BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
FEBRUARY 29, 2016
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, February 29, 2016, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Mike Freeman, Chair
Commissioner Sean P. Conway, Pro-Tem
Commissioner Julie A. Cozad
Commissioner Barbara Kirkmeyer
Commissioner Steve Moreno

MINUTES: Commissioner Conway moved to approve the minutes of the Board of County
Commissioners meeting of February 24, 2016, as printed. Commissioner Kirkmeyer seconded the
motion, and it carried unanimously.
12 CERTIFICATION OF HEARINGS: Commissioner Moreno moved to approve the Certification of
Hearings conducted on February 24, 2016, as follows: 1) COZ15-0004 - Ronald and Lee Birgenheier,
and 2) USR15-0073 - Miller HFI, LLC. Commissioner Cozad seconded the motion, which carried
unanimously.
CI AMENDMENTS TO AGENDA: There were no amendments to the agenda.
CI CONSENT AGENDA: Commissioner Kirkmeyer moved to approve the Consent Agenda as printed.
Commissioner Cozad seconded the motion, and it carried unanimously.
El PUBLIC INPUT: No public input was given.
BIDS:
1) PRESENT BID #81600045, DUST PALLIATIVE SUPPLY - DEPARTMENT OF PUBLIC
WORKS: Trevor Jiricek, Director of General Services, presented the three (3) bids received and stated
staff will make a recommendation on March 14, 2016. (Clerk's Note: This matter was subsequently
rescheduled to 3/16/2016.)

• 2) PRESENT BID #B1600044, ENGINEERING/DESIGN (CENTENNIAL CENTER PLAZA) -
DEPARTMENT OF BUILDING AND GROUNDS: Mr. Jiricek presented the seven (7) bids received and
stated staff will bring back a recommendation on March 14, 2016.
NEW BUSINESS:
El 1) CONSIDER LEASE AGREEMENT AND AUTHORIZE CHAIR TO SIGN - STATE OF
COLORADO DEPARTMENT OF HUMAN SERVICES ACTING BY AND THROUGH THE DIVISION OF
VOCATIONAL REHABILITATION: Toby Taylor, Director of Buildings and Grounds, reviewed the terms
of the lease for a renewal of space already occupied. Commissioner Cozad moved to approve said
agreement and authorize the Chair to sign. Commissioner Conway seconded the motion, and it carried
unanimously.
▪ 2) CONSIDER POLE PERMIT APPLICATION AND AUTHORIZE CHAIR TO SIGN - PUBLIC
SERVICE COMPANY OF COLORADO, DBA XCEL ENERGY: Ryan Rose, Director of the Department
of Information Technology, stated this application is to allow fiber optic cable to go from the North Jail to
attach to the pole and the Chase Building for connectivity. Commissioner Conway moved to approve said
application and authorize the Chair to sign. The motion was seconded by Commissioner Kirkmeyer, and
it carried unanimously.
• 3) CONSIDER REGIONAL COMMUNICATIONS USER AGREEMENT AND AUTHORIZE CHAIR
TO SIGN - CITY OF FORT LUPTON: Mike Wallace, Director of the Department of Public Safety
Communications, reviewed the terms of the user agreement. Commissioner Conway moved to approve
said agreement and authorize the Chair to sign. Seconded by Commissioner Moreno, the motion carried
unanimously. In response to Commissioner Conway, Mr. Wallace stated there are still eleven (11)
agreements outstanding.
• 4) CONSIDER CRIME VICTIM SERVICES GRANT APPLICATION FOR BILINGUAL ADVOCATE
UNIT AND AUTHORIZE ELECTRONIC SUBMITTAL: Jennifer Oftelie, Sheriffs Office, presented the
details of the grant and explained what the funds will be used for. Commissioner Cozad moved to approve
said application and authorize electronic submittal. The motion, which was seconded by Commissioner
Moreno, carried unanimously.
Eri 5) CONSIDER VICTIM ASSISTANCE LAW ENFORCEMENT (VALE) GRANT APPLICATION FOR
VICTIM SERVICES UNIT AND AUTHORIZE CHAIR TO SIGN: Ms. Oftelie reviewed the details
concerning the application which will help off-set the staffing costs of the Victim's Services Unit.
Commissioner Conway moved to approve said application and authorize the Chair to sign. The motion
was seconded by Commissioner Cozad, and it carried unanimously.
• 6) CONSIDER JUSTICE ASSISTANCE GRANT APPLICATION FOR ENFORCEMENT AND
TECHNOLOGY SMALL ITEMS OF EQUIPMENT AND AUTHORIZE ELECTRONIC SUBMITTAL: Ms.
Oftelie presented the details of the grant application requesting the amount of $53,425.00. In response
to Commissioner Kirkmeyer, Ms. Oftelie explained it is to purchase 38 new smart phones and one year
of service which will reduce the need for patrol officers to utilize desk phones. Commissioner Conway
moved to approve said application and authorize electronic submittal. The motion, which was seconded
by Commissioner Cozad, carried unanimously.
• 7) CONSIDER CHANGE ORDER AGREEMENT FOR BRIDGE 54/13A PERMANENT FLOOD
REPAIRS (BID#B1300201)AND AUTHORIZE CHAIR TO SIGN - BOHANNAN HUSTON, INC: Richard
White, Department of Public Works, explained the need to change the contract price is for additional

environmental clearance work for flood repairs. Commissioner Kirkmeyer moved to approve said change
order and authorize the Chair to sign. Seconded by Commissioner Moreno, the motion carried
unanimously.
8) CONSIDER AMENDMENT TO BYLAWS FOR FAIR BOARD: Janet Konkel, Extension Office,
presented the suggested changes to the bylaws. Commissioner Cozad moved to approve said changes
to the bylaws. The motion, which was seconded by Commissioner Conway, carried unanimously.
9) CONSIDER APPEAL OF THE DECISION OF PUBLIC WORKS CONCERNING AN
APPLICATION FOR ACCESS PERMIT, AP16-00022 - SHIPPS FARMS, LP: Janet Lundquist,
Department of Public Works, stated staff received a request for one new access point that was denied.
The applicant is requesting one additional access point off of County Road (CR)100 east of CR 35. The
parcel currently has four (4) existing access points onto CR 100 and the applicant is willing to close one
of the existing access points in exchange for the new access point. In response to Commissioner
Conway, Ms. Lundquist stated staff felt it didn't make sense to close two (2) accesses. Alan Shipps,
applicant, explained the agriculture access point had been abandoned and access points #2 and #3 are
considered residential. This new access point will allow access to a new residential home, as well as
future structures. Mr. Shipps states the current driveway accesses a wheat field. In response to
Commissioner Kirkmeyer, Ms. Lundquist stated the traffic count for CR 100 is low at 210 truck trips a
day. In response to Commissioner Cozad, Mr. Shipps explained the access to the south has large
established trees which makes it hard to V farm equipment through there and having to use it would
create a hardship for the farm business. In response to Commissioner Conway, Mr. Shipps stated
that uses of the access are for the agricultural business and there are about 30 to 40 trips daily on the
gravel road. Commissioner Cozad moved to grant the appeal and issue the access deliniated and shown
on the map as Exhibit "A" after proof that access point Existing #1 is closed and recorded. The motion
was seconded by Commissioner Conway, and it carried unanimously. Commissioner Kirkmeyer
reiterated the abandoned access will be closed.
OLD BUSINESS:
1) CONSIDER CERTIFICATION TO THE WELD COUNTY TREASURER OF ZONING VIOLATION
PENALTIES AS SPECIAL ASSESSMENT- ROGER LEE HILL AND SHERYL KAY HILL (CON'T FROM
1/18/2016): Karin McDougal, Assistant County Attorney, presented the details of the continuation and
stated Sheryl Hill, the property owner, has submitted a completed USR application and entered into an
updated Stipulation Agreement. Commissioner Conway moved to deny said certification of the lien.
Seconded by Commissioner Cozad, the motion carried unanimously.
la 2) CONSIDER CERTIFICATION TO THE WELD COUNTY TREASURER OF ZONING VIOLATION
PENALTIES AS SPECIAL ASSESSMENT - RICHARD PIERRO AND TIM FREI (CON'T FROM
1/18/2016): Ms. McDougal suggested continuing this matter for another two (2) months so that ownership
of the parcel can be determined. Bethany Pascoe, Department of Planning Services, reported the
violation is still occurring on the parcel. Michael Matthews, attorney for Tim Frei, explained he was hired
to determine ownership, and stated, Mr. Frei believes he has ownership of the property, since 2007
substantial progress has been made to clean up the property, but it isn't in compliance. Commissioner
Kirkmeyer moved to continue said matter to April 25, 2016 at 9:00 am. Seconded by Commissioner
Conway, the motion carried unanimously.
Ei 3) FINAL READING OF CODE ORDINANCE #2015-24, IN THE MATTER OF REPEALING AND
REENACTING WITH AMENDMENTS, CHAPTER 2 ADMINISTRATION AND CHAPTER 17 PUBLIC
PLACES, OF THE WELD COUNTY CODE (CON'T FROM 2/8/2016): Commissioner Kirkmeyer moved

to read Code Ordinance#2015-24 by title only. Seconded by Commissioner Conway, the motion carried
unanimously. Bruce Barker, County Attorney, read the title for the record and presented the two (2)
changes since the second reading. No public testimony was offered concerning this matter.
Commissioner Kirkmeyer moved to approve on Final Reading. Seconded by Commissioner Moreno, the
motion carried unanimously.
PLANNING OLD BUSINESS:
1)SECOND READING OF CODE ORDINANCE#2015-26, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING, OF THE WELD COUNTY CODE
(CON'T FROM 1/25/2016): Commissioner Kirkmeyer moved to read Code Ordinance #2015-26 by title
only. The motion was seconded by Commissioner Conway, and it carried unanimously. Mr. Barker read
the title for the record. Tom Parko, Department of Planning Services, presented the options for the second
reading; The first being to continue to another date or the second would be to approve on Second
Reading and reevaluate prior to the third reading. Commissioner Kirkmeyer suggested continuing this to
May 9, 2016, to allow for more time to hold stakeholder meetings. No public testimony was offered
concerning this matter. Commissioner Kirkmeyer moved to continue second reading of Code Ordinance
#2015-26, to May 9, 2016. Seconded by Commissioner Cozad, the motion carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. Code Ordinance#2015-24 was approved on Final Reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board.
There being no further business, this meeting was adjourned at 10:00 a.m.
