WHEREAS, it has been determined by the Board of County Commis-
sioners, Weld County, Colorado, that Frank Vetter and Clara Vetter, hus-
band and wife, are owners of a parcel of land described as follows:
That portion of the East Half of the Northeast Quarter of
Section 35, Township 5 North, Range 67 West of the 6th
Principal Meridian, County of Weld, State of Colorado,
more particularly described as follows:
Beginning at the Northeast corner of said Northeast Quarter
thence along the East line of said Northeast Quarter South
0020'30" West 2502. 65 feet to the Southeast corner of said
Northeast Quarter; thence along the East West center line
of said Section North 89°52'18" West 1316. 49 feet to the
West line of said East Half; thence along said West line
North 0°15'22" East 2489. 90 feet more or less to the North
line of said Northeast Quarter thence along said North line
East 653. 10 feet; thence South 4°10' East 292. 01 feet; thence
South 40°05' East 162. 00 feet; thence South 61°55' East 80. 00
feet thence South 76°50' East 66. 50 feet; thence North 2°04'
East 468. 30 feet to the North line of said Northeast Quarter;
thence along said North line East 382. 00 feet more or less to
the point of beginning, and
WHEREAS, Mr. and Mrs. Vetter are desirous of splitting approximately
. 78 acres from the hereinabove described tract of land, and
WHEREAS, it appears that a lot size variance first must be obtained
before applicants may apply for the Recorded Exemption from the subdivision
regulations of Weld County, as the same is defined in Section 9-4 of the Weld
County Subdivision Regulations, and
WHEREAS, in addition to evidence presented by the applicants, the Weld
County Planning Commission Staff has presented evidence and made representa-
tions concerning the desirability of granting said variance, and
WHEREAS, the Board of County Commissioners feels that when all of
the evidence and representations are considered, good cause for granting a
variance as requested from the minimum lot size requirements of the Weld
County Zoning Resolution has been shown.
NOW, THEREFORE, BE IT RESOLVED, that pursuant to the powers
granted to the County under Title 30 C.R.S. 1973 and Section 9-4A (6), Weld
County Subdivision Regulations, as amended; that Frank Vetter and Clara
Vetter, husband and wife, may proceed to apply for a Recorded Exemption and
the lot size variance is conditioned on the applicants applying for and doing all
necessary to obtain said Recorded Exemption within one (1) year, and said
variance is limited to Mr. and Mrs. Vetter and will terminate if they sell or
otherwise discontinue their interest in the above mentioned land prior to ob-
taining approval for and recording the above mentioned Recorded Exemption.

Dear Sirs:
This letter is in reference to a request, by Frank and Clara Vetter,
for a Lot Size Variance and a Recorded Exemption on property located
in the Eli NEa of Section 35, T5N, R67W of the 6th P.M. , Weld County,
Colorado. The parcel contains approximately 75.62 acres and they
desire to split approximately .78 acres from the parcel .
Section 9-4 A. (6) of the Weld County Subdivision Regulations of Re-
corded Exemption states:
"That the original tract or parcel of land to be divided
under this Section meets the minimum lot size require-
ments established by the Weld County Zoning Resolution;
variance from this requirement being allowed only upon
good cause being shown to the Board of County Commis-
sioners or where said tract or parcel of land lies with-
in the comprehensive plan area of an existing incorpor-
ated town of Weld County. (Rev. 4/17/74)"
Based on the information submitted and the Weld County Regulations
the Planning Commission staff recommends approval for the following
reasons:
1 . The proposed split complies with the Weld County
Comprehensive Plan, and Subdivision Regulations
for Recorded Exemption, Section 9-2, in that the
intent of the split is to promote agriculture.
The parcel to be split is to be utilized by the
Vetter's son who will farm the property. Also
the parcel to be split is a non-farmable piece.
