COLO4 The Weld County Council met in regular session in full conformity with the Weld County Home Rule Charter at 401 N. 15th Avenue, Greeley, Colorado, on Wednesday, October 6, 1976 at the hour of two o'clock. ROLL CALL: The meeting began with an invocation by Mr. John T. Martin, President. On roll call the following were present: President, John T. Martin Vice President, Nancy Clark Councilman Floyd Oliver Councilman Bob E. White Councilman Robert Martin Also present: Bonnie Hickman, secretary; and two members of the press. MINUTES: The minutes of September 15, 1976 were accepted unanimously, by motion of Floyd Oliver and second by Nancy Clark. REPORTS WELD MENTAL HEALTH: Bob White discussed the Weld Mental Health organization and their request for county funding. Council members commented on the organization's association with the County in regard to the provision of services to them. Some felt the County should contribute to this organization. SPECIAL LEGAL COUNSEL: Robert Martin reported that $1,870.00 was spent on special legal counsel after the fulltime county attorney was hired and during September, $2,293.09 was paid out. He remarked that it seems nothing is being done to rid the county of the special legal counsel and noticed that money is being set aside in next year's budget for the same use. PROPOSED CHARTER AMENDMENT: Nancy Clark reported that Mr. David, County Attorney, has not yet contacted her as to his opinion of amending Charter Section 3-3-(4b). SUMMARY OF LEASE-PURCHASE OF ROAD GRADERS: Robert Martin referred to his report of September 14, 1976 regarding the "Summary of Lease-Purchasing of Road Graders. " Council members discussed the benefit of buying one quality brand of highway equipment to save on maintenance costs and to insure a higher resale value. 760689 County Council Minute: Page 2 October 6, 1976 CORRESPONDENCE: Each council member received a letter and booklet prepared by the District Attorney entitled, "Attorney and Investigator Salary Justification Program." Discussion on this was tabled. The League of Women Voters presented to each council member a copy of "Know Your Town Study" of Johnstown and Milliken. Mr. John Martin read a letter from the Weld Health Department congratu- lating him on receiving the Ft. Lupton Outstanding Citizen's Award. RULES AND REGULATIONS: Bob White made a motion, seconded by Robert Martin, to delete the last part of number 13 on page two of the council's Rules and Regulations and Procedures which reads - "and shall not be published within sixty days prior to a general election. " Motion carried. RULES OR ORDER: The Council discussed the necessity of adding a clause to the Rules of Order which would allow the Council to dismiss into executive session. Nancy Clark will discuss the legal implications with Robert Miller, District Attorney, and report later to the Council. GENERAL TOWNS MEETING: Council members expressed a positive appreciation of the September 24 General Towns Meeting. Mr. White suggested the possibility of including county agriculture leaders at such meetings. BUDGET: The council's role in the 1977 Budgetary Proceedings was discussed. Among other things discussed were the county salary scale, the road and bridge department, and the hiring of a performance auditor. There being no further business, Bob White moved the meeting be adjourned, with Robert Martin seconding. Mr. John Martin adjourned the meeting. Council Sept. 14th 1976 From the information furnished, it i}clear that on the basis of bids submitted, the commissioners accepted the second highest bid this being $416, 772 . 00 from McCoy Co. , the other high bid was $42.0, 968. 88 from Larimer Equip. Co. The low bid being $347, 027. 34, or .$69, 745. 00 less than the bid accepted. This bid was submitted by MacDonald Equipment Co. These bids all being for Lease-Purchase over a period of 3 years. Taking a cash purchase bid, the Commissioners took the highest bid, this being $342, 252. 00 from McCoy Co. , this price being $4775. 34 less than the total cost of Lease- Purchase from the MacDonald Co. The MacDonald Bid was the low bid being, $245, 988. Q0 for cash ,Purchase, which was $96, 264. 00 less than the McCoy bid. It is apparent from the comparison of the above figures that from the stand-point of dollars, the tax-payers were ill served in the above transaction. On the basis of cash cost, the commissioners paid out $69, 745. 00 more than the MacDonald lease purchase bid, om=.3-erase. Had they . decided to purchase outright, the MacDonald bid would have been .$96, 264.00 less, As pointed out in paragraph 2, had the Commissioners been interested in getting the best possible deal and not been committed to large cash outlay, the MacDonald lease-pur- chase would have allowed them the best of both worlds in that the total price with MacDonald was only $4775. 34 more than the cash price of the McCoy graders.
