HomeMy WebLinkAbout20163850.tiffRESOLUTION RE: ACTION OF THE BOARD CONCERNING SUSPENSION OF COLORADO RETAIL FOOD ESTABLISHMENT LICENSE - EDEN PHO, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Eden Pho, LLC, located at 3230 23rd Avenue, Evans, Colorado 80620, is allegedly in violation of the Colorado Retail Food Establishment Rules and Regulations, and WHEREAS, on December 28, 2016, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violations at the facility licensed to Eden Pho, LLC, at which time staff informed the Board that the property and business had been sold and requested the matter be dismissed. WHEREAS, after hearing testimony from all present, the Board of County Commissioners deemed it advisable to dismiss the matter based on the transfer of the business and license to new ownership. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that consideration for suspension of the Colorado Retail Food License issued to Eden Pho, LLC, located at 3230 23rd Avenue, Evans, Colorado 80620, be, and hereby is, dismissed with instruction to staff to work closely with the new owner to bring the operation into compliance. BE IT FURTHER RESOLVED by the Board that Health staff is instructed to make follow-up inspections and to bring this matter back to the Board if repeat critical violations are observed or should the facility fail to remain in substantial compliance. Cozad CUSED rbara Kirkmeyer � r Steve Moreno 2016-3850 HL0048 Memorandum TO: Board of County Commissioners From: Dan Joseph DATE: December 28, 2016 SUBJECT: Eden Pho Restaurant Eden Pho Restaurant, located at 3230 23rd Avenue in Evans, Colorado and owned by Eden Pho LLC, has failed to maintain compliance with the Colorado Retail Food Establishment Rules and Regulations (Regulations) (see attached timeline and background summary). Though the Weld County Department of Public Health and Environment (Department) has given the facility all opportunities to come into compliance that are afforded to them in the Colorado Revised Statutes, there have been repeated violations resulting in the assessment of three civil penalties within a 12 -month period. In addition, during this time period multiple other critical violations were noted that have the potential to directly result in illnesses of patrons dining at the establishment. A First Notification of Non -Compliance was issued for violations 1 c (raw animal foods stored over ready -to -eat foods) and 3e (improper cold holding of potentially hazardous foods) and sent via regular mail. January 27, 2016 A follow-up inspection was conducted in which violation 1 c (raw animal foods stored over ready -to -eat foods) was cited and 3e (improper cold holding of potentially hazardous foods) was not cited. February 5, 2016 A Second Notification of Non -Compliance was issued for violation 1 c (raw animal foods stored over ready -to -eat foods) and a Compliance Warning was issued for 3e (improper cold holding of potentially hazardous foods). Both letters were sent via regular mail. February 16, 2016 A follow-up inspection was conducted in which violation 1 c (raw animal foods stored over ready -to -eat foods) was not cited. February 18, 2016 A Notice of Civil Penalty and Compliance Warning was issued for violation 1 c (raw animal foods stored over ready -to -eat foods) and sent via regular mail. May 10, 2016 May 18, 2016 A regular inspection was conducted in which violation 3e (improper cold holding of potentially hazardous foods) was cited. A Second Notification of Non -Compliance was issued for violation 3e (improper cold holding of potentially hazardous foods) and was sent via regular mail. June 7, 2016 June 29, 2016 July 21, 2016 October 21, 2016 December 9, 2016 December 9, 2016 A follow-up inspection was conducted in which violation (improper cold holding of potentially hazardous foods) was not cited. A Notice of Civil Penalty and Compliance Review was issued for violation 3e (improper cold holding of potentially hazardous foods) and sent via regular mail. A compliance review meeting was held with the Weld County Department of Public Health and Environment. A summary was provided at the conclusion of the meeting. A regular inspection was conducted in which violation 3e (improper cold holding of potentially hazardous foods) was cited. A Notice of Civil Penalty and Hearing was issued for violation 3e (improper cold holding of potentially hazardous foods) and was hand -delivered. A non -regulatory inspection was conducted in which violation 3e (improper cold holding of potentially hazardous foods) was noted.
