Chair Commissioner Sean P. Conway, Pro -Tern Commissioner Julie A. Cozad - EXCUSED Commissioner Barbara Kirkmeyer Commissioner Steve Moreno Also present: Acting Clerk to the Board. Tisa Juanicorena Assistant County Attorney. Bob Choate Planning Services Department representative. Diana Aungst Public Works Department representative, Evan Pinkham Planning Services Engineer representative, Hayley Brown Health Department representative, Lauren Light The following business was transacted: ,-=1 I hereby certify that pursuant to a notice dated May 27, 2016, and duly published June 1, 2016, in the Greeley Tribune, a public hearing was conducted to consider the request of Terry and Roberta Vider, for a Site Specific Development Plan and Use by Special Review Permit, USR16-0013. for a Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial and Industrial Zone Districts (build gates and fences) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. Bob Choate. Assistant County Attorney, made this a matter of record. V. Chair Freeman reviewed for the applicant and for the public, the procedures to follow should the case result in a tie vote due to four Commissioners being present and one Commissioner excused. Diana Aungst, Department of Planning Services, presented a brief summary of the proposal and stated 19 referrals were sent out and 15 agencies either did not respond or indicated no concerns. She reviewed the site location, the intent to establish a fence building business with no new structures, and stated adequate parking is provided. Ms. Aungst further reviewed the hours of operation. stated there is no signage or lighting proposed, and there is existing vegetation that C'A-. ?L,Pe,Eli, 2016-1969 PL2426 HEARING CERTIFICATION - TERRY AND ROBERTA VIDER (USR16-0013) PAGE 2 provides screening. She described the existing home and outbuildings not related to the business and stated the business will be performed in the Quonset hut on -site. Ms. Aungst reviewed the number of employees, floodplain stipulations. and adjacent land uses. She verified there have been no objections from surrounding property owners, and stated the site is located in the three (3) mile referral area of the Towns of Garden City and LaSalle, and the Cities of Evans and Greeley and she reviewed the referral responses. Ms. Aungst displayed images of the site and adjacent area and entered the favorable recommendation of the Planning Commission into the record as written. ,= Evan Pinkham, Department of Public Works representative, provided a brief overview of the transportation plans and requirements and stated an Access Permit has been approved, AP16-00144. He provided the average daily traffic counts on County Road (CR) 54 and reviewed the traffic narrative to include approximately four (4) daily round trips: therefore, no tracking control or Improvements Agreement will be required. Hayley Brown, Planning Services Engineer representative, presented the drainage and grading requirements and stated the applicant did submit a drainage narrative showing they will not increase the imperviousness of the site. She clarified the requirements to show interior traffic and parking areas on the map. to obtain a Weld County Grading Permit if they disturb more than one (1) acre. and they must maintain the historical flow patterns and runoffs on the site. Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions and stated the existing house is served by the Central Weld County Water District and there is a septic system sized to accommodate two (2) bedrooms: however, the house will not be used as part of the business. Therefore, use of a portable toilet is acceptable and a commercial septic system will be required if they surpass two (2) full time employees. She clarified there will be no chemicals or waste associated with the business and she stated Development Standards (DS) #13 through #20 address typical Environmental Health items. Roberta Vider, applicant, stated Ms. Aungst and the other staff have done a wonderful job and adequately described the project. 2.1 No public testimony was offered concerning this matter. In response to Commissioner Kirkmeyer, Ms. Vider agreed with increasing the hours of operation. Chair Freeman suggested deleting DS #4 regarding the hours of operation. The Board agreed. After further discussion. the Board offered to change the number of employees to six (6) with the understanding of the septic regulations. The applicant agreed. In response to Chair Freeman, Ms. Vider indicated no concerns with the Conditions of Approval and/or Development Standards and confirmed that they have reviewed. and agree to abide by. the Conditions of Approval and Development Standards. as amended. R Commissioner Conway moved to approve the request of Terry and Roberta Vider, for a Site Specific Development Plan and Use by Special Review Permit, USR16-0013, for a Use permitted 2016-1969 PL2426 HEARING CERTIFICATION - TERRY AND ROBERTA VIDER (USR16-0013) PAGE 3 as a Use by Right, Accessory Use, or Use by Special Review in the Commercial and Industrial Zone Districts (build gates and fences) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Moreno, and it carried unanimously. There being no further discussion, the hearing was completed at 10:42 a.m. This Certification was approved on the 6th day of July, 2016.
