WHEREAS, a public hearing was held on September 20, 1976 in the Chambers of the Board of County Commissioners , Weld County, Colorado, for the purpose of hearing the petition of Amoco Production Company, Security Life Building, 1616 Glenarm Place, Denver, Colorado, requesting a Special Use Permit for the expansion of a gas processing plant located on a parcel of land in Township 2 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows : Section 34 : Beginning at the Southwest L Corner of Section 34, thence 660 feet East; thence North 990 feet; thence West 660 feet; thence South 990 feet to the point of beginning, containing 15 . 00 acres , more or less . Dated the 13th day of August 1976 Secretary • Amoco SUP 314 Development Standards 1 . The permitted uses on the subject property shall be a spindle gas processing plant facility. The facilities shall be limited to those shown on the Special Use Permit plans. 2. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 3. A landscape screen shall be planted around the perimeter of the Special Use Permit area in conformance with the recommendations of the Soil Conservation Service. 4. All aspects of the facility including noise levels and sanitary fac- ilities shall be in compliance with applicable State Health standards and regulations. 5. Access shall be limited to the two points shown hereon. 6. Upon cessation of operations of this spindle gas processing plant facility, all structures shall be removed to 30 inches below grade and the Special Use Permit area shall be graded level . 7. An accoustical stack shall be installed on each of the fourteen com- pressors located within the Special Use Permit area as designed by Engineering Dynamics, Inc. Noise emmissions from the gas processing plant facility with the addition of 6 more compressors for a total of 14 compressors shall not exceed the current noise emmision levels as set forth in a report entitled "Prediction of Noise Levels from Proposed Addition of Six Compressors to the Existing Spindle Gas Plant of the Amoco Production Company" which was prepared by Engineering Dynamics, Inc. 8. The Special Use Permit shall be limited to the plans shown hereon and governed by the development standards stated above. Any changes to the plans and/or the development standards shall require the approval of another Special Use Permit before such changes shall be permitted. RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners approval of this request for permanent zoning subject to staff recommendations. Motion by J. Ben Nix. Mr. Fortner requested flexibility to enable staff to reword item #1 (in reasons for approval ) for clarity. Sec. 33 T6N R67W SUBJECT: Zone change "I" to "A-UD" and Open Cut Mining Permit APPEARANCE: Jim Mueller DISCUSSION: Mr. Mueller explained that this request is to allow Eastman Kodak to have an economical source of film material for future building. Comprises approximately 15 acres. While it will be a long term use, the actual period of time that work will be done is six to eight weeks. There will be three to eighteen month periods when no work at all is done. This is located in the bluffs along Kodak' s south property line, After completion of this project, approximately 10 acres will be used as irrigated farmland. No pit is involved. Water table will not be exposed. Mr. Mueller has recommendations from the Soil Conservation Service for seeding, topsoiling, etc. These recommendations are included on the plat, Weld County Planning staff recommends approval for the following reasons: 1 ) The request is in compliance with the Weld County Com- prehensive Plan and the Weld County Extraction Plan, Mineral Resources Volume II. The area in question is non-irrigated. The Weld County Extraction Plan states that extraction shall be accomodated in non-irrigated areas so long as appropriate extraction and reclama- tion standards are followed. The extraction and reclamation stan- dards are set forth which comply with County standards on the plats; 2) The Weld County Health Department has indicated the proposal is in compliance with the State Health Standards and regulations; and 3) The Town of Windsor has indicated the town has no objections to the proposal . ADDITIONS TO EXTRACTION STANDARDS: 1 ) Any new access onto County Road 62 shall be approved by the Weld County Engineering Department prior to installation. CHANGE TO RECLAMATION STANDARDS: 1 . Reclamation standard number 2 shall be changed to read, "Final slopes shall be 3: 1 minimum." This is a result of a recommendation from the Colorado Geological Survey. RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners approval of this zone change request from "I" to "A-UD" subject to staff recommendations. SW4 SW4 Sec. 16 T5N R65W SUBJECT: "E" to "C" , Final Site Plan and Recorded Exemption APPEARANCE: Doug Sears • DISCUSSION: Mr. Sears explained that this is the property at the intersection where Highway 34 will go east from U.S. 85 Bypass and 1st Avenue. There is just a little over 10 acres in the parcel . The Weld County and Greeley Comprehensive Plans do call for industrial useage in this area. Mike Nabors, McDoy Distributing , was with Mr. Sears. He is an intended user for one of the tracts. This is why application for Recorded Exemption is being made. Mr. Sears explained that it was the Planning staff's recommendation to go through application for Recorded Exemption rather than platting the land. Weld County Planning staff recommends approval for the following reasons: 1 ) The requests comply with the Weld County Comprehensive Plan since the development is adjacent to the City of Greeley and the uses comply with those proposed in the City of Greeley Comprehensive Plan; 2) The City of Greeley has recommended approval of the requests; 3) The Weld County Health Department has indicated the soils in the area are suitable for individual sewage disposal systems; and 4) the Western Hills Fire Department has indi- cated they have no objections to the proposal . RECOMMENDATION OF APPROVAL IS CONDITIONAL UPON: 1 ) A guarantee that the developer is obtaining water from the City of Greeley and has an approved con- tract for water service and installation of the water line: The developer shall submit said contract to the Department of Planning Services prior to advertisement for the Board of County Commissioners' hearing; 2) The letter as submitted dated July 30, 1976, to be signed by McDoy Distributing Company and Sierra Investment Company prior to advertisement for the Board of County Commissioners' hearing and that portion of said letter in quotes be made a condition of approval in the resolution by the Board of County Commissioners; 3) The Grant of Right-of-Way and Easement" and "Warrenty'Deed" documents being made a part of the approval by the Board of County Commissioners such that copies of the recorded instruments as attached be submitted to the files of the Planning Commission and Board of County Commissioners subsequent to recordation; 4) Limitation of access onto the future State Highway frontage road to two access points as requested by the State Department of Highways; and 5) Final approval from the City of Greeley on the drainage study submitted for Parcel A of the Recorded Exemption prior to advertisement for the Board of County Commissionrs' hearing. COMMENT: The City of Evans gave no response to the referral sent to them on these requests by Sierra Investments Company. Mr. Sears explained that he was unaware of the requirement for contracting with the City of Greeley for water. The property is within and is being served by a viable water district. He questioned the legality of the County making this requirement. He explained that the City is expanding and picking up boundaries within the water district, but at present, Delta can serve the property. Page 1311 Mr. Honn explained that the applicant had named the City of Greeley as being the source of water. Proof that water is available is all that is necessary. John Watson, representing Industrial Acres, read letter dated July 30, 1976 into record. Industrial Acres strongly opposes rezoning a small piece of property such as this, without giving consideration to the entire area. They feel this is spot-zoning and is not in compliance with Weld County and the City of Greeley Comprehensive Plan. Jim Smith, partner in Industrial Acres, explained that he owns a parcel of land just to the north. He envisions the Planning Commission's role as one of not reacting to a certain situation, but one of leading forward. Basically, Industrial Acres was requesting to be rezoned at the same time as the property of Sierra Investments is. Mr. Heitman explained that the only reason Sierra Investments is being considered today is because they have a specific use in mind and have requested a change of zone. Industrial Acres has not made that type of application. Mr. Smith said it is conceiveable that Industrial Acres could be re- zonelas Residential because there is residential property to the north, or it could be rezoned as commercial because there is commercial property to the south. He feels that Industrial Acres needs a frame- work so they know where they fit in. He is concerned with what type of buffer will be used between properties. Roy Lundvall was also present as a partner in Industrial Acres. Mr. Sears stated that Mr. Watson was talking as though he is a very naive citizen of Weld County, when in fact he has served on the Planning Commission Board for a good many years. He stated that Mr. Watson most definitely knows what is going on because he helped to create the Weld County Comprehensive Plan. Mr. Sears explained that he had an informal conversation with the partners from Industrial Acres prior to this hearing. The plant is located about 4 miles west and 2 mile north of the Town of Ft. Lupton at the intersection of County Roads 14 and 19. Natural Gas which is produced with oil from the spindle and single tree fields is processed here. Liquids which are removed from the gas include ethane, propane, butane and pintane +. These liquids are removed and stabilized and put in a surge tank where they are then delivered from the plant by pipeline. All liquids leave the plant in a mixed stream. The residue gas is sold to Colorado Interstate Gas Company. It also leaves the plant by a buried pipeline. Plant is designed as a completely closed system. There are no specific odors connected with the process. All compressor units are equiped with exhaust silencers and compressor buildings are completed with noise insulation. Proposed addition to the plant involves the addition of six compressors and some plant processing equipment. The plant processing equipment would increase the plant capacity approximately twelve million cubic feet per day. The new equipment is indicated to be parallel to existing equipment. Plant is operated on a round- the-clock basis. Water is supplied by a water well at a plant site in the vicinity of the plant office. No expansion of the water supply will -be required. No additional road requirements are necessary as a result of this proposed expansion. Robert Chinaud, Engineering Dynamics Incorporated, was consulted by Amoco to survey the noise increase. The new compressors will actually be farther away from the existing residences. The survey shows the existing noise level at 53 decibels. The increase in compressors would create an increase of 2 decibels in noise level . Mr. Lang explained that acoustical barriers can be installed on the stacks of the compressors to help with the noise problem. Dr. Chinaud will be designing these barriers. Planning Commission staff indicated that it would be desirable to have some type of screening on the site. Mr. Lang explained that the site is well maintained and is actually weed free. Mr. Lang also explained that trees had been planted on the site in the past, but when the site was sprayed to kill the weeds, the spray also killed the trees. Page 1313 Weld County Planning Commission staff recommends the request be tabled for the following reasons: 1 ) Letters of opposition to this proposed expansion have been received from August Gittlein, William Gittlein, and Mr. and Mrs. Sheldon Sickler. Copies of those letters are included in an attached packet; 2) Noise has been identified as one of the problems in the area by the surround- ing property owners. The Planning Commission staff has requested a noise study be done which would indicate: A. The noise level of the existng operation; B. The noise level of the facility with the proposed expansion; and C. How these noise levels com- pare with acceptable noise level ratings at the perimeter of the Special Use Permit area and also at the nearby residences. The requested noise study has not been presented to date; 3) In December, 1972 when the Special Use Permit was granted for the original facility, there was to be a landscape screen planted around the perimeter of the area. According to Amoco, trees were planted, but later died from a dust applied to control weeds on the internal area of the facility. The Planning Commission staff has requested the applicant to develop a landscape plan for visual and noise screening purposes to be plantediaround the perimeter of the Special Use Permit area to be in compliance with the recommendation of the Soil Conservation Service. This has not been done to date; and 4) Another sheet to the Special Use Permit plans needs to be submitted to include the proper certificates and development standards. William Gittlein was present. He lives on Road 19 just south of the plant. He was concerned about the noise, dust and traffic. He stated that a good percentage of the traffic is related to the plant. Dr. -Chinaud explained his ideas for designing noise barriers. He stated that the increase in noise would not be very detectable with the addition of new compressors. The Weld County Planning staff recommends denial for the following reasons: 1 ) The proposal at hand is inconsistent with the Weld County Comprehensive Plan. The Plan states that agriculture is a resource in Weld County which must be protected from the impacts of urban growth. To accomplish this objective, the plan states that urban residential , commercial , and industrial uses will be encouraged, to located around existing urban centers so that their impacts will be minimized, and so that the cost of providing the services associated with such uses will be minimized to the greatest extent possible. Inthe pending proposal , the pro- posed use is not an agriculturally related use, but is an urban residential use proposed for a predominately agricultural area. The proposal sets forth no evidence that the use is related to in- tended agricultural uses of the land in question. The subject property is in fact one of several approximately 35-acre parcels which were split out of the SW of Section 5, Township 3 North, Range 68 West of the 6th P.M. , since 1972 when said quarter section was one agricultural unit. The land in question consists primarily of Class II soils which are classified as prime agricultural soils by the Soil Conservation Service. The area could easily support agricultural uses if urban encroachment on the land does not occur; 2) The granting of this request would enhance the conflict between basically incompatible uses, i . e. the traditional conflicts between urban and agricultural uses; 3) If such urban residential uses, as proposed in the pending appl4cation are allowed to occur, the cost of providing services to such rural areas can only be increased, thus resulting in over- all increased costs to the taxpayer. As stated by the Weld county Comprehensive Plan, such uses should be encouraged to locate around existing urban centers, where the base for providing such services is already established; and 4) Finally, if such development is encouraged, more and more agricultural lands will be split into parcels which are basically too small to support viable farm operations, and too large to be maintained properly by those who work in the city but live in the country. As a result of the latter factor, additional conflicts with surrounding agricultural uses occur. Tom Honn explained that the Planning Commission staff has not been able to understand where the deeds describing the property match the description submitted by Carol Lee. Other trainers in the area will also use the track. Traffic will not be increased by this track. Mr. Anderson explained that training will be com- pleted by 10:00 each morning because the dogs can't run in the heat of the day. The track will be used as long as possible except for months when the ground is frozen. There is no other facility like this in Colorado. This facility was approved for Mr. Anderson's own use and has already been constructed. Construction was started last April . Mr. Anderson does not feel that this will encourage other breeders to come into this area. I am attaching hereto three copies of a plot plan for the Spindle Gas Plant which reflects some changes which should be made in the plant facility to permit handling additional gas through the facility. As mentioned to you in a recent conversation, the installation of our Spindle Plant was authorized by the Weld County Board of County Commis- sioners in November, 1972. Subsequent to that time, in February, 1973, we recognized a need to make some modifications in the plant to increase the recovery efficiency of the facility. We prepared a revised plot plan indicating the proposed changes and reviewed our proposed modifications with the Planning Director and the County Commissioners at an informal meeting. The Commissioners determined at that time that the installation of our gas facility had been previously authorized and that the County Commissioners' approval of our proposed changes as indicated on the plot plan would provide the necessary authority for us to obtain building permits and proceed with the proposed work. We are again faced with an opportunity to make changes in our facility to increase the recovery of LPG products from the plant. Any changes which result in increased recovery of petroleum products will be beneficial, not only to Amoco, but also to Weld County. We are anxious to proceed with this work as soon as possible, and we will, therefore, appreciate your assistance in helping us to obtain the County Commissioners' approval with the least possible delay. It would appear from the 1973 precedent that an informal review of proposed changes with the Commissioners should suffice and we hope this is the case. This report is submitted in response to the request that the increase in sound levels ad- jacent to the nearest residences to the Spindle Gas Plant be assessed . This request was made by Mr. John E. Lang of the AMOCO Production Company. Noise Measurements In preparation for predicting noise levels from a proposed AMOCO station, sound measurements were made surrounding the Spindle Gas Plant. A detailed account of the measurement methodo- logy and analysis is provided in that report to AMOCO dated February 14, 1975 and entitled : Prediction and Control of Poten- tial Noise from AMOCO Production Company, West Spindle Compressor Station. The results included the following sound power (Lw) calculations. The DL for loudness is generally found to be 1 dB. Therefore the predicted change in ambient sound level of 2 dB should be just noticeable more than 50% of the time, if the 2 ambient levels were presented in quick succession for comparison, which will not be the case. ( , nomc `s 'rll , WIPP SPECIAL USE PERMIT Spindle Plant Expansion Description of Operations The Spindle Gas Plant processes natural gas which is produced with oil from the Spindle, Surrey, and Singletree fields in Weld County, Colorado. All of the gas from the Singletree, Surrey and West Spindle area is collected at approximately 25 psig, compressed in satellite compressor stations and delivered to the plant at approximately 400 psig, and then further compressed at the plant to 700 psig, the processing pressure. The remainder of the gas from Spindle is collected at 25 psig, delivered to the plant and compressed up to process pressure. At process pressure the gas is chilled by propane refrigerant and expander-induced refriger- ation. Condensed natural gas liquids including ehtane, propane, butane, and pentane plus, are removed and stabilized, delivered to a surge tank, and transported from the plant by pipe line in a mixed stream. Residue gas is sold to Colorado Interstate Gas Company at 700 psig. The plant is designed as a completely closed system and under normal oper- ations there is no venting of hydrocarbon vapors. In the event of a plant shut-down and depressure, hydrocarbon vapors are relieved to a flare system and burned in a smokeless flare stack. The plant processes sweet gas, there- fore, there is no significant odor connected with the process. All compressor engines are equipped with exhaust silencers and the compressor building is complete with noise insulation to reduce noise level. Drips and floor drains are connected to a sump. Collected liquids in the sump are pumped to treat- ing facilities, then to storage, and trucked from the plant. Proposed revisions to the plant involve the addition of equipment to increase the plant capacity by approximately 12 MMCFD. The additional gas is made available to the plant by the 40 acre development in the Spindle area. The new equipment will parallel the existing equipment and the process will be the same as that in the present plant which is operating under a special use permit granted by the Board of County Commissioners on November 29, 1972. Water Supply Water requirements for existing plant are supplied by a water well at the plant site in the vicinity of the plant office. No expansion of the existing water supply will be required. Sewage or Waste Disposal The existing sewage dispersal field will be expanded to accomodate additional employees. Plans for this expansion will be cleared with the Weld County Health Department. -2- Trash and other solid waste materials are accumulated and hauled from the plant site by a local trash disposal company. Operations 24 Hr./day operation, 365 days/yr. 3-8 Hr. shifts/day Maximum anticipated number of employees - 19 All process fluids contained in closed systems with no waste liquid dis- charges from the plant area. The soil is mottled from 10 inches downward and may or may not have a water table within 60 inches. Olney sandy loam is a deep well drained soil. Water intake is medium to rapid and water holding capacity is fair. Vona sandy loam is a deep well drained soil with a moderately light textured surface and subsoil. The subsoil is weakly developed. This investigation was made to evaluate subsoils for foundation bearing capacities . Our opinions follow based upon results of this investigation , and upon our experience with soils in this area . UMMARY I . Subsoils consisted of loose sands and sandy clays of medium stiffness overlying clay shale bedrock. Ground water was present at a depth of 11 feet . 2 . Maximum allowable bearing values recommended are presented below by soil classification. Loose Sands 2 ksf Footing Foundations Clays , sandy 3 ksf Footing Foundations Bedrock Shales 20 ksf (Drilled Pier Founda- tions) NOTE : Three feet of soil cover should be provided above bearing elevations of footings for frost protection. 3 . Soils and ground water present conditions for potential sulfate attack of concrete . Type V cement is recommended in all concrete exposed to soils to resist this attack . DISCUSSION 1 . SITE LOCATION This site is located east of Weld County Road 19 in the SW/4 Section 34 , T 2N, R 67W, Weld County , Colorado . This tract is 660 by 990 feet in dimension . The site is vacant . 2 . PROPOSED CONSTRUCTION An installation of gas processing equipment is planned . Types of equipment , locations and foundation loads are not known to the writer . 3 . SUBSOIL EVALUATION Test holes were drilled at 2 specified locations by means of power-auger drilling equipment . Undisturbed soil samples for laboratory testing were secured by means of thin-wall sampling equipment . Test hole locations are Ls -1- f • • shown in Figure No . 1 ; boring logs are presented in Figure No . 2 . Test holes disclosed the presence of loose fine sands • to a depth of 3-1/2 feet in Test Hole No . 1 . Sands are underlain by sandy clays of medium stiffness . Weathered clay shale and clay shale bedrock are present below the clays . The soil profile for Test Hole No . 2 is similar to that for Test Hole No . 1 except that there are no sands present . Ground water was present at a depth of 11 feet . Physical properties of soils were evaluated by results of the following tests . Standard Penetration Tests - See Figure No . 2 Natural Moisture-Density Tests - See Figures 3 and 4 Swell -Consolidation Tests - See Figures 3 and 4 Test results indicate the shallow soils are not expansive when wetted , and are competent to support light foundation bearing pressures . The bedrock shales are competent to support concentrated foundation loads . 4 . FOUNDATION RECOMMENDATIONS The shallow soils are suitable for support of lightly loaded continuous or spread footings . Footings should bear at a depth that will provide 3 feet of soil cover above their bearing elevations . Maximum allowable bearing pressures recommended are presented below by soil classifica- tions : Loose Sands : 2 ksf Clays : 3 ksf Drilled , cast-in-place piers may be used for support of foundations , grade beams and columns . Piers should penetrate bedrock shales a minimum depth of 4 feet . Piers may be designed on an end-bearing pressure of 20 ksf, and should carry a minimum dead load of 10 ksf in end-bearing to resist uplift from expansion of the weathered shale section. Side shear of 2 . 0 ksf may be used in addition to end-bearing , based upon the lateral area of the pier penetrating bedrock. 5 . FOUNDAT [ON CONCRETE Soluble sulfate contents of soil and ground water are as follows : Water 5000 ppm Clay 1500 ppm ; a -2 - This presents conditions for potentially severe sulfate attack of concrete . Type II cement is recommended in concrete exposed to soils to resist this potential sulfate attack. If Type V cement is not available , Type II cement in a concrete mix having a maximum water-cement ratio of 0 . 45 may be used at somewhat greater risk of sulfate attack. Air entrainment of 4 to 6% , by volume , is recommended in all concrete exposed to soils or to freeze-thaw conditions . 6 . LIMITATIONS Test borings for this investigation were drilled at your specified locations , and data presented represents only this area of investigation. As the locations and the natures and magnitudes of foundation loads for the proposed equipment installations are not know, only general recommendations have been made for static foundations . If foundations are subject to dynamic loadings , such as for compressors , we suggest additional consultation re- garding the proper foundation design .
