BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
APRIL 6, 2016
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, April 6, 2016, at the hour of 9:00 a.m.
• ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:

El MINUTES: Commissioner Conway moved to approve the minutes of the Board of County
Commissioners meeting of April 4, 2016, as printed. Commissioner Cozad seconded the motion, and it
carried unanimously.
• AMENDMENTS TO AGENDA: There were no amendments to the agenda.
• CONSENT AGENDA: Commissioner Cozad moved to approve the Consent Agenda as printed.
Commissioner Kirkmeyer seconded the motion, and it carried unanimously.
PROCLAMATIONS:
El 1) DAY OF THE YOUNG CHILD - APRIL 9, 2016: Chair Freeman read the proclamation for the
record. Caroline Gelatt, and Sherri Hana-Rue, thanked the Commissioners for raising awareness for the
support of early learning opportunities for young children. Ms. Gelatt extended an invitation to the 2016
Kids Count on April 14, 2016. Each one of the Commissioners thanked the United Way Organization for
their efforts and hard work at putting together a great event for the children of Weld County. (Clerk's Note:
the meeting was paused for a photo opportunity.)
PUBLIC INPUT: No public input was given.
COMMISSIONER COORDINATOR REPORTS: Commissioner Moreno attended the Colorado
Energy Breakfast. a Commissioner Kirkmeyer reminded the Board about a couple of upcoming events
and she attended the API breakfast and lunch and she spoke with Mayor Hickenlooper.

Commissioner Cozad reported she attended a meeting and the residents were able to approach
CDOT with concerns about Highway 119. She also attended a Commission on Aging Meeting, and
brought an annual report available for review. She and Commissioner Conway attended the stone soup
dinner benefiting the Food Bank. She reported she went to the Prevention Partners Council Suicide
Prevention, and toured the Justice Service Department with Mark Ward and Doug Erler. Commissioner
Conway and Commissioner Moreno toured the Vestas facility with Senator Bennett. Commissioner
Conway explained he had the opportunity to attend a meeting highlighting the installation of the HOV
lanes which will be free of charge for 90 days. Commissioner Kirkmeyer stated she went to the Louchbuie
Town Hall ground breaking, which will be open by December, 2016.
BIDS:
• 1)APPROVE BID#B1600057, MINING SERVICES - DEPARTMENT OF PUBLIC WORKS: Trevor
Jiricek, Director of General Services, presented the nine (9) bids received and stated staff recommends
awarding the low bid from Hall-Irwin Corporation for the amount of $2,850,000.00. Jay McDonald,
Department of Public Works, reviewed the specifications needed from the bidder. Commissioner
Kirkmeyer moved to approve said low bid. The motion was seconded by Commissioner Conway, and it
carried unanimously.
• 2) APPROVE BID #61600059, GENERATOR INSTALLATION/HMGP (THREE (3) LOCATIONS) -
DEPARTMENT OF BUILDINGS AND GROUNDS: Mr. Jiricek presented the seven (7) bids and staff
recommends awarding the low bid from Quillen Electrical Contracting in the amount of $168,617.00.
Commissioner Morneo moved to approve said low bid. Seconded by Commissioner Cozad, the motion
carried unanimously.
3) PRESENT BID #B1600084, ROAD BROOM SWEEPER (QTY. 1) - DEPARTMENT OF PUBLIC
WORKS: Mr. Jiricek presented the two (2) bids received and stated staff will bring back a recommendation
on April 20, 2016.
OLD BUSINESS:
• 1) CONSIDER AUTHORIZATION OF FILING OF PROCEEDINGS IN EMINENT DOMAIN,
PURSUANT TO SECTION 38-1-101, C.R.S., AGAINST MARK HAMILTON (CON'T FROM 3/30/2016):
Bob Choate, Assistant County Attorney, stated this was continued at the request of Mark Hamilton and
after being notified by Mr. Choate he was not in attendance. Mr. Choate explained that the Department
of Public Works and the County of Attorney's Office have worked very deligently with Mr. Hamilton and
the parties are unable to reach an agreement. Commissioner Moreno moved to authorize the County
Attorney to file proceedings. The motion, which was seconded by Commissioner Cozad, carried
unanimously.
NEW BUSINESS:
_ 1) CONSIDER CONTRACT FOR ELECTRIC SERVICES AND AUTHORIZE CHAIR TO SIGN -
POUDRE VALLEY RURAL ELECTRIC ASSOCIATION, INC.: Elizabeth Relford, Department of Public
Works, presented the contract that is part of the LNG project. Commissioner Kirkmeyer moved to approve
said contract and authorize the Chair to sign. Commissioner Moreno seconded the motion, and it carried
unanimously.
2) CONSIDER RECOMMENDATION TO APPOINT COMMISSIONER STEVE MORENO TO
FREDERICK URBAN RENEWAL AUTHORITY BOARD: Commissioner Conway moved to approve said
appointment. The motion, which was seconded by Commissioner Kirkmeyer, carried unanimously.

• 3) CONSIDER APPLICATION FOR TEMPORARY ASSEMBLY FOR MORE 350 PERSONS ON
APRIL 10, MAY 22, JULY 17 AND AUGUST 28, 2016 - LEAHY FAMILY FARM, LLC: David Leahy,
resident of Greeley and the applicant, explained details of the event which is to allow motorcycle racing
on the property and stated this facility has been operating since 1998. Bruce Barker, County Attorney,
described the terms of the permit and reported there are no concerns. Commissioner Cozad expressed
her appreciation and support of the Leahy's events. Commissioner Kirkmeyer moved to approve said
application. Commissioner Cozad seconded the motion, and it carried unanimously. Ann Leahy presented
a painting to the Board. (Clerk's Note: the meeting was paused for a photo opportunity.)
• 4) CONSIDER AMENDED AND RESTATED AGREEMENT FOR THE PURCHASE OF PUBLIC
ROAD RIGHT-OF-WAY AND TEMPORARY CONSTRUCTION EASEMENT FOR IMPROVEMENTS TO
CR 49 AND AUTHORIZE CHAIR TO SIGN ALL NECESSARY DOCUMENTS - PETER PRESS TRUST;
AND D.R. COOPER FAMILY, LLLP: Tiffane Johnson, Department of Public Works, reviewed the details
of the amended and restated agreement for the amount of $60,787.00. She explained that when the
closing occurred there was a misunderstanding about the temporary and permanent construction
easements. Commissioner Cozad moved to approve said amended and restated agreement and
authorize the Chair to sign all necessary documents. The motion was seconded by Commissioner
Conway, and it carried unanimously.
• 5) CONSIDER TEMPORARY CLOSURE OF CR 31 BETWEEN CRS 34 AND 36: Janet Lundquist,
Department of Public Works, presented the details of the closure effective May 3, through May 6, 2016
for a culvert replacement and explained staff will use standard road signs, barricades and message boards
in advance. Commissioner Kirkmeyer moved to approve said closure. Seconded by Commissioner
Conway, the motion carried unanimously.
6) CONSIDER TEMPORARY CLOSURE OF CR 7 BETWEEN CRS 18 AND 20: Ms. Lundquist
presented the terms of the closure effective April 26, through April 29, 2016, for a culvert replacement and
stated staff will use standard road signs and barricades. Commissioner Cozad moved to approve said
closure. The motion, which was seconded by Commissioner Moreno, carried unanimously.
• 7) CONSIDER RESCINDING DOCUMENT#2016-0822, DATED MARCH 2, 2016, CONCERNING
SMALL TRACT OIL AND GAS LEASE-MINERAL RESOURCES, INC.: Esther Gesick, Clerk to the Board,
explained that a lease was previously entered into with Mineral Resources and this will correct a double
lease Commissioner Conway moved to rescind said document. Commissioner Cozad seconded the
motion, and it carried unanimously.
• 8) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL AND
GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN -
INCLINE NIOBRARA PARTNERS, LP: Ms. Gesick presented the lease for 4.0 mineral acres, in the
amount of $4,800.00. Commissioner Moreno moved to waive the bid procedure, approve said lease and
authorize the Chair to sign. The motion was seconded by Commissioner Conway, and it carried
unanimously.
9) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL AND
GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN -
AZTEC EXPLORATION, LLC: Ms. Gesick reviewed the terms of the lease for the bonus amount$208.08.
Commissioner Cozad moved to waive the bid procedure, approve said lease and authorize the Chair to
sign. Seconded by Commissioner Conway, the motion carried unanimously.

• 10) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL
AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN -
AZTEC EXPLORATION, LLC: Ms. Gesick presented the terms of the lease for.0998 acres, in the amount
of $119.76. Commissioner Moreno moved to waive the bid procedure, approve said lease and authorize
the Chair to sign. The motion, which was seconded by Commissioner Conway, carried unanimously.
• 11) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL
AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN -
AZTEC EXPLORATION, LLC: Ms. Gesick reviewed the details of the lease for 0.1236 acres, in the amount
of $151.56. Commissioner Cozad moved to waive the bid procedure, approve said lease and authorize
the Chair to sign. Seconded by Commissioner Moreno, the motion carried unanimously.
• 12) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL
AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN -
AZTEC EXPLORATION, LLC: Ms. Gesick reviewed the terms of lease for .1451 acres, in the amount of
$174.12. Commissioner Moreno moved to waive the bid procedure, approve said lease and authorize the
Chair to sign. The motion was seconded by Commissioner Conway, and it carried unanimously.
13) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL
AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN -
AZTEC EXPLORATION, LLC: Ms. Gesick presented the details of the lease for .01919 acres, in the
amount of $22.92. Commissioner Conway moved to waive the bid procedure, approve said lease and
authorize the Chair to sign. The motion, which was seconded by Commissioner Cozad, carried
unanimously.
• 14) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL
AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN -
AZTEC EXPLORATION, LLC: Ms. Gesick reviewed the terms of the lease for 0.4362 acres, in the amount
of $523.44. Commissioner Cozad moved to waive the bid procedure, approve said lease and authorize
the Chair to sign. Seconded by Commissioner Conway, the motion carried unanimously.
ci 15) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL
AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN -
AZTEC EXPLORATION, LLC: Ms. Gesick presented the terms of lease for .0437 acres, in the amount of
$52.44. Commissioner Conway moved to waive the bid procedure, approve the lease and authorize the
Chair to sign. The motion was seconded by Commissioner Cozad, and it carried unanimously.
• 16) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL
AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN -
AZTEC EXPLORATION, LLC: Ms. Gesick reviewed the details for the lease for.4004 acres, in the amount
of $480.48. Commissioner Cozad moved to waive the bid procedure, approve said lease and authorize
the Chair to sign. Commissioner Moreno seconded the motion, and it carried unanimously.
17) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL
AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN -
AZTEC EXPLORATION, LLC: Ms. Gesick presented the terms of the lease for.6662 acres, in the amount
of $799.44. Commissioner Moreno moved to waive the bid procedure, approve said lease and authorize
the Chair to sign. The motion, which was seconded by Commissioner Kirkmeyer, carried unanimously.

• 18) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL
AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN
- EXTRACTION OIL AND GAS, LLC: Ms. Gesick presented the terms of the lease for .4954 acres, in the
amount of $594.48. Commissioner Cozad moved to waive the bid procedure, approve said lease and
authorize the Chair to sign. Seconded by Commissioner Kirkmeyer, the motion carried unanimously.
• 19) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL
AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN
- EXTRACTION OIL AND GAS, LLC: Ms. Gesick presented the terms of the lease for .5197 acres, in the
amount of $623.64. Commissioner Conway moved to waive the bid procedure, approve said lease and
authorize the Chair to sign. The motion was seconded by Commissioner Moreno, and it carried
unanimously.
• 20) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL
AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN
- EXTRACTION OIL AND GAS, LLC: Ms. Gesick presented the terms of the lease for .8169 acres, in the
amount of $908.28. Commissioner Cozad moved to waive the bid procedure, approve said lease and
authorize the Chair to sign. The motion, which was seconded by Commissioner Conway, carried
unanimously.
21) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL
AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN
- EXTRACTION OIL AND GAS, LLC: Ms. Gesick presented the terms of the lease for 1.0729 acres, in
the amount of$1,287.48. Commissioner Moreno moved to waive the bid procedure, approve said lease
and authorize the Chair to sign. The motion, which was seconded by Commissioner Cozad, carried
unanimously.
• 22) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL
AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN
- EXTRACTION OIL AND GAS, LLC: Ms. Gesick presented the terms of the lease for 2.80365 acres, in
the amount of $3,364.38. Commissioner Cozad moved to waive the bid procedure, approve said lease
and authorize the Chair to sign. Seconded by Commissioner Conway, the motion carried unanimously.
▪ 23) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL
AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN
- EXTRACTION OIL AND GAS, LLC: Ms. Gesick presented the terms of the lease for .2921 acres, in the
amount of $350.52. Commissioner Conway moved to waive the bid procedure, approve said lease and
authorize the Chair to sign. The motion, which was seconded by Commissioner Moreno, carried
unanimously.
• 24) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL
AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORZE CHAIR TO SIGN
- EXTRACTION OIL AND GAS LEASE: Ms. Gesick presented the terms of the lease for .3085 acres, in
the amount of$370.20. Commissioner Cozad moved to waive the bid procedure, approve said lease and
authorize the Chair to sign. The motion which was seconded by Commissioner Conway, carried
unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.

Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board.
There being no further business, this meeting was adjourned at 10:07 a.m.
