conex) container in the
A (Agricultural) Zone District. based on the recommendations of Planning staff and the Planning
Commission, with the Conditions of Approval and Development Standards as amended and
entered into the record. The motion was seconded by Commissioner Conway, and it carried
unanimously. There being no further discussion. the hearing was completed at 10:31 a.m.
This Certification was approved on the 31st day of October, 2016.
