RE: AUTHORIZE WORKMAN' S COMPENSATION INSURANCE COVERAGE FOR
VOLUNTEER SHERIFF' S DEPUTIES AND AUTHORIZE CHAIRMAN TO
SIGN INSURANCE FORM.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, Section 8-41-106 of the Workman' s Compensation Act
gives the governing body of a county the option of providing
workman' s compensation insurance coverage to volunteer police
officers, and
WHEREAS, it has been a customary practice to provide work-
man' s compensation insurance coverage to volunteer police officers,
and
WHEREAS, the Board considers the risk too great not to pro-
vide workman ' s compensation insurance coverage to Weld County
volunteer Sheriff' s Deputies.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that workman' s compensation
insurance coverage is hereby authorized for Weld County volunteer
Sheriff' s Deputies.
BE IT FURTHER RESOLVED by the Board that the Chairman of
the Board be, and hereby is, authorized to sign the attached
insurance form from the State Compensation Insurance Fund which
informs the insurance company of Weld County' s option to provide
coverage to Weld County volunteer Sheriff' s Deputies .
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 24th day of
January, A.D. , 1979.

8-41.106. Employee. (1) "Employee" means:
(a) (I) Every person in the service of the state, or of any
county, city, town, or irrigation, drainage, or school district
or any other taxing district therein, or of any public
institution or administrative board thereof under any appointment
or contract of hire, express or implied; and every elective
official of the state, or of any county, city, town, or
irrigation, drainage, or school district or any other taxing
district therein, or of any public institution or administrative
board thereof; and every member of the military forces of the
state of Colorado while engaged in active service on behalf of
the state under orders from competent authority. Policemen and
firemen who are regularly employed shall be deemed employees
within the meaning of this paragraph (a) , as shall also sheriffs
and deputy sheriffs, regularly employed, and all persons called
to serve upon any posse in pursuance of the provisions of section
30-10-516, C.P..S. 1973, during the period of their service upon
such posse, and all members of volunteer fire departments,
volunteer rescue teams or groups, volunteer disaster teams,
volunteer ambulance teams or groups, and volunteer search teams
in any county, city, town, municipality, or legally organized
fire protection district in the state of Colorado, and all
members of the civil air patrol, Colorado wing, while said
persons are actually performing duties as volunteer firemen or as
members of such volunteer rescue teams or groups, volunteer
disaster teams, volunteer ambulance teams or groups, or volunteer
search teams or as members of the civil air patrol, Colorado
wing, and while engaged in organized drills, practice, or
training necessary or proper for the performance of such duties.
Members of volunteer police departments, volunteer police
reserves, and volunteer police teams or groups in any county,
city, town, or municipality, while actually performing duties as
volunteer police officers, may be deemed employees within the
meaning of this paragraph (a) at the option of the governing body
of such county or municipality. (Emphasis supplied)
Please exercise your option under the above-underlined
portion of Section 8-41-106, Workmen's Compensation Act, and
return to the State Compensation Insurance Fund, 1313 Sherman.
