CHURCH AND CHURCH SCHOOL ON A TRACT OF LAND IN THAT
PORTION OF THE NWG, SECTION 24 , TOWNSHIP 5 NORTH, RANGE
66 WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO - TRINITY
LUTHERAN CHURCH.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute, and the Weld County
Home Rule Charter, is vested with the authority of administering
the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, held a public hearing on the 12th day of October, 1977 ,
at the hour of 9 : 00 o' clock A.M. , for the purpose of hearing the
application of the Trinity Lutheran Church, for the granting
of a Conditional Use Permit for a Church and Church School on the
following described real estate, to-wit:
That portion of the Northwest Quarter of Section 24, Township 5 North,
Range 66 West of the 6th P.M. in the County of Weld, State of Colorado
more particularly described as follows:
Beginning at the Northwest Corner of the Northwest Quarter of said
Section 24; thence along the West line of the Northwest Quarter of
said Section South 1°28'00" East 1777.00 feet to the true point of
beginning; thence along the center of the Greeley-Loveland Irri-
gation Company canal South 66°08'00" East 166.90 feet; thence North
62°40'00" East 165.50 feet; thence North 30°58'00" East 186.89 feet
to a point on the East line of subject parcel; thence North 1°28'00"
West 741.47 feet; thence South 88°32'00" West 400.00 feet to the
West line of the Northwest Quarter of said Section 24; thence along
said West line South 1°28'00" East 900.00 foot more or less to the
true point of beginning.
SUBJECT to the following described easements. Reserved easement for
access and maintenance of Greeley-Loveland Ditch.
Beginning at the Northwest corner of the Northwest Quarter of said
Section 24; thence along the West line of the Northwest Quarter of
said Section South 1°28'00" East 1777.00 feet to the true point
of beginning; thence along said West line North 1°28'00" West 55.32
feet; thence South 66°08'00" East 166.61 feet; thence North 62°40'00"
East 127.35 feet; thence North 30°58'00" East 194.30 feet; thence
North 41°00'15" East 45.34 feet to a point on the East line of subject
parcel; thence South 1°28'00" East 78.50 feet; thence South 30°58'00"
West 186.89 feet; thence South 62°40'00" West 165.50 feet; thence
North 66°08'00" West 166.90 feet, more or less to the true point of
beginning.
Utility and access easement for Central Weld County Water District.
Beginning at the Northwest corner of the Northwest Quarter of said

beginning; thence along said West line North 1°28'00" West 55.32 feet
to the true point of beginning; thence South 66°08'00" East 166.61

The above described parcel. contains 7.35 Acres more or loos net_
WHEREAS, the petitioner was present, and
WHEREAS , evidence was presented in support of the grant of the
Conditional Use Permit for a Church and Church School, and
WHEREAS, Section 3. 3.D. 4 . c. of the Weld County Zoning
Resolution authorizes such a use in an Agricultural District on
the grant of a Conditional Use Permit by the Board of County Com-
missioners, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, heard all the testimony and statements of those present,
has studied the request of the petitioner and the recommendations
of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter, and having been fully in-
formed and satisfied that the request for a Conditional Use Permi-
for a Church and Church School on the hereinabove described real
estate, complies with all of the conditions as set out in Section
3. 3.D. 2. of the Weld County Zoning Resolution;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the application of
the Trinity Lutheran Church for a Conditional Use Permit for a
Church and Church School on the hereinabove described tract of
land, be, and hereby is, granted, subject to the Development
Standards contained in the Conditional Use Permit, and subject
to the addition of Development Standard No. 7. as stated below:
7. If, in the future, the Board of County Commissioners
of Weld County, Colorado receive any complaints that
children are off the property described above, said Board
may require the school playground area to be fenced.
and, subject to the dedication of a 20 foot right-of-way on 35th
Avenue and required approval of a drainage report presently being
prepared by Hogan and Olhausen, Engineers .
BE IT FURTHER RESOLVED by the Board of County Commissioners
of Weld County, Colorado, that the reasons for approval contained
in the Planning Commission Recommendations dated October 4 , 1977,
be, and hereby are, incorporated as the findings of fact of
the Board of County Commissioners in this matter.
The above and foregoing Resolution was , on motion duly made

lative to the Trinity Lutheran Church site located on 35th Avenue.
This information is submitted for your review and approval and should

U From our investigation, we have concluded the following:
1 . The 100 year peak rate of runoff from the property in
its developed state which will exit the property is
less than the 100 year peak rate of runoff from the �; `I
property in its undeveloped state.
, 2. The detention pond, as indicated on the Trinity
• Lutheran Church Site Plan, has the capacity to
U hold the runoff created by the difference in peak
7 rates of runoff from the 100 year storm developed
and the 100 year storm undeveloped.
Z 3. No adverse drainage affects will be created by the
development of the site.

Moved by Ben Nix that the following resolution be introduced
for passage by the Weld County Planning Commission:
Be it Resolved by the Weld County Planning Commission that the
application for Church and Church School
covering the following described property in Weld County,
Colorado, to-wit:
See attached
be recommended (favorably) ( WINN) to the Board of County
Commissioners for the following reasons:
1. The request is in conformance with the Weld County Comprehensive
Plan in that the new church is located adjacent to an existing
municipality (Greeley) and compatible with the future land use
plans of that municipality.
2. It is the opinion of the Planning Commission that this request
is in compliance with the provisions of Section 3. 3.D(2) of the
Weld County Zoning Resolution which states:
"The Planning Commission and Board of County Commissioners
shall consider the following in making their determination
in approving or denying a Conditional Use Permit :

the character of the neighborhood and existing
agricultural uses, need for the proposed use, its effect
upon the immediate area, its effect on future development
of the area and the health, safety, and welfare of the
inhabitants of the area and the County. "
This determination is based upon the following:
A. The City of Greeley Planning Commission has indicated they
have no objections to the new church since the use is
compatible with their Comprehensive Land Use Plan.
B. The Weld County Health Department has indicated they
recommend approval of the request.
C. The Western Hills Fire Protection District has indicated
they have no objections to the construction of the new
church.
The Planning Commission recommendation for approval is subject to
the CUP plans being amended to indicate the reservation or
dedication of an additional 20' of right-of-way along 35th Avenue
since 35th Avenue is a proposed arterial road in the Weld County
Thoroughfare Plan.

DEVELOPMENT STANDARDS
1 . The permitted uses on the hereon described property shall be
the church and church sch¢pl facilities as shown on the CUP

2 . The Conditional Use Permit area shall be maintained in such
a manner so as to prevent soil erosion, fugitive dust , and
the growth of noxious weeds .
3. All parking shall be provided on-site.
4 . Access shall be limited to the two access points as shown
hereon.
5. All sewage disposal facilities shall comply with Weld County
and State Health Standards and Regulations.
6. The Conditional Use Permit shall be limited to the plans
submitted and governed by the Development Standards stated
above and all applicable Weld County regulations. Any
changes to the plans and/or Development Standards shall require
approval of another Conditional Use Permit before such changes
shall be allowed.

DISCUSSION : Mr. Billings briefly reviewed the request for the
proposed new church and church school . He also indicated that
because of the cost of the sewer onto the church property, they
l./ will now work with the Weld County Health Department for the septic
system. He also indicated that the County Engineering Department
was concerned about the water run-off on the property . This
water will be used for irrigation on the property. Ken McWilliams
then read the staff recommendations and Development Standards.
The request for an additional 20 ' of right-of-way along 35th
Avenue was discussed. Mr. Billings indicated they have no
objections to providing the additional right-of-way provided there
is 20 ' between the existing right-of-way line and Public Service
Company ' s easement .
MOTION: Be it therefore resolved to recommend approval to the Board
of County Commissioners with the Development Standards. Motion by
Ben Nix, seconded by Bette Kountz. A vote of "aye" by Ben Nix ,
Marge Yost , Percy Hiatt , Bette Kountz, Harry Ashley, Irma White,

DISCUSSION: Mr. Bird explained to the Planning Commission that Mr .
Zabka wishes to create three frontage lots and create a separate
lot for the existing set of improvements presently on the property
../ for a total of five lots . All steps taken up to this point appear

to be in order. There is a provision for a 60' right-of-way
that would have access to Lot 4 . There is also a 20 ' dedication
of the right-of-way to the county along the frontage of the
property. Mr. Nix asked where the access would be. Mr . Bird
responded by saying it would be from County Road 41 . There would
be only one common access for the three lots. Ken McWilliams
then read the staff recommendation. No further discussion.
MOTION: Be it therefore resolved to recommend approval of the
preliminary plan to the Board of County Commissioners. Motion
by Jerry Kiefer , seconded by Harry Ashley. A vote of "aye" by

lumber yard and hardware store. IIe indicated he had checked with
the Town of Mead and they have no objections to the operation.
Ken McWilliams then read the staff recommendation and asked that
the Planning Commission take particular note of the Longmont Fire
Protection District letter in which they asked that adequate on-
site fire protection measures be provided . Mr . Hiatt indicated
he had site reviewed the area and feels the operation will
improve what is now existing there. Some discussion followed
regarding the sewer and water system.
MOTION: Be it therefore resolved to recommend approval of the
change of zone to the Board of County Commissioners. Motion by
Percy Hiatt , seconded by Marge Yost. A vote of "aye" by Ben Nix ,

Dear Sir:
Trinity Lutheran Church of Greeley,Colorado is planning on building a new church and
school on 35th Avenue immediately south of Sunset Memorial Gardens Cemetery. The
plot of ground is 8 1/3 acres, access to the property will be on 35th Avenue.
The building will have a total of 18,000 square feet which will be on two levels.
The upper level will house the santuary seating 400, a meeting room, and church offices.
The lower level will have six class rooms for 120 pupils for Day School and Sunday
School, a fellowship hall, library, and school offices.
The church has 900 members including children. The Day SChool will be open Monday
through Friday nine months a year for grades one through eight and kindergarten at a
later date.

The Trinity Lutheran Church Site Plan is unacceptable
to the Weld County Engineering Department and will not
be approved until the following problems are corrected:
1. Retention must be supplied for the runoff from the
southern drainage area. The amount of retention
which must be supplied is the 100 year runoff
volume in the developed condition less a release
rate not greater than the 5 year storm runoff in
the undeveloped condition .
2. The outfall at the southeast corner of the property
must be graded with a defined channel to insure
proper flow into the Greeley-Loveland Ditch.
3. Confirmation of permission to drain portions
of the property into the Greeley-Loveland Ditch
must be provided.
4 . Retention ponds which are used for sprinkling
system storage must be supplied with an outfall
line , the capacity of which should not exceed
the peak flow from a 5 year event . The
retention volume required for the 100 year event
must be supplied above the outfall , thus not
serving a duel purpose .
5. The outfall from the northeast retention pond
will not be allowed to drain into the Sunset
Memorial Cemetery unless the owners written
approval is received.

site. The following questions should be answered.
1. No drainage or detention computations concerning
storm water runoff have been supplied.
2. A detention pond has been indicated in the northwest
corner but no release structure is shown.
3. Both entrances appear to be at the crest of the hill
indicating no culverts are required; however, grading
should be done to insure no site water will flow on
the roadway . This should be indicated on the plan.

Following comments are made in relation to conditional use permit for construc-
tion of Trinity Lutheran Church in a portion of NW4j Section 24, Twp. 5N, Range
66W. The site is an eight and 33/100 acres located along 35th Avenue north of
Greeley-Loveland ditch and south of Sunset Memorial Cemetary.
Soil Suitability:
The site is comprised of Vona sandy loam, 1 to 3 percent slopes, which is a deep
well drained soil with a moderately rapid permeability and moderate available
water capacity. Surface runoff is slow and water erosion hazard is low. Light
surface texture does, however, present a wind erosion hazard.
The soil exhibits a slight limitation for construction of small commercial build-
ings and dwellings with basements. A standard footing design should be adequate
for construction. A moderate limitation does exist for use as a playground due
to slope and dusty conditions that would result from bare soil surface. The
limitation should be easily rectified with adequate landscaping plan.
Flooding Potential:
Evaluation of site and proposed land use of the area should not create flooding
nor is the site within an existing flood plain.
Planned Drainage System:
Evaluation of planned drainage system is difficult to assess as none was enclosed
with proposed site plan. However, the site location should not propose any sig-
nificant surface drainage problems. A provision in the plan shows a planned re-
tention pond in the northeast corner of the site which should allow for adequate
storage of surface runoff generated on the site.
Vegetative Protection and Erosion Control Plan:
Neither a vegetative nor an erosion control plan was submitted for
evaluation. The soil type does, however, exhibit wind erosion potential
due to the light soil surface texture. The maximum bare soil area
exposed would have to be 100 feet or less to keep expected soil loss
to less than 5 tons per acre per year. Therefore, it is essential
that bare soil areas be kept to the absolute minimum practical during
the construction phase to avoid severe wind erosion. Permanent or
temporary vegetative cover should be planted to provide soil protection
during the critical wind erosion period from January through May.
Topsoil should be stockpiled when possible to be replaced over fill
or cut areas to help insure reestablishment of permanent vegetative
cover once construction is complete.

This is to acknowledge your request for soils information for proposed
building site for the Trinity Lutheran Church and Church School to be
located on 8.3 acre site in the NW4j Sec. 24, Twp. 5N, Range 66W.
The building site is located on soil type Vona sandy loam, 1 to 3
percent slope. This is a deep, well drained soil en gentle plains and
high terraces. Typically the surface layer is a sandy loam about 10
inches thick. The subsoil is a fine sandy loam about 18 inches thick.
The substratum, to a depth of 60 inches, is a sandy loam or loamy sand.
Permeability is moderately rapid. Available water capacity is moderate.
Surface runoff is slow and erosion hazard is low.
The soil exhibits only slight limitation for construction of small com-
mercial buildings and dwelling with basements. A standard footing de-
sign should be adequate for construction. A moderate limitation, however,
does exist for use as playground due to the slope and dusty conditions.
These interpretations are based on the general soil characteristics and
indicates there is only a slight chance of encountering special physical
hazards which might limit construction or require special engineering
design. This report does not preclude an on-site investigation and tests
by a competent soils engineer should physical hazards be found.
A copy of the general soils description and soils map are included for
further information.
