Dear Ms. Aungst:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11,
2011 memorandums to county planning directors, this office will only perform a cursory
review of the referral information and provide informal comments. The comments do not
address the adequacy of the water supply plan for this project or the ability of the water
supply plan to satisfy any County regulations or requirements. In addition, the comments
provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
The application is for a Site Specific Plan and Use by Special Review Permit on a 34.8 acre
parcel described as Lot A of Recorded Exemption no. RE -4232. The applicant is proposing to
develop several mixed use buildings with uses including: the manufacturing of handcraft
organic skin care products, catering kitchen, office, event center for classes, retreats, and
weddings, day spa, greenhouse, and warehouse. The facility will be open 7 days per week
with up to 12 employees at full build out; 40 guests are expected on site daily, with up to 300
guests during weddings. There will be outdoor landscaping onsite. The proposed water supply
is a future well to be constructed under well permit no. 79178-F; the proposed annual amount
of water use is 11.6 acre-feet.
Permit no. 79178-F was issued on July 15, 2016 pursuant to section 37-90-137(4), C.R.S to
construct a well into the Lower Arapahoe aquifer. Its uses are limited to commercial,
irrigation, and domestic purposes at a pumping rate of 300 gpm with the annual appropriation
limited to 11.6 acre-feet. Information in this office indicates that the well has not been
constructed. The permit will expire on July 15, 2017 unless the applicant constructs the well
and installs a pump prior to the expiration date. The proposed uses of the well appear to be
consistent with the allowed uses on permit no. 79178-F.
So long as the applicant maintains a valid well permit and follows the permit conditions, this
office has no objections to this proposal. If you, or the applicant, have any questions please
