SUBJECT: Probable Cause Hearing for MUSR14-0030- A Minor Amendment to a Site Specific Development Pan
and Use by Special Review Permit No. USR-1704 (solid waste disposal site and facility including Class it composting,
an animal waste recycling or processing facility (an anaerobic digester -based renewable energy plant (gas)) along
with a concrete batch plant to be used for construction of the facility) for the addition of a Digester Process
Sy tee and a 7U -foot flare in the A (Agricultural) Zone District.
MUSR14-0030 Development Standard #17 states: The facility shall operate in compliance with applicable
Colorado Air Quality Control trop Regulations tfons and comply with any permits /ts issued by the Fir ! o lu ion Control Division.
USR 14-0030 Development Standard #21 states: /n accordance with the Colorado Air Quality Control
Commissions Regulation Number 2, odor detected off site shall not exceed the lever of seven -to -one (7:1) dilution
threshold,
M U R I4MO3O Development Standard #44 states: The property owner or operator shun be responsible for
complying with ►il of the foregoing Development Standards. Noncompliance with any of the foregoing
Development Standards may be reason for revocation of the Permit by the Board of County Commissioners.

U -1704 - A Site Specific Development Plan and a Special Review Permit for a
soli'd waste disposal site and facility (including Class I composting), an animal
waste recycling or processing facility (an anaerobic digester -based renewable
energy plant (gas)) along with a concrete batch plant to be used for construction
of the facility in the A (Agricultural) Zone District approved by the Board of
County Commissioners.
USR-1704 approved with odor standard: In accordance with the
Colorado Air Quality control Commission Regulation Number 2, odor
detected off of the site shall not exceed the level of seven -to -one (71)
dilution threshold.
Feb. 25, 2013 Changes to Site Layout of USR-1704 approved by the Board of County
Commissioners changes included changing from 6 lined ponds (1 storm
water pond and 5 addition process ponds) to 3 lined ponds (2 storm
water ponds, 1 settling basin, 1 covered digester lagoon), and changing
the digester design from 24 rectangular, in ground covered digester pits
to 5 above ground digester tanks approximately 0 -feet in height,

District approved by the Director of the Department of Planning Services.

A total of 91 odor complaints logged/received. Of the odor measurements taken -
the facility exceeded to the 7:1 odor threshold on one (1) occasion — 4/27/2016,
Letter mailed via certified rna it to owner/applicant re: 7/1120/6 probable cause hearing..
Probable Cause Hearing — finding of Show Cause — Show Cause Hearing scheduled for
9/19/2016
July 12 —Sept. 14 A total of 175 odor complaints logged/received. No instances of facility exceeding the 7:1
2016 odor threshold during this period.

Sec. 23-2-270. - Develoament standards.
An applicant for a Special Review Fermat shall demonstrate conformance with
and shall continue to meet any DEVELOPMENT STANDARDS approved and
adopted by the County. The DEVELOPMENT STANDARDS shill be olaced on the
Special Review Permit Plan Map prior to recording. Noncompliance with any of
the approved DEVELOPMENT STANDARDS may be reason for revocation or
suspension of the special review permit by the Board of County Commissioners.
Civil penalties in heu of a suspension may also be imposed with the express
prior agreement of the applicant. The availability of these remedies in no way
limits the Board of County Commissioners from seeking or applying any other
remedies which are available for noncompliance with the development
standards.
Section 2-4-40,O i Weld County Code: Where the Board is considering the revocation or suspension
of a permit or license, including but not limited to uses by special review and permits issued under
Chapter 21, but specifically excluding liquor licenses, the Board shall consider evidence and
statements in mitigation and in aggravation of the violation prior to determining the appropriate
penalty. Such evidence and statements may relate to and include, but not be limited to, the following:
• The compliance history of the party against whom the complaint was made with respect to the permit at issue or other County -issued
permits.
Good faith efforts on behalf of the person against whom the complaint is made to comply.
Duration of the violation.
• Economic benefit of noncompliance to the person against whom the complaint is made.
Impact on, or threat to, the pubihc health or welfare or the environment as a result of the violation.
• Malfeasance.
• Whether legal and factual theories were advanced for purposes of delay.
▪ in addition to the factors set forth in this Subsection, the following circumstances shall be considered as grounds for reducing or
eliminating penalties:
• The voluntary and complete disclosure by the person against whom the complaint is made of such violation in a timely fashion after
discovery of the noncompliance.
▪ Full and prompt cooperation by the person against whom the complaint is made following disclosure of the violation, including, when
appropriate, entering into a legally enforceable commitment to undertake compliance and remedial efforts.
• The existence and scope of a regularized and comprehensive environmental compliance program or an environmental audit program.
• Substantial economic impact of a penalty on the violator.
• Other mitigating factors.

Due to a work conflict. I am unable to attend the Show of Cause Hearing for Heartland on
Monday. I would love to be there but hope all of my neighbors come in full
force. Regardless, I still wanted to voice my concerns.
Quick Summary:
I live off of CR40and CR 51
Health: The health of my family is the top concern. Specifically my kiddo who hadn't
used an inhaler in years but needs it now when he is outside at our house. However, he
doesn't need the inhaler at school or other locations which is very concerning. The
Impact of our animals is concerning, as well_

Well Being: I can't leave my windows open and my kids often times won't want to be
outside due to smell. And these are country kids that are use to all kinds of smell but the
smell we all are enduring is simply horrendous. We live in the country so that we can
enjoy the outdoors and keep very active. Yet, we are limited due to the smell and health
concerns, When I take my kids to the bus top, they always complain about the smell and
often times ask to sit in the car to wait.
Resale of my home: I can almost guarantee that Heartland Executives wouldn't buy my
home because they wouldn't want to live near the stench. I would be terrified to show my
home to a possible homebuyer on any day due to knowing the smell would be noticeable.
I have lived near feed lots and the smell is less than what is emitted from the Heartland
plant.
Lack of Transparency: From the beginning, Heartland's team should have been more
transparent to citizens Their lack of transparency makes it hard to trust anything they are
telling us Their motives also make me questions the health and safety of the workers in
their plant I can't help but think their only concern is profit and not the health/well being
of their neighbors and workers.
I work for local government. It is our duty to do our best to keep our citizens safe, healthy
and ensure their voices are being heard. Therefore, I am hopeful the Weld County
Commissioners will speak up and protect all of us citizens that are being negatively
impacted by the Heartland Plant.

enddosed, and the produced biogas is typically contained, stored and utilized. However,
there may be some slight odors from feedstocks and other sources. These odors may be
more evident it the biogas system is constructed in an area not used to livestock
production, Because the AD system reduces the odor in the effluent, the net effect for
livestock facilities is anticipated to be a reduction in odor. AD facilities have been built in
the U.S. for the prime reason of effective odor reduction.

Probably for YOU it is a good morning, we are sure you all had a full night's sleep. 1 any sure
for Heartland, it is a FANTASTIC morning too!
For my husband and I, it was ANOTHER night of interrupted sleep when the horrific odor
engulfed our home early in the morning! My health is so bad this morning it is
unbelievable....but I a.m sure that is NO care or concern to you all...with the exception of
Commissioner Kirkmeyer.
Once again the Big Business wins in Weld County and the citizen that elected YOU into office
lose! After all you don't want to shut a business down... even if they are affecting awhole entire
community and our lives
Enjoy your day, we will be trying to work a full 8 hours at our jobs while we try to get over a
severe headache from the stench and I try to bring my blood sugars down and while we try to
manage once again on less than 5 hours sleep.

In reviewing our notes and information given to the community by Jason Thomas, Heartland Plant Manager, we
would like to emphasize information that was told to us at the very first Heartland Community Meeting which
was held on -11-16 in Kersey at the Fire Station.

Jason told all of us there (approx. 25-30 community neighbors) that there are FIVE (5) potential odor sources
where they believe the odor is coming from; just in case this has not been reviled to you in any of the past 2
hearings, we feel it is important you know this. As Heartland is only addressing only TWO (2) of these BYE
(5) potential odor sources to potentially be fixed by 6-30-17; that will leave this community THREE (3) more
odor sources to fix AFTER 6-30-17.....looks like they are going to be allowed to drag this horror out for us
residents for many years...
Below are links to some of the media outlets that have run the story since the 9-19-16r Show of Cause
Hearing....we find it interesting that the one on the top of the list is from Colorado Springs, a town that is
trucking their smelly trash up to Weld County for 'green' recycling another fine reputation Weld County
has obtained thanks to this plant! Weld County has not only made the news in Colorado but also in Alabama,
Texas, Kansas, Washington DC, California, Idaho, Montana, Nevada, Oregon, Washington State & Virginia.
How very embarrassing for our County... good chance after the 11-14-16 meeting it will reach even further and
to multiple other statesL. Our opinion/feelings are if Heartland's feet were held to the fire they would `find' the
money and `clean' this mess up pretty darn fast and not continue to drag it out for years... The concept of the
`green' recycling to make methane gas is a good idea, the fact that they dragging their feet to fix the odor issues
tells us just what kind of morals they have.
Today, at our home the wind is blowing at least 30 miles an hour brining in that stench to our home...YES the
windows are closed tight. Our 4 year old granddaughter who is here with us today said to us, this smells worse
than Ryder's poop (Ryder is her puppy), sad that a 4 year old will remember her grandparents' house as a stinky
place because EVERY TIME she is at our home it STINKS!!!

The research I have conducted in preparation for the Show Cause hearing for Heartland strongly
supports there is only one possible resolution. In this search for data, I had requested the top
odor producing facilities throughout the state. The following data that I have obtained, while
disheartening as a neighbor, clearly demonstrates the sheer magnitude of the problem.
Please note; many of these facilities span several years. For example, the wastewater treatment
plant has had �3oo complaints in 12 years, which equates to about 25 per year. Also consider
that Heartlands complaints have only been in 11 months.
On a per year basis, Heartland Biogas has more than. 3 times the complaints than all of the
other top odor producing facilities across the entire state combined!!!! In fact, Heartland is
on track to have more complaints in 1 year than all of the other top odor producers in the
state combined for the last 12 years!
We need your help in protecting the rights and well-being of our community!
We cannot continue like this.

I am aware of the meeting taking place on November 14, 2016. Unfortunately, I am unable to attend but wanted
to address my thoughts in email to you.
I live on CR 38, exact address is 25101 CR 38, LaSalle, CO..exactly one mile east of CR 49/38.
I am unsure of all the details of how Heartland came about, etc.. we have only lived out here since January
2016. However, I do smell the odor from it much more daily and it is not welcoming at all. Especially in the
morning, when I have the windows open, it is pretty bad.
I do not know what is going to happen with it, or if anything can, but if you can somehow limit the odor, it
would be greatly appreciated!!

Good evening,
I woke up the past two weekends in a row to glorious fall mornings and couldn't wait to get outside to
get all my stock tanks ready for winter. Great country air territory! It would have been glorious but for
the fact there was NO clean country air! The acrid gas smell from Heartland made my work hard due
to poor air quality and burning eyes. My elderly parents live with me and can't breathe well with this
poor air quality. Heck neither can any of us in this area! I know you put off this hearing until 11/14 until
after the election. Sadly, I wish you hadn't.
This facility is at 40 percent production now and if they crank it up more, our already poor air quality
will be worse, When there is fog this black crap comes out of the stack at Heartland and hovers.

I, would be willing to let you park a trailer, stay over here for a couple days and walk a mile in our
shoes. I am sure Heartland would get a heads up and you wouldn't smell the "NEW" fresh country air
here. I dare any of you to do it and NOT give a heads up to the company. I assure you. at 3 am. you
will wake up to the worst smell you have ever encountered. Then stay the day! You will forever
appreciate your Greeley air. I remember Greeley's stinky days. The old packing plant put in filters and
this clang place needs to spend some money and do the same! We rely on you commissioners to
represent us. Please do it! Please stay out here for two day's unannounced and let your lungs enjoy
what we enjoy daily. Your group permitted this awful business and didn't listen to any of our
concerns. Now all our concerns are realized. Heartland sent our a flier to all of us stating that they
cannot promise there will be no odor. What the hell is that? If they can't control the odor, then they
need to shut down!
Heartland isn't taking any of this seriously as this horrible air is now a daily occurrence. I have
livestock and I purchase "Fly Predators" from Spaulding Labs in the Spring through the fall so I don't
have flies. It costs me about $700.00 a year. You can go to my barn and you won't find ANY
fly's. Since this horrid neighbor moved in, I now have fly strips in my house! Please, picture that in
your kitchen, it is so very attractive! When this business was permitted, we were told there would be
no cow crap left outside. That is a damn lie. The fly's just love it and reproduce with abandon!
Please help us with this and protect our quality of life! None of us purchased significant amounts of
landi built homes and expected to smell this. Anything that smells this bad is a health risk. 1 went to
college in Buffalo, New York. Our neighborhood now smells like Lackawanna, New York when the
steel mills were puffing out noxious gasses, not unlike what is happening here.
All of us want to know what this business is pumping into the air from the stacks at Heart
believe we all have the right to know what we are breathing.

EDF/Heartland Biogas plant, that some of you and previous County Commissioners allowed into our
neighborhood!!!

ONCE AGAIN we can't do work outside that is desperately needing done prior to winter!
Ken walked outside and the stench was SO BAD he almost vomited!!! Yes we live with this S`I E CH EVERY
DAY OF OUR LIVES! You still can't open windows and air out your home because you never know when it's
going to hit. It may come and go but it is horrid when it hits so you can't even take a chance of opening
window.
You ALL told EDF/Heartland Biogas at the July probable cause hearing you were going to hold their feet to the
fire and make them clean the air up... when is that going to happen 5 years from now, probably never!!!!
Per the community meeting held by EDF/Heartland Biogas in August, they have 5 (FIVE) potential odor
sources and they are ONLY addressing 2 (TWO) with the County.
This a weekend, there is NO rotten food being brought into that plant...so what is the stench from now, the
holding ponds or are they releasing gases into the air and they need scrubbers to stop the odor.. we don't know
but we are convinced EDF/Heartland Biogas does.
Now we are being told by some of you that the County will NOT shut them down because the County 'fears' a
lawsuit from EDF/Heartland Biogas....really what about all of us neighbors do we need to start holding bake
sales to earn money to hire a lawyer for us, we can't sell our homes NO ONE would want to live here ! ! !
It is TIME for ALL of you elected officials to stand up for the citizens of Weld County that elected YOU into
office and put a STOP to our nuisance neighbor, FD►F`Heartland Biogas, that YOU allowed into our community
and are STILL allowing here.
They need to FIX this odor issue and fix it NOW; YOU ALL need to hold them accountable to this, YOU
NEED to hold true to your word and hold their feet to the tire! Time to show that you all really do care about
the citizen of Weld County and not these big industrial businesses you are allowing to damage the lives and
health of Weld County citizens.

My name is Todd Amen, I live on County Road 38 and the corner County Road 49. I own Amen Oil Field
Services. I write this email in regards to the upcoming meeting on November 14, 2016.
I know how permits/policies/and county development works. In obtaining my USR Permit, I had hoops and
bounds to jump through before I could even begin production. There were stipulations and notifications
enforced on nee just to be able to run my company. I couldn't even put up a yard light, due to "light pollution"
against my neighbors and traffic along my road. It baffles me that I did not even receive a notice, a phone call,
or a letter regarding the Heartland Plant. The lights that Heartland puts in the dark of the night, the traffic that
Heartland puts on the roads, and the odor that Heartland puts out is inexcusable. The odor congregates in any
open door on my property, it is constant 24 hours a day, and does not let up.
I do believe that if Heartland was anything regarding the Oil Field, it would have been shut down already, with
no question. it is unfair to the citizens, who work hard every day, and who have made their homestead in the
country, to enjoy the air, the grass, and the benefits that country life gives you, to have to fight the constant odor

and light sore that Heartland has brought to us. I ask that you consider my email as the majority opinion and
