BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
SEPTEMBER 26, 2016
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, September 26, 2016, at the hour of 9:00 a.m.
El ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:

• MINUTES: Commissioner Moreno moved to approve the minutes of the Board of County
Commissioners meeting of September 21, 2016, as printed. Commissioner Conway seconded the
motion, and it carried unanimously.
• CERTIFICATION OF HEARINGS: Commissioner Cozad moved to approve the Certification of
Hearings conducted on September 21, 2016, as follows: 1) Hearing to obtain Public Input re: formation
of Charter Review Committee. Commissioner Moreno seconded the motion, which carried unanimously.
ID AMENDMENTS TO AGENDA: Commissioner Conway moved to add the following under New
Business: 4) Consider Agreement for Repairs to Bridge 58/47C and authorize Chair to sign — Naranjo
Civil Constructors, Inc. Seconded by Commissioner Cozad it carried unanimously.
• CONSENT AGENDA: Commissioner Moreno moved to approve the Consent Agenda as printed.
Commissioner Cozad seconded the motion, and it carried unanimously.
PUBLIC INPUT: No public input was given.
BIDS:
eg 1) APPROVE BID #B1600142, CNG 3/4 TON 4X4 FULL SIZE EXTENDED CAB PICKUP
W/UTILITY BOX (TOWN OF LASALLE) - DEPARTMENT OF PUBLIC WORKS: Rose Everett,
Department of Purchasing, presented the two (2) bids received and stated The Town of LaSalle
recommends awarding the second lowest bid from Spradley Barr Ford Lincoln of Greeley, in the amount

of $60,649.00. Elizabeth Relford, Department of Public Works, explained under this grant they are
required to go with the low bid unless it doesn't meet specifications. Commissioner Conway moved to
approve said bid. The motion was seconded by Commissioner Cozad, and it carried unanimously.
• 2) APPROVE BID #B1600143, CNG 1/2 TON 4X4 SHORT BED, EXTENDED CAB PICKUP
(TOWN OF LASALLE) (QTY. 2) - DEPARTMENT OF PUBLIC WORKS: Ms. Everett reviewed the two
(2) bids received and stated staff recommends awarding the low bid from Auto Nation Ford Littleton in
the amount of $81,614.00. Commissioner Cozad moved to approve said low bid. Seconded by
Commissioner Conway, the motion carried unanimously.
• 3) APPROVE BID #B1600144, CNG 3/4 4X4, FULL SIZE EXTENDED CAB PICKUPS (QTY. 2) -
DEPARTMENT OF PUBLIC WORKS: Ms. Everett presented the three (3) bids received and stated staff
recommends awarding the low bid from Spradley Barr Ford Lincoln of Greeley in the amount of
$85,042.00. Commissioner Cozad moved to approve said low bid. Seconded by Commissioner Moreno,
the motion carried unanimously.
• 4) PRESENT BID #B1600149, DOWNTOWN PARKING LOT CONSTRUCTION - DEPARTMENT
OF BUILDINGS AND GROUNDS: Ms. Everett presented the six (6) bids received and stated staff will
bring back a recommendation on October 10, 2016.
NEW BUSINESS:
El 1) CONSIDER INSTALLATION OF TRAFFIC CONTROL DEVICES ON VARIOUS COUNTY
ROADS: Janet Lundquist, Department of Public Works, reviewed the background on the intersections,
and reported the annual study of the intersections is to determine if they meet the Hazard Elimination
Study (HES) requirements. A crash analysis was completed for each of the seven (7) intersections. It
was determined that there is a safety issue concern. Commissioner Conway moved to approve said
installation of traffic control devices. The motion, which was seconded by Commissioner Moreno, carried
unanimously.
2) CONSIDER TEMPORARY CLOSURE OF CR 50 BETWEEN CRS 47 AND 49: Ms. Lundquist
reviewed the terms of the closure effective October 10, 2016, through October 14, 2016, for a culvert
replacement. She stated staff will use water for dust abatement. Commissioner Moreno moved to
approve said closure. The motion was seconded by Commissioner Cozad, and it carried unanimously.
El 3) CONSIDER TEMPORARY CLOSURE OF CR 76 BETWEEN CRS 49 AND 51: Ms. Lundquist
presented the closure request from North Weld Water District so they are able to install a water line, and
the temporary closure, which will be effective September 26, 2016, through October 15, 2016, will only
be closed during daytime hours. Ms. Lundquist explained the reasons for the lengthy closure and reported
the ADT for that section of roadway is 65 vehicles per day. Commissioner Cozad moved to approve said
request of closure. Seconded by Commissioner Moreno, the motion carried unanimously.
• 4) CONSIDER AGREEMENT FOR REPAIRS TO BRIDGE 58/47C AND AUTHORIZE CHAIR TO
SIGN - NARANJO CIVIL CONSTRUCTORS, INC: Mike Bedell, Department of Public Works, reviewed
the terms of agreement for repairs on the bridge rail due to a traffic accident. He explained that Naranjo
Civil Constructors will complete the repairs for the amount of $11,622.00. Commissioner Moreno moved
to approve said agreement and authorize Chair to sign. The motion, which was seconded by
Commissioner Cozad, carried unanimously.

5) CONSIDER SUSPENSION OF COLORADO RETAIL FOOD ESTABLISHMENT LICENSE -
MARISCOS Y TACOS EL TAPATIO: Deb Adamson, Department of Public Health and Environment,
introduced Marcela Swain Health, interpreter for the owners. Ms. Adamson stated one of the
requirements is for one of the owners or employees to become a certified food protection manager, so
that if one of the owners isn't on site, there is an employee with food safety knowledge, and she requested
the use of the $1,000 civil penalty to defray costs of achieving compliance. Dan Joseph, Department of
Public Health and Environment, presented the history of the statutory regulations which have been
violated. He stated the restaurant has received three (3) civil penalties in a 12 -month period and displayed
a slide presentation outlining the progression of the compliance and enforcement actions. He stated since
June, 2015, there have been four (4) regular inspections and four (4) follow-up inspections preformed,
during which 49 violations have been citied. Of the 49 violations, 42 were critical and of those critical
violations, 27 were foodborne illness risk factor violations. The violations are as follows: Improper cooling
of cooked foods and storage of raw animal foods stored over ready to eat foods. Mr. Joseph played
videos of rain water entering the walk-in cooler and dripping onto food stored on the shelf and of an insect
walking on the food preparation area. Mr. Joseph suggested the owners be on -site until all issues are
resolved. In summary, Mr. Joseph reviewed the recommendations from the Health Department.
El Commissioner Cozad asked for clarification on how long staff would recommend suspending the
license. In response to Commissioner Cozad, Mr. Joseph stated he would like the license suspended
until a consultant can be hired and there is evidence showing the owner will be on -site until a certified
food protection manager is trained. He stated things are not being maintained over the long run.
Magdalena Enriquez stated the restaurant opened in 2012. Mateo Enriquez explained he is the cook and
owner, and has been there for nine years and they have two (2) or three (3) other employees. Both
Mr. Enriquez and Ms. Enriquez report they are owners of the restaurant. Commissioner Cozad expressed
they need to have a food protection manager available when they can't be there.
Commissioner Conway asked the owners how they will ensure there is proper oversight at the restaurant
to remedy this violation. Ms. Enriquez stated they hired a consultant who came to train all the employees
on September 15, 2016, and recently they purchased and upgraded their equipment. In October, they
plan to send all employees to a class and will hire one to become the manager. In addition, they will
terminate the ones who are unwilling to follow the rules, and they plan to commit more time at the
restaurant. = Ms. Adamson stated she confirmed with the consultant that she was at the restaurant
on September 15, 2016, at which time training took place in the kitchen to work on several issues.
Mr. Joseph stated hiring the consultant is meeting one of the conditions. Chair Freeman stated he feels
like the owners and the Board have the same end oal in mind and would like the owners to commit to
being on -site and having the employees trained. = Mr. Barker clarified the $1,000.00 civil penalty and
suggested imposing the suspension collected in advance and held until all the conditions are met.
Commissioner Cozad moved to approve the resolution imposing suspension along with the civil penalty
and havie it held in advance, and she would like the Health Department staff to report to the Board within
60 days, with the conditions that the owner be on -site at all times and if it is found they are not on -site,
the suspension would be immediate. The motion, which was seconded by Commissioner Conway,
carried unanimously. Ms. Adamson clarified when staff does the follow-up inspection they will need
to return to the Board before the suspension in enforced. Commissioner Cozad thanked the owners for
working with Health Department staff, and said it was important they continue to work with the consultant
and make sure the employees are following all protocols. Mr. Barker requested November 28, 2016 be
added to the motion as the date the Health Department reports back to the Board.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
