RESOLUTION RE: ACTION OF THE BOARD CONCERNING REQUEST TO PURSUE ABATEMENT AGAINST MID PLAINS INVESTMENT, LLC, C/O RUSSELL RICHARDSON, FOR VIOLATION OF THE WELD COUNTY BUILDING CODE - BCV16-00020 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Mid Plains Investment, LLC, do Russell Richardson, is allegedly in violation of the Weld County Building Code, specifically a Dangerous Building which is alleged to be uninhabitable, and WHEREAS, despite efforts by the Building Compliance staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 20th day of July, 2016, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Mid Plains Investments, LLC, do Russell Richardson, were not present or represented at said hearing, although all parties were notified of said hearing by Building Compliance staff, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, and the recommendation of staff from Building Compliance and from the Planning Department, and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable refer to the County Attorney's Office for immediate action and staff is directed to pursue court action in the most efficient and expedient process. On February 19, 2015 I, Weld County Building Official Frank Piacentino, and Compliance Officer Pamela Bland spoke to you regarding the condition of this property. As we described to you on the phone, there have been several complaints regarding the property. This includes individuals trespassing, dilapidated structures, and other issues. The Sheriff's department has responded to the location and found individuals inside the buildings. No one should be occupying the property or accessing the property. There currently are no valid building permits, and the house previously was subject to an abatement order and was boarded up. As a result, no one should be at the property, inside the buildings, or working on the property. Any persons doing so risk potential arrest. You indicated that upon your release, scheduled for May 18, 2015, you would like to begin the process of renovating the property. We would be happy to work with you to accomplish this goal. However, prior to beginning any work on the property you must meet with the Planning and Building Department of the county and obtain all necessary permits. Further, no one can occupy the premises until a certificate of occupancy has been obtained. If you do not comply with the Weld County Zoning and Building requirements the County may pursue any number of actions to ensure compliance. This could include a civil lawsuit, an injunction, a criminal charge, and significant fines and expenses. Upon arrival fire department found that the property occupant was burning large limbs very close to a structure. The property occupant was asked to show documentation of a valid burn permit; which he did not have on scene. The fire was extinguished and no citation was issued. We researched our records and determined that no burn permit is on file. Beyond the illegal burning issue, the property occupant was agitated with our fire crews and law enforcement had to be called to ensure for the safety of our crews extinguishing the fire. We also received a telephone complaint from a neighbor stating that the property occupant was hauling trash into the site and burning it; I cannot confirm this complaint. The Greeley Water Department caught someone at this location illegally using the fire hydrant there. This had been reported by a resident but not confirmed until today. The water department had Weld Sheriff's Deputy respond and notify the occupant that it was illegal to use the hydrant and a pipe wrench they were using to operate the hydrant was confiscated. No citations were issued to my knowledge. Hopefully this helps your case.
