RE: APPROVAL OF RECORDED EXEMPTION NO. 330 - MR. AND MRS. DOUGLAS
UYEMURA
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 14th day of August, 1978 in the Chambers of the Board of County
Commissioners of Weld County, Colorado that the property of
Mr. and Mrs. Douglas Uyemura, described as Lot 1, Etherton' s Sub-
division, a subdivision located in the West Half, Northeast Quarter,
Northeast Quarter of Section 16 , Township 5 North, Range 65 West of
the 6th P.M. , Weld County, Colorado, being more particularly described
as follows :
Beginning at the Northeast Quarter of Etherton's
Subdivision; said point being 665.40 feet westerly
of the Northeast Corner of Section 16, Township 5
North, Range 65 West, of the 6th P.M. Thence,
considering the North Line of said Se..Lion 16 to
hoar North 90°00'00" W, and with all other
bearings contained herein being relative thereto,
westerly along said section line a distance of
302.7 feet:
Thence S 00°03'00" E, a distance of 30.00 feet to
the Northwest Corner of lot 1, Etherton's Subdivision.
Thence S 00°03'00" E, a distance of 294.00 feet;
Thence S 90°00'00" E, a distance of 157.00 feet to
the True Point of Beginning
Thence S 90°00'00" E, a distance of 155.53 feet to the
Fast line of said Lot 1;
Thence S 00°01'17" E, along the East line of said
Lot 1, a distance of 140.00 feet;

Said tract of land contains 0.500 Acres more or less
together with a 60 foot access easement running
parallel to and immediately to the South of the

does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and

WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, 1973 , as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owned by Mr. and Mrs. Douglas Uyemura, be and hereby,
is exempt from the definition of the terms "subdivision" and
"subdivided land" pursuant to its authority under Section 30-28-
101 (10) (d) , CRS, 1973, as amended.
The above and foregoing Resoluticn was, on motion duly made
and seconded, adopted by the following vote on the 14th day of
August, A.D. , 1978.

Dear Commissioners:
The attached application, plat and related items are in reference
to a request by Mr. & Mrs. Douglas Uyemura for a recorded exemp-
tion. The parcel of land on which this request has been made is
described as Lot 1 , Etherton ' s Subdivision, a subdivision located
in the W NE*NE* Section 16, T5N, R65W of the 6th P.M. , Weld
County, Colorado. This property is located at the southeast
corner of the intersection of Bluebell Avenue and East 20th Street .
The property contains 4. 38 acres of Estate Zoned property. The
request is to split the property into parcels of . 500 and 3. 88
acres.
The Uyemuras desire to build a residence on the . 500 acre parcel .
The 3. 88 acre parcel has an existing residential use and improve-
ments located on it .
Based upon the information submitted and the adopted policies in
the County, the Department of Planning Services Staff recommends
the request be approved for the following reasons :
1 . The proposed split conforms with the Recorded Exemption intent
clause and the Weld County Comprehensive Plan. The City of
Greeley Comprehensive Plan Future Land Use Map identifies the
property in question as low and medium density residential uses .
The proposed use on the property would be compatible with sur-
rounding land uses.
2. The 4 acre plus parcel is part of an existing platted subdivision
which has low utility for agricultural use due to the amount of
acreage and the intent for residential development which the
County Estate Zone allows.

RECOMMENDAT ION
August 11 , 1978
3 . On August 10, 1978, the Weld County Board of Adjustment
granted a variance from the requirements of Section 9-4 A. (3 )
of the Weld County Subdivision Regulations, therefore, this
request complies with the provisions of Section 9-4 A. of
the Weld County Subdivision Regulations.
It should be noted that the Greeley Planning Commission has recom-
mended denial on this request . They expressed no concern for the
creation of an additional residential lot ; however, the proposed
private access easement does not conform to the Greeley Subdivision
Regulations which require that the access to a public street be,
in itself , open to the public. The Greeley Planning Commission
did recommend a street dedication as opposed to the private access.
Such a street could then serve the platting of additional lots. A
copy of the City of Greeley Planning Commission letter is enclosed
in the attached packet .

Dear Mr & Mrs Uyemura:
Millie Turner, Environmental Health Specialist, Division of Environmental
Health Services, inspected the property (Lot 1, Etherton Sub. ; Wz, NE',
NE;, 5-16, T5N, R65W) on which you wish to build a house with associated
sewage disposal system. No problems were noted at the time of inspection
with respect to the area suitability for an individual sewage disposal
system. However, our division has experienced problems with excessive
percolation rates in the East 20th Street area in the past. Also, as
stated to Ms. Turner, you wish to retain as much irrigated pasture as
possible. This situation may raise the groundwater level to such a
depth as to make installation of a conventional system not possible
by our regulations.
If you have any further questions, please do not hesitate to contact this
office.

6) Special Use Permit (Geisert)
On August 8 , 1978 the Greeley Planning Commission reviewed and
made the following recommendations :
1) Rezoning "E" to "C" (Bliss) - -The Commission recommended denial
, of the rezoning and suggested that City and County staffs meet
to provide some overall guidance to development along 18th Street.
The Commission noted the following concerns :
(a) inadequate public improvements (water, fire , sewer , street) ,
(b) lack of interior street and secondary access , (c) inadequate
use buffers and site development controls , and (d) non-confor-
mance with Comprehensive Plan which suggests commercial activity
clustered near First Avenue and the cemetary.
2) Rezoning "E" to "C" (Bernhardt) - -The Commission recommended denial
on the same grounds as the Bliss rezoning .
3) Recorded Exemption (Hertzke) - -The Commission recommended no
objection . It was requested that the applicant work with the
Highway Department to ensure adequate dedication for a widened
10th Street .
4) Recorded Exemption (Uyemura) --The Commission recommended denial . .
They expressed no concern forthe creation of an additional
residential lots, however, private access easements do not conform

to Greelex Subdivision Resulations which reQuirethat the access
to a public street he in itself o2en to the public : A streets
dedication is recommended. Such a street could then serve the
platting of additional lots .
5) Recorded Exemption (McDonald) - -The Commission recommended no
objections . The Highway Department has recommended consolida-
tion of access to a single driveway serving both parcels .
6) Special Use Permit , Mining (Geisert) - -The Commission recommended
no objections to the proposed mining operation . Staff expressed
concern for adverse impacts of flood water diversion onto City
property. The Commission expressed interest in encouraging a
reclamation compatible with ultimate Island Grove Park development .
