shall receive compensation on a per diem basis to be agreed upon by

DECREE OF FINAL SETTLEMENT
OF GERALD S. TURNER,
AND DETERMINATION OF HEIRSHIP
Deceased.
And now on this day comes Robert W. Turner, the
Executor of the estate of Gerald S. Turner, deceased, and pre-
sents to the Court a final account and report of his administra-
tion of said estate, and asks that the same be approved and
that he be discharged.
And from the records and files herein, the Court doth
find that said decedent died on or about the 7th day of May,
A. D. 1952, a resident of the County of Larimer, State of Colo-
rado; and thereafter Robert W. Turner was duly appointed Executor
of said Estate.
And it further appearing to the Court and the Court
doth find that subsequently and on or about August 15, 1952,
Edith C. Turner, the widow of the said Gerald S. Turner, deceased,
filed herein her election to take one-half of the decedent's
estate as provided in Section 37 (a), Chapter 176, 1935 Colorado
Statutes Annotated.
And it further appearing to the Court and the Court
doth find that a notice to creditors to file claims against
said estate was published as required by law, and that all claims
allowed by the Court against said Estate, and all costs of
administration, and inheritance taxes have been paid, and that
notices have been sent to all claimants whose claims had not
been allowed, of the date fixed for final settlement as required
by law and such claims of such claimants have been allowed and

satisfied or disallowed.
And the Court doth further find that the statutory
period for filing claims has elapsed, and that there has been
published a proper Notice that said final account would be pre-
sented for final settlement on Monday, the 15th day of February,
A. D. 1954, and that the hearing was regularly continued to this
date.
And it appearing to the Court that there has been
filed herein an agreement and consent to a decree of final settle-
ment signed by Edith C. Turner, the widow of decedent, Robert
W. Turner, W. Lloyd Turner and Dorothy Turner Dunn, the children
of said decedent, whereby the said persons have requested the
Court to allow distribution of the entire net estate or residue
as follows:
1. To Edith C. Turner, widow, an undivided one-half
in and to all real and personal property, which undivided one-half
interest would be computed with the value of the premises devised
intrust for Peter T. Matthews included, but such undivided one-
half interest is not to include any portion of the said premises
devised in trust for the said Peter T. Matthews.
2. That the following described premises, to wit:
The East Half (Et) of Section Twenty-one (21),
Township Eight (d)) North, Range Sixty-seven
(67) West of the Sixth Principal Meridian;
shall be held in trust by Robert W. Turner for the use and
benefit of Peter T. Matthews, paying to the said Peter T. Matthews
annually any net income from said premises, until the said Peter
T. Matthews shall have attained the age of twenty-five (25) years
at which time Robert W. Turner, as such trustee, shall convey
said premises to Peter T. Matthews, free and clear of any en-
cumbrances. By virtue of said agreement the widow and three

children of the decedent have executed and placed in escrow
their quit claim deed, quitclaiming said premises to the said
Peter T. Matthews, and which deed is to be delivered to Peter
T. Matthews upon his attaining the age of twenty-five (25)
years.
3. That the remainder of said residue or net estate,
after an undivided one-half thereof is taken by Edith C. Turner
and after the premises devised in trust to Robert W. Turner for
the use of Peter T. Matthews are excluded, shall be divided,
share and share alike, among Robert W. Turner, W. Lloyd Turner
and Dorothy Turner Dunn, and that such shares shall be undivided
shares both as to realty and as to personalty.
The Court having considered the Will, the effect there-
upon of the said election of the widow and the agreements and
requests hereinabove recited, doth find that the said election
of Edith C. Turner to take under the statute eliminated the
trust for her benefit created by Paragraph the Second of
decedent's last Will and Testament, and that it was the intent
of the testator that his children, if living, should take and
receive, share and share alike, all the rest, residue and re-
mainder of his estate after the devise in trust for the benefit
of Peter T. Matthews of the Eaat One-Half (El) of Section
Twenty-one (21), Township Eight (8) North, Range Sixty-seven
(67) West of the Sixth Principal Meridian, and conveyance of
the fee therein to the said Peter T. Matthews at the time he
shall attain the age of twenty-five (25) years, and after the
undivided one-half of his estate is set aside for his widow
in accordance with her election, and doth also find that all
of decedent's children were living at the time of his death
and are now living, and doth further find that the agreements
• and requests hereinabove mentioned are reasonable and should
be carried out.

THEREFORE THE COURT DOTH DECREE that the said net
estate of decedent shall be divided and distributed in the
manner recited in Items 1, 2 and 3 hereinabove set forth and
Both construe the last Will and Testament of decedent to mean
that in the event his widow should elect to take under the
statute that then and in such an event his estate shall be
given, devised and bequeathed in the manner specified in Items
1, 2 and 3 hereinabove set forth.
And having heard and examined the account and report
of the said Robert W. Turner, Executor, loth find that said
estate has been fully and faithfully administered and the
account and report of said Executor is hereby approved.
The Court further doth construe, ascertain and de-
termine that by virtue of decedent's last Will and Testament,
title to the premises described therein, to wit:
The East One-half (Ef) of Section Twenty-one
(21), Township Eight (8) North, Range Si::ty-
seven (67) West of the Sixth Principal Meri-
dian;
passed thereby to Robert W. Turner as trustee for the use and
benefit of Peter T. Matthews until Peter T. Matthews shall have
attained the age of twenty-five (25) years, at which time
Robert W. Turner, as trustee, shall convey to the said Peter
T. Matthews, the title to said premises free of any encum-
brances.
And 1t appeaing to the Court that a verified Petition
was heretofore filed herein by Robert W. Turner, Executor of
the estate of Gerald S. Turner, asking for the judicial ascer-
tainment and determination of the heirs of said deceased; that
notice of the hearing of such petition has been given as re-
quired by the statutes of the State of Colorado; that all re-
quirements of lay and the orders of this Court have been

WHEREAS, Grantor is the qualified Personal Representative of
