HomeMy WebLinkAbout20160628.tiff RESOLUTION RE: GRANT APPEAL, IN PART, CONCERNING REQUEST FOR ACCESSES ON COUNTY ROAD 84, PERMIT AP15-00501 - HIGHLAND INDUSTRIAL PARK, CIO CLIFF SIMPSON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on February 3, 2016, the Board of County Commissioners heard an appeal from AGPROfessionals, on behalf of Highland Industrial Park, do Cliff Simpson, concerning the decision by the Department of Public Works to deny the application for two additional Accesses, AP15-00501, for a total of five (5) accesses along County Road 84 west of County Road 33, at which time the Board deemed it necessary to continue this matter to February 17, 2016, to allow Public Works staff and the applicant time to meet with representatives from the Town of Ault and potentially revise the request, and WHEREAS, pursuant to Weld County Code Sections 2-4-10 and 12-5-100, such appeal to the Board is considered to be "de novo," and WHEREAS, on February 17, 2016, upon consideration of all of the evidence presented, including a review of all additional information submitted by AGPROfessionals, on behalf of Highland Industrial Park, do Cliff Simpson, and the Department of Public Works, the Board deemed it advisable to grant the appeal, in part, and approve the application for Access Permit, AP15-00501, for a total of two (2) accesses along County Road 84, east of County Road 33. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the appeal of AGPROfessionals, on behalf of Highland Industrial Park, do Cliff Simpson, is granted, in part, and Access Permit, AP15-00501, be, and hereby is, approved for a total of two (2) accesses along County Road 84, east of County Road 33. BE IT FURTHER RESOLVED by the Board of County Commissioners that the issuance of AP15-00501 is conditional upon the following: 1. The applicant shall enter into an Improvements and Road Maintenance Agreement with the County of Weld concerning County Road 84. 2. The applicant is requesting five additional access points off of CR 84 east of CR 33 . CR 84 is an arterial roadway and CR 49 is a local roadway . The denial for the access request is due the following : i 1 . The access would be a net increase of accesses . The parcel currently has three existing access points . One existing access point onto CR 33 which is maintained by the Town of Ault and two AG accesses onto CR 84 . The applicant is going through the development review process in the Town of Ault . Upon review of this application Public Works staff recommends utilizing or relocating the two existing access points onto CR 84 but denies the addition of the other access points . Please see the attached aerial map , application materials , and letter from the applicant. The Weld County Code language is listed below: Sec . 12-5-30. Regulation of access onto County roadways . A . One access per lot. Direct access from a public road shall be limited to not more than one ( 1 ) per legal lot, except as may be expanded or further limited or restricted by the Board of County Commissioners or staff, as a result of zoning requirements , consideration in land use applications , safety considerations , subdivision regulations , or inability to meet minimum requirements as defined in the Weld County Design Criteria . E . Additional access . If a new access is requested to a legal parcel where an existing access already exists , the additional access shall not be approved unless the denial of the new access creates undue hardship on the property owner , as determined by the Department of Public Works . The subject property is zoned I-industrial . The proposed � p p industrial development is bordered on the west by WCR 33 and beyond is developed Y p agriculture. To the south is WCR 84 and beyond is developed agriculture. To the north and east are developed agricultural properties. gri p pertles. Two accesses have been informally approved by staff and access permits are anticipated for the subdivision roadway system: Rylan and Teagan Avenues (See attached Exhibit A) . Request: The applicant wishes three additional accesses to WCR 84, and respectfully p Y requests a variance from the Weld County Road Access Policy that allows only one ( 1 ) access per lot. Two additional accesses are requested for service road access only. The two additional accesses described above are approximately 780 feet and 2000 feet east of WCR 33 . One additional access is requested for Lot 15 . The access to Lot 15 is approximately 395 feet east of WCR 33 . Weld County Code Reference: Section 12-5 - 10 describes the intent of the Road Access Policy as : "This Article is established for the safe and efficient movement of traffic while allowing reasonable access to properties. "Access Permit Required: Any person constructing a new access onto a County road, or reconstruction, paving, altering, enlarging, or changing the use of any existing access onto a County road, must first be issued access by the Department of Public Works. No such work shall commence prior to the issuance of an Access Permit. " Section 12-5-30(E) provides Regulation of access onto County roadways. "Additional Access: If a new access is requested to a legal parcel where an existing access already exists, the additional access shall not be approved unless the denial of the new access creates undue hardship on the property owner, as determined by the Department of Public Works. Whenever multiple accesses to a single legal parcel exist, and additional accesses are requested, one (1) or more existing accesses must be removed, minimizing new accesses and utilizing existing accesses. 4 Rationale: Accesses to the two service roads are necessary for maintaining public improvements such as sewer and water main. The service roads shall be maintained by the Owner' s Association and will be constructed to Weld County Standards. Access for Lot 15 will be the only legal access for the Lot. The requested variance e allows for reasonable access to the property. The overall affect of the proposed additional accesses will be minimal to traffic efficiency.
