HomeMy WebLinkAbout20161664.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION, RECX16-0045 -MARK AND SUZY ZIGRAY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the request for Recorded Exemption, RECX16-0045, was submitted by Mark and Suzy Zigray, 9778 County Road 80, Fort Collins, Colorado 80524, for property which is located on the following described real estate, to-wit: Lot B of Recorded Exemption, RE-4362; being part of the NW1/4 of Section 23, Township 7 North, Range 67 West of the 6th P.M., Weld County, Colorado being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A," said plat to be recorded, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption, RECX16-0045, does not come within the purview of the definition of the terms "subdivision" and "subdivided land," and WHEREAS, this request is to divide the property into parcels estimated to be approximately 27 acres and 2 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms "subdivision" and "subdivided land." BE IT FURTHER RESOLVED by the Board that the application of Mark Zigray for Recorded Exemption, RECX16-0045, be, and hereby is, approved subject to the following conditions: 1. If a residence is to be constructed on proposed Lot A, a Weld County Septic Permit is required for the proposed Lot A septic system and shall be installed according to the Weld County On-site Wastewater Treatment System Regulations. 2. Topographic or physical features of the proposed lot, such as lakes/reservoirs, ditches, streams, etcetera, may limit the area available for a new or replacement septic system. Prior to recording the plat, the Environmental Health Division of the Weld County Department of Public Health and Environment recommends that the applicants review the County Code pertaining to Septic Systems to assure that any installed septic system will comply with all setback requirements found in the Code. In the event the proposed lot is not of sufficient size to allow the installation of a septic system, the lot may need to be enlarged. The applicant shall review the information and use it to positively manage on-site soils. 4. Prior to recording the plat: A. All septic systems located on the property shall have appropriate documentation/permits from the Weld County Department of Public Health and Environment. The Environmental Health Division of the Weld County Department of Public Health and Environment was unable to locate a septic permit for the septic system for the main house located on Lot B of this application. Any existing septic system which is not currently permitted through the Weld County Department of Public Health and Environment will require an evaluation prior to the issuance of the required septic permit. In the event the system is found to be inadequate, the system must be brought into compliance with current regulations. B. All septic systems must be located on their respective lots and meet all lot line setback requirements. The applicant shall provide a drawing of the septic systems, with dimension and distances from lot lines, to the Weld County Department of Public Health and Environment for verification of setbacks. C. The applicant shall provide a recorded copy of any agreement signed by all of the owners of the property crossed by the access. The access shall be for ingress and egress and shall be referenced on the plat by the Weld County Clerk and Recorder's reception number. D. The applicant shall address the requirements of Weld County School District RE-4, as stated in the referral response dated March 16, 2016. Evidence of such shall be submitted, in writing, to the Weld County Department of Planning Services. E. The property is in violation of Chapter 23 of the Weld County Code (Violation #ZCV16-00003). This violation was initiated due to the presence of more than one (1) Dwelling Unit without first completing the necessary Weld County Zoning Permits. The applicant has applied for a Zoning Permit for a second single-family dwelling (ZPSD16-0001) to allow a second single-family dwelling on the property; thereby, correcting the violation. The applicant shall address the Conditions of Approval for the Zoning Permit of a second single-family dwelling for this permit to be approved. F. Lot A shall comply with the one (1) acre net minimum lot size required by Section 24-8-40.L of the Weld County Code. Net acreage calculations should not include future road right-of-way. 2016-1664 RECX16-0045 RECX16-0045 - MARK AND SUZY ZIGRAY PAGE 3 G. The applicant shall provide the Weld County Department of Planning Services with a Statement of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. 5. Items to be included on the plat: A. The plat shall be titled: Recorded Exemption No. 0705-23-02 RECX16-0045. B. The applicant shall submit to the Weld County Department of Planning Services a recorded copy of any agreement signed by all of the owners of the property crossed by the access. The access shall be for ingress and egress and shall be referenced on the plat by the Weld County Clerk and Recorder's reception number. C. All approved accesses shall be clearly shown on the plat and labeled with the approved Access Permit Number (AP16-00034). The applicant shall contact the Weld County Department of Public Works to determine if a culvert is necessary at any approved road access point. D. County Road 80 is a gravel road and is designated on the Weld County Road Classification Plan as a local road, which requires 60 feet of right-of-way at full buildout. The applicant shall verify and delineate on the site map the future and existing right-of-way and the documents creating the existing right-of-way. If the existing right-of-way cannot be verified, it shall be dedicated. All setbacks shall be measured from the edge of future right-of-way. This road is maintained by Weld County. E. County Road 21 is a gravel road and is designated on the Weld County Road Classification Plan as a local road, which requires 60 feet of right-of-way at full buildout. The applicant shall verify and delineate on the site map the future and existing right-of-way and the documents creating the existing right-of-way. If the existing right-of-way cannot be verified, it shall be dedicated. All setbacks shall be measured from the edge of future right-of-way. This road is maintained by Weld County. F. Show the floodplain boundaries on the map. Label the floodplain boundaries with the FEMA Flood Zone and FEMA Map Panel Number. G. Setback radiuses for existing oil and gas tank batteries and wellheads shall be indicated on the plat, per the setback requirements of Section 23-3-50.E of the Weld County Code. H. All recorded easements and rights-of-way shall be delineated on the plat by book and page number or reception number. 2016-1664 RECX16-0045 RECX16-0045 - MARK AND SUZY ZIGRAY PAGE 4 The following notes shall be placed on the plat: 1) All proposed or existing structures will meet the minimum setback and offset requirements for the Zone District in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. No building or structure, as defined and limited to those occupancies listed as Groups A, B, E, F, H, I, M and R in Section 302.1 of the 2012 International Building Code, shall be constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead or within a 25-foot radius of any plugged or abandoned oil and gas well. Any construction within a 200-foot radius of any tank battery or 150-foot radius of any wellhead shall require a variance from the terms of Chapter 23 in accordance with Subsection 23-6-10.C of the Weld County Code. 2) Any future structures or uses on the site must obtain the appropriate zoning and building permits. 3) Lot A is not eligible for a future land exemption, in accordance with Section 24-8-20.C.1 of the Weld County Code. 4) The largest lot of any Recorded Exemption may not be less than thirty-five (35) acres net unless approved by the Weld County Board of Commissioners in accordance with Section 24-8-40.P. of the Weld County Code. 5) A Flood Hazard Development Permit is required for all construction or development occurring in the floodplain or floodway as delineated on Federal Emergency Management Agency (FEMA) FIRM Community Panel Map#08123C-1205E and 08123C-1211E, effective date January 20, 2016 (The Slough Floodplain). Any development shall comply with all applicable Weld County requirements, Colorado Water Conservation Board requirements as described in Rules and Regulations for Regulatory Floodplains in Colorado, and FEMA regulations and requirements as described in 44 CFR parts 59, 60, and 65. The FEMA definition of development is any man-made change to improved or unimproved real estate, including, but not limited to, buildings or other structures, mining, dredging, filling, grading, paving, excavation, drilling operations, or storage of equipment and materials. 6) FEMA's floodplain boundaries may be updated at any time by FEMA. Prior to the start of any development activities, the owner should contact Weld County to determine if the floodplain boundaries have been modified. 2016-1664 RECX16-0045 RECX16-0045 - MARK AND SUZY ZIGRAY PAGE 5 7) The installation of any septic system within the 100-year floodplain shall comply with the Weld County O.W.T.S. floodplain policy. In accordance with the State of Colorado O.W.T.S. Regulations, no septic system shall be installed within the floodway. 8) Prior to the release of building permits, the applicant shall submit a recorded deed describing the Lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the Lot designation and Recorded Exemption number. 9) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that Lot A has an adequate water supply of sufficient quality, quantity and dependability. 10) The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. 11) The historical flow patterns and runoff amounts will be maintained on the site. 12) Building permits shall be obtained prior to the construction of any building. Buildings that meet the definition of an Agricultural Exempt Building, per the requirements of Sections 29-1-20 and 29-3-20.B.13 of the Weld County Code, do not need building permits; however, a Certificate of Compliance must be filed with the Department of Planning Services and an electrical and/or plumbing permit is required for any electrical service to the building or water for watering or washing of livestock or poultry. 13) Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County-Wide Road Impact Fee Program. 14) Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County Facility Fee and Drainage Impact Fee Programs. 15) Potential purchasers are hereby notified that a Confined Animal Feeding Operation (USR-1091 for 2,000 cows, SUP-136 and USR-801 for 20,000 lambs) is located directly east of the intersection of County Roads 80 and 23. Off-site impacts that may be encountered include noise from trucks, tractors and equipment; dust from animal pens and odors from animal confinement, silage, and manure. 2016-1664 RECX16-0045 RECX16-0045 - MARK AND SUZY ZIGRAY PAGE 6 16) RIGHT TO EXTRACT MINERAL RESOURCES STATEMENT: Weld County has some of the most abundant mineral resources, including, but not limited to, sand and gravel, oil, natural gas, and coal. Under title 34 of the Colorado Revised Statutes, minerals are vital resources because (a)the state's commercial mineral deposits are essential to the state's economy; (b) the populous counties of the state face a critical shortage of such deposits; and (c) such deposits should be extracted according to a rational plan, calculated to avoid waste of such deposits and cause the least practicable disruption of the ecology and quality of life of the citizens of the populous counties of the state. Mineral resource locations are widespread throughout the County and person moving into these areas must recognize the various impacts associated with this development. Often times, mineral resource sites are fixed to their geographical and geophysical locations. Moreover, these resources are protected property rights and mineral owners should be afforded the opportunity to extract the mineral resource. 17) The Weld County Right to Farm Statement, as it appears in Section 22-2-20.J.2 of the Weld County Code, shall be placed on the map and recognized at all times. 6. Upon completion of Condition of Approval #1-5 above, the applicant shall submit an electronic version (.pdf), or one (1) paper copy, of the plat to the Weld County Department of Planning Services for preliminary approval. The plat shall be prepared in accordance with the requirements of Section 23-2-260.D of the Weld County Code. Upon approval of the plat, the applicant shall submit a Mylar plat, along with all other documentation required as Conditions of Approval. The Mylar plat and additional requirements shall be submitted within one hundred twenty (120) days from the date of the Board of County Commissioners Resolution. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services. The applicant shall be responsible for paying the recording fee. 7. In accordance with Weld County Code Ordinance #2012-3, approved April 30, 2012, should the plat not be recorded within the required one hundred twenty(120) days from the date of the Board of County Commissioners Resolution, a $50.00 recording continuance charge shall added for each additional three (3) month period. 8. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00. It is the opinion of the Department of Planning Services staff that the applicant has not shown compliance with the following criteria as listed in Section 24-8-40.A through 24-8-40.P of the Weld County Code: Section 24-8-40.P of the Weld County Codes states, "After August 3, 2010, the largest lot of any recorded exemption may not be less than thirty-five (35) acres net. This requirement may be waived by the Board of County Commissioners if the Board finds that extenuating circumstances experienced by the applicant justify approval of the recorded exemption and that the recorded exemption is not for the purpose of evading the requirements and intent of this Chapter." The property was divided in 1999 into 3 lots; Lot A, Lot B and Lot C of Recorded Exemption RE- 2364. Then in 2006, Lots A and B of RE-2364 were amended, moving the location of Lot A and increasing the size of Lot A. In 2006, Lot A of AMRE-2364 was split into two lots through the Recorded Exemption process case number RE-4361. Also in 2006, Lot B of AMRE-2364 was split into two lots through the Recorded Exemption process case number RE-4362. The applicant is requesting to split Lot B of RE-4362 (28.37 acres net) into two (2) lots. According to Section 24-8- 2016-1664 40.P of the Weld County Code Lot B's of Recorded Exemptions may not be less than thirty-five (35) acres net unless the Board of County Commissioners finds that extenuating circumstances and that the recorded exemption does not evade the requirements and intent of the subdivision regulations. The applicant has indicated they are creating the new lot to sell to for financial reasons. Planning staff has provided the applicant with an alternative, the Planned Unit Development (PUD) process. The applicant has elected to not pursue this option and continue to proceed with the Recorded Exemption process. Should the Board of County Commissioners approve this request, the Department of Planning Services staff recommends the following conditions be attached: 1. Moreover, these resources are protected property rights and mineral owners should be afforded the opportunity to extract the mineral resource. 17) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive agricultural counties in the United States,typically ranking in the top ten counties in the country in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with long-standing agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural areas: open views,spaciousness,wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well-run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work, harvest and gravel roads; odor from animal confinement, silage and manure; smoke from ditch burning; flies and mosquitoes; hunting and trapping activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. It is common practice for agricultural producers to utilize an accumulation of agricultural machinery and supplies to assist in their agricultural operations. A concentration of miscellaneous agricultural materials often produces a visual disparity between rural and urban areas of the County. Section 35-3.5-102, C.R.S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Water has been, and continues to be, the lifeline for the agricultural community. It is unrealistic to assume that ditches and reservoirs may simply be moved"out of the way" of residential development. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. People are exposed to different hazards in the County than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches,electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs and livestock, and open burning present real threats. Lind Farms, Inc. owns the real property located upon the east and south side of the property the subject of this building violation. Due to the fact that Lind Farms, Inc. immediately adjoins the subject property on the south and east side, it is necessary to advise you of certain items that affect the subject property in which Lind Farms, Inc. has a vested interest as well as the specific violations of the Weld County Code. The first issue relates to the septic tank and leach field which is apparently located on property owned by Lind Farms, Inc. and located immediately south of the pool enclosure which has been illegally converted into a single family residence, which becomes a second residence upon Lot B of Recorded Exemption 4362. Specifically, this second residence does not have any right or easement to use the septic tank and leach field assuming that the same are located upon Lind Farms, Inc. property. For your convenience, we attach copies of letters dated February 14, 2006 (Exhibit "A") and August 20, 2015 (Exhibit "B"). You will note that the February 14, 2006 letter advised the owners of the subject property, Mark and Suzanne Zigray,that use of the septic tank and leach field for the pool enclosure was permissive and subject to termination upon ninety (90) days notice. The letter dated August 20, 2015 did provide the ninety (90) day termination notice. To this date, Mr. and Mrs. Zigray have failed to terminate use of the septic tank and leach field which constitutes a trespass by the Zigray's upon the Lind Farms, Inc. property. 1 The reason the use of the pool enclosure, septic tank and leach field is permissive is due to the fact that Lind Farms, Inc. never granted an easement for the use of the septic tank and leach field. We suggest that you inspect the recorded exemption plats concerning these properties and you will see that there is no easement granted or shown upon any of the plats for use of the septic tank and leach field. The USR plats that you can inspect and determine the accuracy of this statement are as follows: Recorded Exemption Plat RE-4362, Recorded Exemption Plat 2364, Recorded Exemption Plat 4362, Recorded Exemption Plat 4361, and a Warranty Deed recorded February 19, 1988 as reception no. 02131454 (copy enclosed as Exhibit !/C1/ As an easement for said septic tank and leach field was never granted, the use of the septic tank and leach field is only permissive as stated in the February 14, 2006 letter and permission for the septic tank and leach field has now terminated. Even if it were (wrongly) determined that an easement existed for the benefit of the pool enclosure, the same cannot be used for a septic tank and leach field for a new single family residential dwelling as that would be a substantial expansion of the burden and change of the easement which is not permitted under Colorado law. Lind Farms, Inc. will consider granting an easement for said septic tank and leach field but only upon terms and conditions acceptable to Lind Farms, Inc. and upon execution of a written easement agreement which will then be recorded. If an easement agreement is not entered into, it will be necessary for Mr. and Mrs. Zigray to construct a new septic tank and leach field upon property which they own and which property is in conformance with the Weld County Code. Termination was given due to the fact that Lind Farms, Inc. plans on installing a pipeline and utilities for irrigation in the same location where the septic tank and leach field is located which was mentioned in the August 20, 2015 letter. As a courtesy, Lind Farms, Inc. will delay installation of those new facilities until March 1, 2016 which gives ample time for the Zigray's to (1) terminate any use of the existing septic tank and leach field for the pool enclosure/illegal residence; (2) construct a septic tank and leach field upon their own property; or (3) enter into an easement agreement with Lind Farms, Inc. for said septic tank and leach field. The second issue is related to ingress and egress for any new or proposed parcel of land which might be created in accordance with the Weld County Code such as a new recorded exemption specifically for the newly created single family residence. We suggest you inspect RE 2364 which does show and specifically provide for an access easement for the benefit of Lots A, B and C of recorded exemption 2364 which road is located east of the eastern boundary of what is currently Lot B of RE 4362. If a new parcel is requested to be created, the new parcel will not have the benefit of said road easement as that would be an expansion of the easement which is not permitted under Colorado law except upon approval of the property owner, namely, Lind Farms, Inc. Any new parcel must contain any provision that use of the existing easement road is strictly prohibited. Obviously, Mr. and Mrs. Zigray could create an easement upon their own property for the new lot. 2 Similar to the septic tank and leach field use, Lind Farms, Inc. will consider granting an easement for ingress and egress upon the existing road for any new parcel. However, until such an easement agreement is entered into, Lind Farms, Inc. will not consent to use of the existing road for any new or expanded purpose. Due to the fact that Lind Farms, Inc. has a vested interest in any creation of new lots or building permits which would necessarily involve access and septic, we request that you contact the undersigned regarding any applications for building permits,septic permits or parcel creation either on a permanent or temporary basis. It has been called to our attention that the septic tank and/or leach field may have failed or are not properly operating. We have noticed that there has been some effluent flowing and seeping onto the property owned by Lind Farms, Inc. It is necessary that you make immediate repairs or replace said septic tank and leach field to avoid any health issues. The referenced property is located south of and adjacent to Weld County Road 80 and east of and adjacent to Weld County Road 21. Although student and land impacts associated with this project appear minimal, already approved residential development within the area of the project contributes to a substantial cumulative impact upon Weld County School District Re-4. In addition, the effect upon school site planning is significant because of the difficulty in acquiring school sites in the appropriate locations and sizes to serve such dispersed development. Given the rapid growth of other areas within the School District, Weld Re-4 remains concerned with its financial ability to provide for continuing growth within the area of the project. This and related concerns are discussed in detail below. Site Issues Weld County Re-4 understands that the project proposes to add one additional lot to the existing property. Land dedication is not feasible to offset the impact of growth upon the School District. Therefore, District Re-4 requests cash-in-lieu of land for the additional lots at the current market value of land within the area (see recommendations). Further, the District requests the opportunity to respond to any land use changes associated with either lot. Facility and Fiscal Capacity Issues Range View Elementary School, Severance Middle School and Windsor High School currently serve this area. Approved development far exceeds the District's current capacity to fund educational facilities. Consequently, continual approval of new projects can create expected seat (capacity) shortages. As of December 1, 2015, the District's total bonding capacity approximates $156.6 million at 25 percent of assessed valuation per state statute. Debt outstanding from previous bond elections totals $31.3 million leaving $125.3 million available for future facility needs throughout the District. Given residential development and student potential from already approved but not completed projects, this amount is likely deficient to provide the necessary school facilities. For example, the District expects that within three years, a new high school will likely be required. The costs associated with building a new high school will consume a large part of the remaining debt capacity, compromising the District's ability to provide for other areas of need, including the elementary and middle school levels. Inadequate bonding capacity is the direct result of residential growth occurring at a pace that well exceeds the District's statutorily limited ability to fund school construction. Recommendations The School District remains very concerned about residential activity and the ensuing enrollment that will follow as well as the District's physical and financial abilities to serve that growth. Because land dedication is not feasible from this project, the District requests that the owner agree to pay cash in lieu of land at the current market value of land within the District. Assuming payment of cash-in-lieu of land at the value of$2,240 for the additional lot, the School District does not object to approval of this zoning permit. In addition, the School District requests to be notified of any proposed land use changes associated with either lot. Cooperation of all parties is necessary in offsetting the adverse fiscal impacts of rapid residential growth upon the School District's statutorily limited resources.
