RE: APPROVE ACCEPTANCE OF QUIT CLAIM DEED FOR PUBLIC RIGHT-OF-WAY AT
FOR IMPROVEMENTS TO COUNTY ROAD 49, BETWEEN 1-76 AND COUNTY ROAD
38 AND AUTHORIZE CHAIR TO SIGN ANY NECESSARY DOCUMENTS - THOMAS
D. CROGHAN LIVING TRUST AND MARY E. CROGHAN LIVING TRUST
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Quit Claim Deed from Thomas D.
Croghan Living Trust and Mary E. Croghan Living Trust, 8469 County Road 49, Hudson, Colorado
80642, commencing upon acceptance, with further terms and conditions being as stated in said
Quit Claim Deed; said property being described in Exhibit A, and
WHEREAS, after review, the Board deems it advisable to accept said Quit Claim Deed,
for Public Right-of-Way for improvements to County Road 49, between 1-76 and County Road 38,
a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Quit Claim Deed for Public Right-of-Way for improvements to County
Road 49, between 1-76 and County Road 38, from Thomas D. Croghan Living Trust and Mary E.
Croghan Living Trust, be, and hereby is, approved and accepted.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign any necessary documents pertaining to said Quit Claim Deed.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 8th day of February, A.D., 2016.

Anadarko, which owns the adjacent lot to the south of this property, acquired this quit claim
deed for the County at no cost to the County.

THIS DEED is made this (Q day of A , 2015, between, Thomas D. Croghan
Living Trust, dated August 26, 2011 and Vary E. Croghan Living Trust, dated August 26, 2011,
whose address is 8469 CR 49, Hudson, CO 80642,party of the first part and Weld County,
Colorado, a body politic and corporate of the State of Colorado, whose address is 1150 "O"
Street, Greeley, Colorado 80631,party of the second part.
WITNESSETH,that the said party of the first part, for sufficient consideration,the
receipt whereof is hereby confessed and acknowledged, has remised, released, sold, conveyed
and QUIT CLAIMED, and by these presents does remise, release, sell, convey and QUIT
CLAIM unto the said party of the second part, its heirs, successors and assigns, forever, all the
right,title, interest, claim and demand which the said party of the first part has in and to the
parcel of land situate, lying and being in the County of Weld and State of Colorado,to wit:
All of the real property described in the attached Exhibit"A."
TO HAVE AND TO HOLD the same,together with all the appurtenances and
privileges thereunto belonging or in anywise thereunto appertaining, and all the estate, right,
title, interest and claim whatsoever, of the said party of the first part, either in law or equity,to
the only proper use, benefit and behoof of the said party of the second part, heirs and assigns
forever.

A strip of land, Sixty (60) feet in width, being part of the East Half (E1/2) of Section Twenty—four (24),
Township Two North (T.2N.), Range Sixty—five West (R.65W.) of the Sixth Principal Meridian (6th P.M.),
County of Weld, State of Colorado, and consisting of the following three constituent parts:
1) The East Sixty (60) feet of Lot A, Recorded Exemption No. 1307-24-4—RE 112, recorded March 15,
1974 as Reception No. 1632044 of the records of the Weld County Clerk and Recorder;
