HomeMy WebLinkAbout20163372.tiffHEARING CERTIFICATION DOCKET NO. 2016-93 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR16-0033, FOR ANY USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE, OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS (STORAGE OF ELECTRICAL EQUIPMENT IN AN EXISTING BUILDING, ALONG WITH AN OFFICE AND PARKING AND STAGING OF COMMERCIAL VEHICLES ASSOCIATED WITH THE ELECTRICAL BUSINESS) PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICULTURAL) ZONE DISTRICT - HOLLIS REVARD A public hearing was conducted on November 9, 2016, at 10:00 a.m.. with the following present: Commissioner Mike Freeman, Chair Commissioner Sean P. Conway. Pro-Tem Commissioner Julie A. Cozad Commissioner Barbara Kirkmeyer Commissioner Steve Moreno Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative, Chris Gathman Public Works Department representative, Evan Pinkham Planning Services Engineer representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: hereby certify that pursuant to a notice dated September 30, 2016, and duly published October 5. 2016, in the Greeley Tribune, a public hearing was conducted to consider the request of Hollis Revard, for a Site Specific Development Plan and Use by Special Review Permit, USR16-0033, for any Use permitted as a Use by Right, Accessory Use. or Use by Special Review in the Commercial or Industrial Zone Districts (storage of electrical equipment in an existing building, along with an office and parking and staging of commercial vehicles associated with the electrical business) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. Chris Gathman, Department of Planning Services. presented a brief summary of the proposal and explained the intent to store equipment and share an access with the existing residence. He stated the applicant is intending to have up to ten (10) employees and the application stated that up to two (2) trucks will access the site each day and up to three (3) trailers will be parked at the site when not at the job site. He included the hours of operation and clarified the applicant is not intending to do any improvements or make any changes to the property. Mr. Gathman reviewed ?Lt Pe ,E A l�- 27a -t(, 2016-3372 PL2450 HEARING CERTIFICATION - HOLLIS REVARD (USR16-0033) PAGE 2 the closest residences and adjacent properties and stated impacts will be minimal as most of the storage will be inside the existing building. He stated the closest neighbor has met with the applicant and expressed his concerns, which have been addressed. Mr. Gathman stated the site is located within the three (3) mile referral area of the City of Greeley. which submitted a referral with recommendations that have been taken into consideration. He stated 15 referrals were sent out, six (6) provided comments and five (5) were received with no comments. He displayed images and entered the favorable recommendation of the Planning Commission into the record as written. In response to Commissioner Kirkmeyer, Mr. Gathman stated he will forward the referral for the City of Greeley. In response to Commissioner Cozad, Mr. Gathman stated he will clarify the details surrounding the natural drainage ditch. 2 Evan Pinkham, Department of Public Works representative. provided a brief overview of the transportation plans and requirements, and stated an Access Permit, AP16-00453. has been approved utilizing the access off of County Road (CR) 41. He provided the average daily traffic counts for CR 41 and stated a traffic narrative was included with the application materials and there will be no tracking control or Improvements Agreement required. ER Hayley Balzano, Planning Services Engineer representative, presented the drainage and grading requirements. L Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions. stating the existing home and shop are served by the North Weld County Water District and a septic system that is permitted and was reviewed to be adequate for the house and up to six (6) full-time day workers. She stated a portable toilet is acceptable and that Development Standards (DS) #8-16 address typical Environmental Health items. Hollis Revard, applicant, stated she had nothing to add to the presentation. No public testimony was offered concerning this matter. a. In response to Commissioner Cozad, Mr. Gathman stated he emailed the referral to the Board. After further review. the Board agreed to remove Condition of Approval (COA) #1.A, and 1.B. In response to Commissioner Kirkmeyer, Ms. Revard stated there is no new map yet and that the lighting has been in existence for several years. The Board agreed to delete COA #1.C.5. In response to Commissioner Kirkmeyer, Mr. Gathman clarified the Eaton Ditch is designated as a FEMA floodplain area. Commissioner Cozad asked for clarification regarding the hours of operation. After further discussion, the Board agreed to delete DS #5. Commissioner Cozad suggested deleting the first three (3) sentences and adding the clarification of "existing septic system" in DS #14. The Board agreed. She further suggested deleting the parenthetical reference to St. Vrain Creek Floodplain from DS #22. Commissioner Kirkmeyer recommended deleting DS #24. The Board accepted these changes. Commissioner Conway suggested an amendment to the findings under 2.D in relation to the referral recommendations from the City of Greeley. The Board agreed to remove the last two (2) sentences. Q In response to Chair Freeman. Ms. Revard indicated she has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as amended. 2016-3372 PL2450 HEARING CERTIFICATION - HOLLIS REVARD (USR16-0033) PAGE 3 ra Commissioner Moreno moved to approve the request of Hollis Revard, for a Site Specific Development Plan and Use by Special Review Permit, USR16-0033, for any Use permitted as a Use by Right. Accessory Use. or Use by Special Review in the Commercial or Industrial Zone Districts (storage of electrical equipment in an existing building, along with an office and parking and staging of commercial vehicles associated with the electrical business) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. There being no further discussion, the hearing was completed at 10:31 a.m. This Certification was approved on the 14th day of November, 2016.
