HomeMy WebLinkAbout770604 RESOLUTION RE : TRANSFER OF ESCROW FUNDS USED TO GUARANTEE COMPLIANCE WITH COUNTY ROAD SPECIFICATIONS FOR MILTON LAKES ESTATES FIRST FILING FROM WELD COUNTY TREASURER TO WELD COUNTY ROAD AND BRIDGE. WHEREAS, on July 7 , 1970 , two cashier checks were posted by the subdivider of Milton Lakes Estates First Filing to guarantee compliance with County road specifications, and WHEREAS, on April 7, 1971, by a motion, the Board of County Commissioners deposited these checks in escrow with the Weld County Treasurer, and WHEREAS, these roads have not as yet to date, been completed as to County road specifications , and WHEREAS , there is a need that these roads be brought up to County road specifications. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the sum of Three Thousand Seven Hundred Fifty-five Dollars ($3 , 755. 00) held in Escrow with the Weld County Treasurer for Milton Lakes Estates First Filing, to guarantee compliance with County road specifications , be , and here- by is transferred to the Weld County Road and Bridge Fund to be applied to bring these roads up to County specifications. The above and foregoing Resolution was , on motion duly made and seconded, adopted by the following vote on the 23rd day of March, A.D. , 1977. M. , Weld County, Colorado, more particularly described as follows: Beginning at the Southeast corner of said Section 13; thence N00° 00' 00" E on an assumed bearing along the East line of said Section 13 a distance of 5289.50 feet to the Northeast corner of said Section 13; thence NOO° 00' 00" E along the East line of said Section 12, a distance of 2644.75 feet to the East quarter corner of said Section 12; thence S89° 49' 03". Contains 387.52 Acres m/1 and BE IT FURTHER RESOLVED, that the accompanying plat is approved for filing, and the public roads, streets, highways and easements thereon shown are approved, provided however, that the County of Weld will not undertake maintenance of said streets, roads and rights-of-way until they have been constructed by the subdivider according to specifications and accepted by the County of Weld, and • BE IT STILL FURTHER RESOLVED, that the cashiers checks posted July-7, 1970, by the subdivider, in the sum of $3,755.00, will remain in effect for said Milton Lakes Estates, First Filing, to guarantee absolute compliance with County Road Specifications and that said cheek shell continue for one year after completion of said roads or unless sooner released by action of the Board.
