WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute, and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, held a public hearing on the 12th day of October, 1977 , at the hour of 9 : 00 o' clock A.M. , for the purpose of hearing the application of the Trinity Lutheran Church, for the granting of a Conditional Use Permit for a Church and Church School on the following described real estate, to-wit: That portion of the Northwest Quarter of Section 24, Township 5 North, Range 66 West of the 6th P.M. in the County of Weld, State of Colorado more particularly described as follows: Beginning at the Northwest Corner of the Northwest Quarter of said Section 24; thence along the West line of the Northwest Quarter of said Section South 1°28'00" East 1777.00 feet to the true point of beginning; thence along the center of the Greeley-Loveland Irri- gation Company canal South 66°08'00" East 166.90 feet; thence North 62°40'00" East 165.50 feet; thence North 30°58'00" East 186.89 feet to a point on the East line of subject parcel; thence North 1°28'00" West 741.47 feet; thence South 88°32'00" West 400.00 feet to the West line of the Northwest Quarter of said Section 24; thence along said West line South 1°28'00" East 900.00 foot more or less to the true point of beginning. ' -1 1 Subject to existing County Road rights-of-way 770152 The above described parcel. contains 7.35 Acres more or loos net_ WHEREAS, the petitioner was present, and WHEREAS , evidence was presented in support of the grant of the Conditional Use Permit for a Church and Church School, and WHEREAS, Section 3. 3.D. 4 . c. of the Weld County Zoning Resolution authorizes such a use in an Agricultural District on the grant of a Conditional Use Permit by the Board of County Com- missioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, heard all the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully in- formed and satisfied that the request for a Conditional Use Permi- for a Church and Church School on the hereinabove described real estate, complies with all of the conditions as set out in Section 3. 3.D. 2. of the Weld County Zoning Resolution; NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application of the Trinity Lutheran Church for a Conditional Use Permit for a Church and Church School on the hereinabove described tract of land, be, and hereby is, granted, subject to the Development Standards contained in the Conditional Use Permit, and subject to the addition of Development Standard No. 7. as stated below: 7. If, in the future, the Board of County Commissioners of Weld County, Colorado receive any complaints that children are off the property described above, said Board may require the school playground area to be fenced. and, subject to the dedication of a 20 foot right-of-way on 35th Avenue and required approval of a drainage report presently being prepared by Hogan and Olhausen, Engineers . BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the reasons for approval contained in the Planning Commission Recommendations dated October 4 , 1977, be, and hereby are, incorporated as the findings of fact of the Board of County Commissioners in this matter. The request is in conformance with the Weld County Comprehensive Plan in that the new church is located adjacent to an existing municipality (Greeley) and compatible with the future land use plans of that municipality. 2. Retention must be supplied for the runoff from the southern drainage area. The amount of retention which must be supplied is the 100 year runoff volume in the developed condition less a release rate not greater than the 5 year storm runoff in the undeveloped condition . 2. The outfall at the southeast corner of the property must be graded with a defined channel to insure proper flow into the Greeley-Loveland Ditch. 3. Confirmation of permission to drain portions of the property into the Greeley-Loveland Ditch must be provided. 4 . Retention ponds which are used for sprinkling system storage must be supplied with an outfall line , the capacity of which should not exceed the peak flow from a 5 year event . The site is an eight and 33/100 acres located along 35th Avenue north of Greeley-Loveland ditch and south of Sunset Memorial Cemetary. Soil Suitability: The site is comprised of Vona sandy loam, 1 to 3 percent slopes, which is a deep well drained soil with a moderately rapid permeability and moderate available water capacity. Surface runoff is slow and water erosion hazard is low. Light surface texture does, however, present a wind erosion hazard. The soil exhibits a slight limitation for construction of small commercial build- ings and dwellings with basements. A standard footing design should be adequate for construction. A moderate limitation does exist for use as a playground due to slope and dusty conditions that would result from bare soil surface. The limitation should be easily rectified with adequate landscaping plan. Flooding Potential: Evaluation of site and proposed land use of the area should not create flooding nor is the site within an existing flood plain. Planned Drainage System: Evaluation of planned drainage system is difficult to assess as none was enclosed with proposed site plan. However, the site location should not propose any sig- nificant surface drainage problems. A provision in the plan shows a planned re- tention pond in the northeast corner of the site which should allow for adequate storage of surface runoff generated on the site. Vegetative Protection and Erosion Control Plan: Neither a vegetative nor an erosion control plan was submitted for evaluation. The soil type does, however, exhibit wind erosion potential due to the light soil surface texture. The maximum bare soil area exposed would have to be 100 feet or less to keep expected soil loss to less than 5 tons per acre per year. Therefore, it is essential that bare soil areas be kept to the absolute minimum practical during the construction phase to avoid severe wind erosion. Permanent or temporary vegetative cover should be planted to provide soil protection during the critical wind erosion period from January through May. Topsoil should be stockpiled when possible to be replaced over fill or cut areas to help insure reestablishment of permanent vegetative cover once construction is complete.
