RE: LOT SIZE VARIANCE #45 - ROBERT DUCKWORTH.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has determined
at a public hearing held on the 29th day of August, 1977, in
the Chambers of the Board of County Commissioners of Weld County,
Colorado, that a certain parcel of land is owned by Robert Duck-
worth, 2729 Weld County Road No. 201, Longmont, Colorado 80501 ,
which land is more particularly described as follows, to-wit:
Part of the NE4 of Section 16 , Township 2 North,
Range 68 West of the 6th P.M. , Weld County,
Colorado,
WHEREAS , Robert Duckworth desires to split the hereinabove
described tract of land into two parcels , and
WHEREAS, Section 9-4A(6) of the Weld County Subdivision
Regulations requires that a lot size variance be obtained before
a Recorded Exemption is granted to the applicant, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, based upon the recommendations of the Department of
Planning Services , feels that the applicant has not shown good
cause for granting a lot size variance under Section 9-4A (6)
of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED that a variance from lot
size requirements be, and hereby is denied to Robert Duckworth
for the above-described parcel of land.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 29th day of
August , A.D. , 1977.

RE: Lot Size Variance #45
Dear Commissioners:
The attached letter and related items are in reference to a request by
Robert Duckworth for a lot size variance. The subject property is
described as Pt. NE4 of Section 16, T2N, R68W of the 6th P.M. , Weld
County, Colorado. Said property is located immediately northwest of
Rinn. and 1 mile west and 12 miles south of Del Camino. The property
in question contains approximately 69.7 acres of Class I , II , III ,
and IV irrigated soils. The request is to obtain a variance from the
minimum lot size requirement , Section 9.4(a) (6) , so that Mr. Duckworth
may make application to apply for a recorded exemption. Section 9.4(a)(6)
states, "that the original tract or parcel of land to be divided under
this section meets the minimum lot size requirements established by
the Weld County Zoning Resolution; variance from this requirement being
allowed only upon good cause being shown to the Board of County Commis-
sioners or where said tract or parcel of land lies within the Compre-
hensive Plan of an existing corporated town of Weld County. (Revised
4-17-74)" . If this lot size variance is granted, Mr. Duckworth will
proceed with his application for a recorded exemption to divide the
property into parcels of approximately 25 acres and 44. 7 acres. As
proposed, the 44. 7 acre parcel would contain an existing set of improve-
ments and the 25 acres would be ccnveyed as .a new residential site.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services recommends that the request
be denied for the following reasons :
1. The proposed split does not comply with the Weld County Comprehen-
sive Plan because it would promote non-agricultural use of agri-
cultural land and it would encourage urban encroachment on rural
land use.
2. The request is not in conformance with the intent clause of the
Agricultural Zone District (Section 3. 3A of the Weld County Zoning
Resolution) which states:

"Intent - The intent in establishing the A-I Agricultural Zone
District is to allow all agricultural and related uses in those
areas in which agriculture is and should continue to be the
predominant land use. This district is intended to discourage
encroachment of incompatible uses upon the agricultural land
in the district , to encourage agricultural uses as the highest
and best use of the land in the district as compared with
other uses in conflict therewith, and to provide for the
orderly expansion of urban growth in conformance with the Weld
County Comprehensive Plan. "
The request would not be encouraging the agricultural uses as the
highest and best uses, it would not be providing for the orderly
expansion of urban growth, and it would be promoting the division
of agricultural lands into smaller, less economic parcel sizes.
3. The proposal is not in compliance with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County Sub-
division Regulations) . Said clause states:
"The intent in establishing the Recorded Exemption procedure
is to provide, in accordance with the Weld County Comprehen-
sive Plan, a means whereby non-productive agricultural lands
may be developed for higher or more productive uses, in-so-far
as such uses are compatible with surrounding agricultural uses
in areas where such land divisions are proposed. (Revised
4-17-74)"
The split would allow an additional set of improvements to be
built and therefore create an urban encroachment which would not
be compatible with the Agricultural District.
4. The minimum lot size in the irrigated Agricultural District is 80
acres. The intent is to maintain large enough tracts for farm
purposes, and to assist in the encouragement of agricultural uses
as the highest and best use of the land. The proposed split is
in violation of that intent .

Gentlemen:
Please consider this request for a lot size variance.
I have sixty nine end seven tenths acres of J.rrigated
land with improvements and would likes a variance to
sell off approximately twenty five acres.
We purchased the farm with a twenty nine -)ercent down
payment. I farm the place m:,•self, but the land is not
productive enough at c,trrent farm prices to make interest
payments. This is cre^ting a financial ourden for me.
This land has good road frontage with all utilities. It
is best suited for raising 'sass, so it would make an
excellent acreage for someone wanting to keen a few
horses or cattle.
Enclosed you will find a sketch of the land involved
and a copy of the deed.

The necessary materials for the above described request are complete
