COMMENTS: General Project Information/Location: Project description: Dog Rescue and Boarding This project is east of and adjacent to Woodruff Ave and south of and adjacent to Morris Ave (south of CR18 and is east of CR31. Parcel number: 130927108001 Drainage Requirements: Please contact Department of Planning Services/Engineering Development Review for questions or assistance for drainage requirements at 970-353-6100. URBANIZING VS NON -URBANIZING DRAINAGE AREA: This area IS within a Non -Urbanizing Drainage Area: Require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for NON -URBANIZING areas. Detention pond waived and a simple drainage narrative: A drainage narrative is required and full drainage report and detention pond waived if the site qualifies for an exception to detention requirements listed below. The drainage narrative must include at the minimum: 1. Description which exception is being applied for and supporting rationale 2. Where the water originates if it flows onto the property from an offsite source 3. Where it flows to as it leaves the property 4. The direction of flow across the property 5. If there have been previous drainage problems with the property Exceptions. 1. Exceptions to stormwater detention shall not jeopardize the public health, safety, and welfare of public and private property. Exceptions shall be supported with a drainage narrative. a. No stormwater detention will be required for sites that meet any of the following conditions. Requirements of the Municipal Separate Storm Sewer System (MS4) areas remain applicable. 11) Parcels with total area less than, or equal to, a 1.0 gross acre. The Applicant has submitted a Drainage Narrative stating that they will be meeting exception 1.A.11, parcels with total area less than, or equal to, 1.0 gross acre. MS4: This site is not in a defined Municipal Separate Storm Sewer System (MS4) area which is a more urbanized area with state mandated, higher water quality requirements Geologic Hazard Area: This area IS NOT in a Geologic Hazard Area. Floodplain: This area IS NOT in a FEMA regulatory floodplain. CONDITIONS OF APPROVAL: A. The plan shall be amended to delineate the following: 1. The applicant shall show the drainage flow arrows. Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Project description: A Site Specific Development Plan and Use by Special Review Permit for a Kennel (for rescue and boarding of 32 animals, both dogs and cats) in the A (Agricultural) Zone District. This project is south of and adjacent to Morris Avenue and is east of and adjacent to Woodruff Street. Parcel number 130927108001. Access is from Woodruff Street. Access: An Access Permit application was submitted with the application materials. Public Works will review the application and provide an access permit and permit number if approved. Questions concerning access requirements can be directed to Public Works access permit division. An Access Permit is required. For new accesses and/or change of use of an existing access, the fee and photos are required (Access permit instructions and application can be found at http:/Iwww.co.weld.co.usIDepartments/PublicWorks/Permits html.) Chapter 6, Sections 6.3, 6.4 and 6.5 of the Weld County Engineering and Construction Criteria, offer access design guidance. (This document can be found at http://www.co.weld.co.us/Departments/PublicWorks/EnqineeringandRightofWay/EnclineeringCriteraandP olicies.html) Existing access points with change of use or new access points may or may not be granted. Questions pertaining to access permits or access design shall be directed to the Public Works Department. For shared accesses, Public Works strongly recommends that the property owner establish an access road maintenance agreement so future owners of the properties will be aware of their requirements for shared maintenance of the access road. This is not a requirement for the recorded exemption but is recommended to avoid property owner conflicts in the future. Entrance gates (if applicable) must be set back a minimum of 100 feet from edge of shoulder to allow a truck with trailer or RV to pull completely off of the roadway and open the gate. In no case shall any vehicle(s) stopped to open a gate be allowed to create a safety issue for roadway users. When feasible, there shall be no net increase in the number of accesses to a public road. Roads: Morris Avenue is a gravel road and is designated on the Weld County Road Classification Plan as a local road, which requires 60 feet of right-of-way at full buildout. The applicant shall delineate on the site plan the future and existing right-of-way. All setbacks shall be measured from the edge of future right-of-way. This road is maintained by Weld County. Traffic: No traffic counts are available in the area. The traffic information submitted with the application materials indicated that there will be approximately less than 1 daily roundtrips. TRACKING CONTROL: Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are listed below. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. Less than 20 passenger vehicle round trips/day, no upfront tracking control requirements. Improvements and Road Maintenance Agreement: No improvements agreement will be required as the anticipated traffic is less than 21 round truck trips/day or 50 round passenger vehicle trips/day or if defined as a Site Plan Review (SPR). A development standard will be applied to the recorded map indicating any impacts to the road must be mitigated by the owner. The access on the site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking. CONDITIONS OF APPROVAL: A. (Department of Public Works) WELD COUNTY DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT 1555 North 17th Avenue, Greeley, CO 80631 www.weldhealth.org Memorandum To: From: Date: Diana Aungst Lauren Light, Environmental Health Services October 24, 2016 Re: USR16-0038 Richard Martinez, c/o Furever Dog Rescue and Boarding, c/o Debbie Linder Environmental Health Services has reviewed this proposal for a Site Specific Development Plan and Use by Special Review for a Kennel (up to 75 dogs, six (6) months of age or older of a non-specific breed to include doggie daycare and boarding) in the A (Agricultural) Zone District. There is one home and the kennel facility on the site. Aristocrat Ranchette Water supplies water and a permitted septic system (G19910290) sized for 2 bedrooms (4 people) provides sewer. A Pet Animal Care Facilities Act (PACFA) license is required. The application indicates that pea gravel and driveway rock will be installed. We recommend that the following conditions be part of any approval: We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with Chapter 14, Article 1 of the Weld County Code. 4. Fugitive dust should attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations. 5. The facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as delineated in 25-12-103 C.R.S. 6. Adequate drinking, hand washing and toilet facilities shall be provided for employees, volunteers and the public, at all times. For employees, public or volunteers on site for less than 2 consecutive hours a day, and 2 or less full time employees on site, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 7. In the event the applicant intends to utilize the existing septic system at the home (G19910280) for business use, the septic system shall be reviewed by a Colorado Registered Professional Engineer if the usage exceeds 4 people. The review shall consist of observation of the system and a technical review describing the system's ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 8. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to On -site Wastewater Treatment Systems. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 9. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are minimized. 10. The applicant shall comply with the Colorado Department of Agriculture (CDA), Division of Animal Industry regulations. 11. The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. MEMORANDUM To: Diana Aungst, Planner September 28, 2016 From: Bethany Pascoe, Zoning Compliance Officer Subject: USR16-0038 Referral Upon review of my case files and computer, an active Zoning Violation (ZCV16-00067) was noted. This violation was initiated due to the operation of a Dog Rescue (Furever Dog Rescue & Boarding) without first completing the necessary Weld County Zoning Permits. This case has been forwarded to the County Attorney's Office and we have initiated legal action; therefore, an investigation fee IS required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff initiated complaints. If this application if approved by the Board of County Commissioners it will correct this outstanding violation. If this application is denied, the Department of Planning Services asks that the Board forward this case to the County Attorney's Office for legal action through the District Court process, but to delay that legal action for 30 (thirty) days to allow the applicant time to remove the dog rescue, address the building concerns and reduce to no more than 4 (four) dogs.
